CATEGORICAL EXE TION, SPECIAL PERMIT AND VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a special
permit for 2'-9" separation between structures (garage and remodeled house) where 4'-0" is required and
variances for a side setback variance for the existing earage for 1'-6" side setback where 4'-0" is required
and a parking variance for 18'-4" in garage depth where 20'-0" is required at 1421 Bernal Avenue, APN:
026-054-040 ; property owner: Bob and Candace Savoie, 1421 Bernal Avenue; and
WHEREAS, the Planning Commission held a public hearing on said application on May 8 , 1995,
at which time said application was denied;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on June 5. 1995,
at which time it reviewed and considered the staff report and all other written materials and testimony
presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and
by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received
and addressed by this council, it is hereby found that there is no substantial evidence that the project set forth
above will have a significant effect on the environment, and Categorical Exemption per Section: 15301 -
Existing Facilities Class 1(e), Additions to existing structures provided that the addition will not result in
an increase of more than 10,000 SF if the project is in an area where all public services and facilities are
available to allow for maximum development permissible in the General Plan and the area in which the
project is located is not environmentally sensitive is hereby approved.
2. Said Variance and Special Permit are approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such variance and special permit are as set forth in the minutes and recording
of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of the
County of San Mateo.

Conditions of approval categorical exemption, special permit, side setback variance and parking variance
1421 BERNAL AVENUE
effective JUNE 5, 1995
1. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped April 3, 1995, Sheet 1, Site Plan; Sheet 2, Demolition Plan and Section; Sheet 3, First
Floor Plan; Sheet 4, Second Floor Plan with eave layout as shown on 81/2" X 11" plan view date
stamped April 28, 1995; and Sheet 5, Elevations;
2. that if the existing nonconforming accessory structure (garage) is ever demolished it shall be replaced
with a garage that meets current zoning code requirements and is located in the rear 30% of the
length of the lot; or variances and special permits shall be received before any new accessory
structure shall be built; and
3. that the use and any improvements for the use shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of Burlingame.
