RESOLUTION APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT
TO RETAIN A SHOWER IN AN ACCESSORY STRUCTURE
RESOLVED by the CITY COUNCIL of the City of Burlingame that.'
WHEREAS, a categorical exemption has been proposed and application has been made for a
amendment to conditional use permit to retain a shower in an accessory structure at 204 Bayswater
Avenue. zoned R-1: APN: 029-283-140 ; proWCLy owners: Leslie and Frank Dov1e, 204 Bayswater
Avenue ; and
WHEREAS, the Planning Commission held a public hearing on said application on Anril 8.
1996 , at which time said application was denied;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on MU 6.
1966 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this council, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption per
Article 19, Section: 15301 - Existing Facilities, Class 1, operation, repair, maintenance ...of
existing... private structures... involving little or no expansion of use beyond that previously existing,
including but not limited to: (a) interior or exterior alterations involving such things as interior partitions,
plumbing and electrical conveyances is hereby approved.
2. Said amendment for a Conditional Use Permit is approved subject to the conditions set forth in
Exhibit "A" attached hereto.' Findings for such Conditional Use Permit are as set forth in the minutes
and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

foregoing resolution was introduced at a regular meeting of the City Council held on the 6th day of
Ma,L, 1996 , and adopted thereafter by the following vote:

Conditions of approval of an amendment to a Conditional Use Permit to Retain a Shower in an
Accessory Structure

effective MAY 6, 1996
1. that the existing project shall remain as shown on the plans submitted to the
Planning Department and date stamped May 23,1990 including a toilet and
shower in the accessory structure;
2. that this detached building shall never be used as a rental unit, for the purposes
of a bedroom, or for a home occupation without amendment to this conditional
use permit;
3. that no new accessory structure or increase. of square footage of the main
structure shall be permitted without an amendment to this permit; and
4. that the project shall meet Uniform building and Fire Codes as amended by the
City.
