HomeMy WebLinkAboutReso - CC - 007-1994G RESOLUTION NO. 7-94 RESOLUTION APPROVING CONDOMINIUM PERMIT, NEGATIVE DECLARATION AND SUBDIVISION MAP - 808 -820 -EL CAMINO REAL (APN 029-012-160/170/180) RESOLVED, by the City Council of the City of Burlingame that: WHEREAS, application was made to the Planning Commission of the City of Burlingame for a residential condominium permit at 808-820 E1 Camino Real; and WHEREAS, said application and the negative declaration and condominium permit therefore were heard by the Planning Commission of the City of Burlingame on November 8, 199.3, said hearing being properly noticed as required by law; and WHEREAS, the negative declaration was approved, the condominium permit was denied and denial of the subdivision map were recommended by the Planning Commission, a timely appeal was filed, and a public hearing upon said appeal was scheduled and held by the City Council on February 7, 1994, -and continued to March 7, 1994: NOW, THEREFORE, IT IS ORDERED AND DETERMINED by the City Council of the City of Burlingame: 1. The decision of the Planning Commission denying the condominium permit for 808-820 El Camino Real is hereby reversed and the project as described in those plans. date stamped February 28, 1994, is hereby approved, subject to the conditions set forth 7 in Exhibit"A". The subdivision map for said project, date stamped February 25, 1994, is also approved. 2. on the .basis of the Initial Study, the documents submitted and reviewed, and comments received and addressed by the Planning Commission and this Council, it is hereby found that this project will not have significant effects on the environment. Negative Declaration ND -466-P is therefore approved. 3. That the following findings of fact are made regarding said project: (a) The approved project is for a 18 unit condominium at 808- 820 El Camino Real, as more fully set forth in said application dated October 4, 1993, and as modified by said plans date stamped February 28, 1994; (b) The condominium as described in the staff report, said plans and in the testimony at the hearing meets the condominium standards of the Burlingame Municipal Code 4. The granting of the condominium permit would be in the interests of the health and welfare of the persons using said property, of the City of Burlingame, and in conformity with reasonable and orderly use of the property. 0 , MAYOR E I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution.was introduced at a regular meeting of the City Council held on the 7th day of February, 1994, and was adopted thereafter by the following vote: AYES: COUNCILMEMBERS: HARRISON, O'MAHONY, PAGLIARO, SPINELLI NOES: COUNCILMEMBERS: KNIGHT ABSENT: COUNCILMEMBERS: NONE ITY CLERK 3 CONDITIONS OF APPROVAL, NEGATIVE DECLARATION & CONDOMINIUM PERMIT 808 TO 820 EL CAMINO REAL, 18 UNIT RESIDENTIAL CONDOMINIUM (effective March 7, 1994) EXHIBIT A 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped February 28, 1994 Sheets A-1, A-4 to A-7, A-9 to A-10 ,except that Sheet A-4 shall be revised to meet the 8-1/2" x 11" plan submitted with the arborist's October 5, 1993 letter, each unit shall have a minimum of 75 square feet of private open space, and with the following revisions required by the City Council as conditions of their approval action: the bedroom in unit C facing the rear property line and the bedroom in unit E facing the rear property line shall be removed at the third floor level and replaced with a flat roof or deck with sufficient slope to drain properly; the square footage represented by the two bedrooms (one in unit C and one in unit E) shall be deleted from the project; that the exterior covering of the structure shall be wooden shingle; and that the elevator penthouse/mechanical equipment shall be relocated to the north end of the structure so that it can be screened behind the bedroom towers remaining on the rear elevation of the building; 2. that the project shall be built as shown on the topographic survey date stamped September 7, 1993, vesting tentative subdivision map date stamped February 25, 1994, except that the joint drainage easement and egress easement shall be located so that the driveway is no closer than 12 feet to any portion of the church structure or attached accessory structures; the final subdivision map filed shall have the easement now shown for "ingress/egress" changed to be labeled "for egress only"; and that the storm water drainage easement shall be shown at the location determined with this action; and that the driveway to the below grade parking area shall be designed to stay clear of the pedestrian walkway and lobby area and that traffic control sensors and warning lights and two mirrors as approved by the City Engineer shall be installed on the ramp to insure vehicular safety; 3. that the conditions of the Fire Marshal's September 13, 1993 memo, Chief Building Official's February 23, 1994, and City Engineer's October 19, 1993 and February 24, 1994 memos shall be met; 4. that the conditions of the Parks Director's memo of September 13, 1993 shall be met, including and referencing arborists McClenahan and Huntington's letters of June 19, 1992 and June 5, 1992 respectively regarding the species redwood tree on site and Richard Huntington's letter of October 5, 1993 regarding the maple tree on 815 Fairfield Road and that Sheet L-1 showing the landscape plan date stamped September 7, 1993 shall be revised to: match the revised site plan date stamped February 28,1994; shall include a 6 foot tall solid board fence with 1 foot of lattice (total 7' as measured from highest adjacent grade) along the rear property line of the project and extended beyond to the full width of the property at 819 Fairfield Avenue; and shall meet all the landscape requirements of the City of Burlingame as determined by the Director of Parks; CONDITIONS OF APPROVAL, NEGATIVE DECLARATION & CONDOMINIUM PERMIT 808 TO 820 EL CAMINO REAL, 18 UNIT RESIDENTIAL CONDOMINIUM (effective March 7, 1994) page -2- 5. that the applicant provide both a copy of the latest purchase agreement between the church and the developer and documentation of a recorded easement, including provisions for landscape maintenance for the landscaping on church parking lot, for review and approval by the City Attorney prior to issuance of a building permit; 6. that the maximum elevation at the top of the roof ridge and parapet wall shall not exceed elevation 71.59' (34.961) as measured from the average elevation at the top of the curb along E1 Camino Real, and that the top of each floor and final roof ridge shall be surveyed and approved by the City Engineer as the framing proceeds and prior to final framing inspection and roofing; 7. that a total of two (2) guest parking stalls shall be designated and marked on the final map and plans, these stalls shall not be assigned to any unit or purchased by any owner of any unit shall be outside the security gate and shall be owned and maintained by the condominium association; 8. that the parking garage shall be designed to city standards and shall be managed and maintained by the condominium association to provide parking at no additional fee, solely for the condominium owners and their guests, and no portion of the parking area and aisles shall be converted to any other use than parking or used for any support activity such as storage units, utilities or other non -parking uses; 9. that a security gate system with an intercom to each unit shall be provided for access to the below and on -grade parking areas; 10. that construction take place only during hours as specified in the Burlingame Municipal Code Section 18.08.035; 11. that particulate matter created during construction not exceed levels as specified in the Bay Area Air Quality Management District's regulations 1 and 6; 12. that the final inspection shall be completed and a certificate of occupancy issued before the close of escrow on the sale of each unit; 13. that the developer shall provide the initial purchaser of each unit and to the board of directors of the condominium association, an owner purchaser manual which shall contain the name and address of all contractors who performed work on the project, copies of all warranties or guarantees of appliances and fixtures and the estimated life expectancy of all depreciable component parts of the property, including but not limited to the roof, painting, common area carpets, drapes and furniture; and 14. That the project shall meet all required disabled accessible standards, all other requirements of the Burlingame Municipal Code and all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame.
