RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME WAIVING
A MINOR DEFICIENCY IN THE BID SUBMITTED BY O'GRADY PAVING OF
MOUNTAIN VIEW AND AUTHORIZING EXECUTION OF AGREEMENT BETWEEN
THE CITY OF BURLINGAME AND O'GRADY PAVING FOR
1997 STREET RESURFACING PROGRAM -- CITY PROJECT NO. 9645
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the City Council has authorized an invitation for bids for the 1997 STREET
RESURFACING PROGRAM, CITY PROJECT NO. 9645; and
WHEREAS, on APRIL 29, 1997, all bids were received and opened before the City Clerk
and representatives of the Public Works Department; and
WHEREAS, O'GRADY PAVING OF MT. VIEW submitted the lowest responsible bid for
the job in the amount of $471,392.20; and
WHEREAS, O'GRADY PAVING did not submit a signed Addendum No. 1 with its bid as
required by the Addendum, and the second lowest bidder, C.F. Archibald Paving, filed a protest with
the City; and
WHEREAS, the City Council has received and considered all written and oral testimony
regarding the issue from all interested persons; and
WHEREAS, it appears that Addendum No. 1 would only cause a de minimis increase in the
cost of the Project, if at all, and would therefore not be grounds for withdrawal of a bid under Public
Contract Code § 5103; and
WHEREAS, the evidence submitted shows that O'Grady Paving did actually receive and
consider the Addendum in its bid and that its failure to submit the signed Addendum with the bid was
a technical error that had no effect on the bid process; and
WHEREAS, O'Grady promptly submitted the signed Addendum when it discovered the
oversight; and
WHEREAS, there is no aspect of the delayed submittal of the Addendum that indicates any
fraud or corruption or unfairness to other bidders; and
WHEREAS, the difference between the bid by O'Grady and the next lowest bidder is almost
$23,000; and
WHEREAS, it is in the best interest of the competitive bidding process to waive the minor
technical defect of the delayed submittal of the signed Addendum,
NOW, THEREFORE, be it RESOLVED, and it is hereby ORDERED, that:
1. The Plans and Specifications, including Addendum No. 1, are approved and adopted.
2. The minor technical defect of a signed Addendum No. 1 not being submitted by
O'GRADY PAVING with its bid is waived.
3. The bid of O'GRADY PAVING for the project in the amount of $471,392.20 is
hereby accepted.
The City Manager is authorized and directed to enter into the Agreement contained
in the Project Specifications, including Addendum No. 1, on behalf of the City of
Burlingame with O'GRADY PAVING.
