RESOLUTION NO. 25-96
RESOLUTION APPROVING CATEGORICAL EXEMPTION,
SIDE SETBACK, LOT COVERAGE AND PARKING VARIANCE
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
side setback variance for 5'-8" where T-6' is reeuired. a lot coverage variance for 41.4% where
40% is the maximum allowed and parking variances for one covered parking space and one
uncovered parking spacenot in an approved driveway where two covered and one uncovered spaces
are required for new construction at 801 Paloma Avenue. zoned R-1: APN: 029-013-160; ro e
owners: Jeffrey P. and J. P Lindstrom, 801 Paloma Avenue ; and
WHEREAS, the Planning Commission held a public hearing on said application on April 8.
1996 , at which time said application was approved;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on May
6. 1.996 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this council, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption
per Article 19., Section: 15303, Class 3, construction and location of limited numbers of new, small
facilities or structures including (a) single-family residences not in conjunction with the building of
two or more such units. In urbanized, areas, up to three single-family residences may be constructed
or converted under this exemption is hereby approved.
2. Said side setback, lot coverage and parking variances are approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such side setback, lot coverage and parking
variances are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo. I'--

Conditions of approval categorical exemption, side setback, lot coverage and parking variances
801 PALOMA AVENUE
effective MAY 6, 1996
1. that the project shall be built as shown on the plans submitted to the Planning Department
(sheets A-2 and A-3 date stamped March 12, 1996; sheet A-1 and 81/2" x 11" sheet date
stamped April 1, 1996);
2. that any increase in bedrooms over the 3 existing shall require an amendment to this
application in front of the Planning Commission;
3. that the 10' x 20' uncovered brick paved parking area in the side setback between the house
and the garage shall be recognized as approved on-site parking;
4. that any additional square footage proposed on this property shall require an amendment
to this special permit application and all new floor area shall be subject to all applicable
provisions of the zoning ordinance at that time;

5. that the garage shall be returned to use as a garage, the carpet removed within 30 days of O
receiving a final inspection of the remodel of the house; and the garage shall be used for Gn
