HomeMy WebLinkAboutReso - CC - 024-1997RESOLUTION 24-97 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AWARDING CONTRACT FOR FURNISHINGS FOR THE BURLINGAME PUBLIC LIBRARY TO OP CONTRACT INC. AND WAIVING MINOR BID IRREGULARITY CITY PROJECT NO. 9305 RESOLVED, by the City Council of the City of Burlingame: WHEREAS, on January 14, 1997, the City publicly advertised the purchase of furnishings for the City Library, and on February 25, 1997, the City received six sealed bids as called for in the advertisement; and WHEREAS, OP Contract Inc. is the apparent, responsible low bidder on the base bid combined with various alternates that were requested; and WHEREAS, the bid form submitted by OP Contract contained a misentry on the Bid Summary for one item regarding the base bid, in that the base bid entry reflected alternates plus base bid; however, the detailed bid form submitted by OP Contract Inc. specifically noted that the entry included base bid plus alternates and further identified the actual base bid; and WHEREAS, this minor misentry does not give OP Contract, Inc. any competitive advantage, any monetary relief, nor any right to withdraw the bid if it so chose under the Public Contracts Code; and WHEREAS, it does not appear that the purchase of drapes for the Library in this contract is advantageous to the City and that alternate 5 will not be awarded, NOW, THEREFORE, BE IT RESOLVED, that: 1. The City Council hereby waives the minor irregularity of misentry of base bid on the bid summary by OP Contract Inc. 2. The City Council hereby awards the contract for furnishings for the Burlingame Public Library [Project No. 93051 to OP Contract Inc. for the base bid, plus alternates 1, 2, 3, and 4 submitted, in the total amount of $323,123.51. 2. The City Manager is directed to execute the agreement with OP Contract Inc. contained in the award for and on behalf of the City of Burlingame. 1h o `rte MAYOR I, JUDITH A.
