RESOLUTION APPROVING NEGATIVE DECLARATION
CONDOMINIUM PERMIT, CONDITIONAL USE PERNIIT AND PAREING VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame that:

zone and two guest spaces for a 20 unit residential condominium project at 1733 California Drive.

WHEREAS, the Planning Commission held a public hearing on said application on January
22, 1995 , at which time said application was approved;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on
February 21. 1995 , at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this council, it is hereby found that there is no substantial evidence that the

project set forth above will have a significant effect on the environment, and Negative Declaration
ND- 475-P is hereby approved.

2. Said condominium permit, conditional use permit and parking variance is approved subject to

the conditions set forth in Exhibit "A" attached hereto. Findings for such condominium permit,

use and parking variance are as set forth in the minutes and recording of said
conditional permit

3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

effective FEBRUARY 21, 1995
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped December 19, 1994 Sheets; Al, A2.1, A2.2, A3.1, A3.2, A3.3, A3.4,
A4.1, Schematic Landscape Plan and Tentative Map and amended by Sheet A3.1 dated
January 17, 1995, East Elevations and North Elevation;
2. that the overall height of the buildings shall not exceed 35'-0" as measured from the
average top of curb at the front of the lot;
3. that the Associate Civil Engineer's comments dated December 28,1994 and January 12,
1995, the Park Director's comments dated December 13, 1994, the Chief Building
Official's comments dated December 2, 1994 and the Fire Marshal's comments dated
December 14, 1994 shall be met;
4. that the final inspection shall be completed and a certificate of occupancy issued before
the close of escrow on the sale of each unit;
5. that this project is subject to the requirements of Chapter 11.06 of the municipal code
prior to the issuance of a building permit; and that if meeting the requirements of
Chapter 11.06 requires a redesign, the project must be resubmitted to the Planning
Commission for their review;
6. that the developer shall provide the initial purchaser of each unit and to the board of
directors of the condominium association an owner/purchaser manual which shall contain
the name and address of all contractors who performed work on the project, copies of
all warranties or guarantees of appliances and fixtures and the estimated life expectancy
of all depreciable component parts of the property, including but not limited to the roof,
paint, common area carpets, drapes and furniture; and
7. that the project shall meet all federal access standards, all other requirements of the
Burlingame Municipal Code and the Uniform Building codes and Uniform Fire Codes
as amended by the City of Burlingame.
