RESOLUTION APPROVING CATEGORICAL EXEMPTION,
AND SPECIAL PERMIT FOR TAKE-OUT FOOD
RESOLUTION NO. B2-96
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
specialeo rmit for take-out food at 1400 Burlingame Avenue zoned C-1 Subarea A APN• 029-122-
190 ; Peter S Umland Umland Properties 904 Peninsula Avenue #406 San Mateo property owner
WHEREAS, the Planning Commission held a public hearing on said application on Se tember
2-, 1996 , at which time said application was denied;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on OGtober
21. 1996 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this council, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption per
Article 19. Section: 15301- Existing Facilities, Class 1(a), Interior or exterior alterations involving such
things as interior partitions, plumbing, and electrical conveyances is hereby approved.
2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official
records of the County of San Mateo.

Conditions of approval categorical exemption and special permit for take-out food
1400 BURLINGAME AVENUE
effective OCTOBER 21, 1996
1. that the conditions of the City engineer's June 29, 1996 memo shall be met;
2. that the business may be open Monday through Sunday 6:00 a. in. to 9:00 p.m. with
a maximum of three employees on site at any one time, including the proprietor;
3. that the food items sold from this site shall be limited to those which are
manufactured off the site and prepackaged except for frozen slushies, coffee and hot
chocolate prepared on-site and sold individually for consumption on or off the
premise; and which shall not exceed 15% of the gross sales from the site;
4. that the applicant shall purchase and maintain at least daily, more often if necessary,
a trash receptacle inside the door to the store and on the sidewalk along Burlingame
Avenue at a location approved by the City Engineer and Fire Department;
5. that trash receptacles on the sidewalk shall be replaced by the trash receptacle
selected by the Burlingame Avenue Streetscape Study and shall be paid for by the
property owner and in place within 30 days of notification by the city of the
availability of the trash receptacle;
6. that the applicant shall remove once -a -day or more frequently, if determined to be
necessary by the City, all take-out debris on the sidewalk, in the gutter, and in
planters, in front of the store along Burlingame Avenue and within 50' of the store
in each direction;
7. that the permit shall be reviewed when the proprietor of the business changes; and
8. that the project shall meet all the requirements of the municipal code of the 1995
edition California Building and Fire Code as amended by the City of Burlingame.
