HomeMy WebLinkAboutReso - CC - 046-1997RESOLUTION NO. 46-97 RESOLUTION APPROVING CATEGORICAL EXEMPTION, and VARIANCE RESOLVED by the CITY COUNCIL of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for an amendment to a Special permit to allow office archive, art storage, and art preparation space in the existing building at 1766 El Camino Real. zoned C-1. APN 025-161-110: Vincent A. Muzzi, 1766 El Camino Real, property owner: WHEREAS, the Planning Commission held a public hearing on said application on May 27 1997 , at which time said application was approved; WHEREAS, this matter was appealed to City Council and a hearing thereon held on Ione 16. 1997 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a Categorical Exemption per Article 19, Section: 15303 - Class 1 - the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2. Said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permit are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. .�.; rh.onga u MAYOR I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 16th day of lune , 1997 , and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: HARRISON, KNIGHT, O'MAHONY, SPINELLI NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: JANNEY CITY CLERK Conditions of approval categorical exemption and an amendment to an exisitng special permit 1766 EL CAMINO REAL effective JUNE 16, 1997 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped April 3,. 1997, sheets Tl, Al, A2, Al Proposed and A2 Proposed: 2. that the office may be open 7:00 a.m. to 6:00 p.m. Monday through Friday with 40 employees; 3. that the conditions of the Fire Marshal's memo (4/14/97), and the Senior Building Inspector's memo (4/14/97) shall be met; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 1995 edition, as amended by the City of Burlingame.
