HomeMy WebLinkAboutReso - CC - 038-1997RESOLUTION NO. 38-97 RESOLUTION OF INTENTION OF THE CITY- COUNCIL OF THE CITY OF BURLINGAME TO EXTEND THE CABLE TELEVISION FRANCHISE FOR UP TO SEVEN (7) MONTHS TO JANUARY 31,1998 WHEREAS, on June 15, 1981, the City of Burlingame granted a franchise for the providing of cable television services to Pacific Cable Television, which franchise was to terminate on June 24, 1996; and WHEREAS, on May 20, 1996, the City Council approved a one year extension of the franchise to June 24, 1997, in order to allow Pacific Cable to complete its transfer of the franchise to TCI CableVision; and WHEREAS, under the rules and regulations of the Federal Communications Commission, it is necessary for the City and Pacific Cable Television's successor to negotiate the terms of renewal of the franchise; and and WHEREAS, Pacific Cable Television is now completing the transfer of the franchise to TCI; WHEREAS, it is necessary for the City to adopt a new telecommunications ordinance to incorporate applicable Federal law and recognize changes in the telecommunications industry; and WHEREAS, negotiation of franchise renewal with Pacific Cable Television, involving significant city staff and outside consulting services, would be a pointless and unnecessary expenditure of time and money in view of the sale of Pacific Cable to TCI, because negotiations would involve so many parties and do require deliberation and discussion; and WHEREAS, an extension to January 31, 1998, would seem to allow the transfer to occur, TCI to fully understand the needs and desires of the community, and negotiations to be completed, 1 NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve, determine, and find as follows: 1. A public hearing on the proposed extension is hereby set for June 2, 1997, at 7:00 p.m. before the City Council of the City of Burlingame, at the Council's Chambers at 501 Primrose Road, Burlingame, California. 2. Oral or written comments may be submitted at this hearing. Written comments may also be submitted to the City Clerk prior to the public hearing at 501 Primrose Road, Burlingame, California 94010. The City Clerk is instructed to provide notice of the public hearing by publishing this Resolution in a newspaper of general circulation in the City of Burlingame once no later than ten (10) days after adoption of this resolution.
