COLEMAN CRY ATTORNEY CITY OF BURLINGAME 801 PRIMROSE ROAD BURIJNGAMIE CAUR 94010 VIMM619twel LNN Me] on gull will - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME DECLARING ITS INTENTION TO RE-ESTABLISH THE BROADWAY AREA BUSINESS IMPROVEMENT DISTRICT AND ESTABLISH 1995-1996 ASSESSMENTS THEREFORE WHEREAS, the California Streets and Highways Code Section 36500 et sea., authorizes cities to establish parking and business improvement areas for the purpose of promoting economic revitalization and physical maintenance of business districts in order to create jobs, attract new business and prevent erosion of the business district; and WHEREAS, the Broadway Area Business Improvement District was established on June 1, 1992, and is to terminate on June 30, 1995, and the Advisory Board of said district has requested the Burlingame City Council to re-establish such an improvement district and to establish 1995-1996 assessments therefore. NOW, THEREFORE, the City of Burlingame does hereby resolve, determine, and find as follows: 1. The City Council does, at the request of said Advisory Board and pursuant to the California Streets and Highways Code Sections 36500 et sea., declare its intention to re- establish the BROADWAY AREA BUSINESS IMPROVEMENT DISTRICT ("the District"). 2. The boundaries of the entire area to be included in the District are set forth on Exhibit "A," incorporated herein by reference. The street addresses of the included properties are set forth on Exhibit "B." In the case of conflict or omission, Exhibit "A" shall prevail. 3. The types of improvements and activities proposed to be funded by the levy of assessments on business in the District are set forth in Exhibit "C," incorporated herein by reference. 4. If the majority written protest is only as to an improve- ment or activity proposed, then that type of improvement or activity shall not be included in the District. 12. Further information regarding the BROADWAY AREA BUSINESS IMPROVE- MENT DISTRICT and the proposed assessments may be obtained from the City Clerk at City Hall, 501 Primrose Road, Burlingame, CA 94010. 13. The City Clerk is instructed to provide notice of the public hearing as follows: a. Publish this Resolution of Intention in a newspaper of general circulation in the City of Burlingame once, at least ten (10) days before the public hearing. b. Mail a complete copy of this Resolution of Intention to each and every business owner in the District within seven (7) days of the adoption of this Resolution by the City Council. MAY I, JUDITH A.
