HomeMy WebLinkAboutReso - CC - 041-1997RESOLUTION NO. 41-97 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME TO EXTEND THE CABLE TELEVISION FRANCHISE CURRENTLY HELD BY POST-NEWSWEEK CABLE, INC. FOR SEVEN (7) MONTHS TO JANUARY 31,1998 RESOLVED, by the City Council of the City of Burlingame: WHEREAS, on June 15, 1981, the City of Burlingame granted a franchise to Pacific Cable Television for the providing of cable television services, which franchise was to terminate on June 24, 1996; and WHEREAS, on May 20, 1996, the City Council approved a one-year extension of the franchise to June 24, 1997, in order to allow Pacific Cable to complete its transfer of the franchise to TCI CableVision; and WHEREAS, on May 19, 1997, the City Council adopted a resolution indicating that the Council was considering extending the franchise to January 31, 1998, and a public hearing on the proposed extension was set for June 2, 1997, and notice was duly published in a newspaper of general circulation in the City; and WHEREAS, on June 2, 1997, the City Council held a public hearing on the proposed extension and received written and oral testimony from all interested persons, and the Council has considered the testimony and materials submitted to the Council regarding the extension; and WHEREAS, under the rules and regulations of the Federal Communications Commission it is necessary for the City and Pacific Cable Television's successor to negotiate the terms of renewal of said franchise; and WHEREAS, it is necessary for the City to adopt a new telecommunications ordinance to incorporate applicable Federal law and recognize changes in the telecommunications industry; and WHEREAS, negotiation of franchise renewal with Post -Newsweek Cable, Inc., involving significant city staff and outside consulting services, would be a pointless and unnecessary expenditure of time and money in view of the pending sale of Pacific Cable to TCI, because negotiations would involve so many parties and do require deliberation and discussion: and WHEREAS, an extension to January 31, 1998, would allow the transfer to occur, TCI to fully understand the needs and desires of the community, and negotiations to be completed, NOW, THEREFORE BE IT RESOLVED that it is in the best interests of the City of Burlingame that the cable television franchise currently held by Post -Newsweek Cable, Inc. be extended to January 31, 1998, for the sole purpose of allowing the transfer of the franchise pursuant to the Franchise Assumption Agreement with the City, negotiation of the terms of renewal of the franchise, adoption of a revised telecommunications ordinance, and determination of the proposed renewal.
