Hillsborough. prQ= owner WHEREAS, the Planning Commission held a public hearing on said application on December 9, 1996 , at which time said application was denied; 44 WHEREAS, this matter was Mealed to City Council and a hearing thereon held on Jamiga- 6. 1997 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; CD NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 07 °,a 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments F: received and addressed by this council, it is hereby found that there is no substantial evidence that the tVJ1 project set forth above will have a significant effect on the environment, and Negative Declaration ND482-P is hereby approved. 2. Said special permits are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such special permits are as set forth in the minutes and recording of said meeting. 3. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held or. the 6th day of h1lum , 1997 , and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: HARRISON, JANNEY, KNIGHT, O'MAHONY, SPINELLI NOES: COUNCHMEMBER¢: NONE ABSENT: COUNCII.MF.MBERS: NONE EXHIBIT "A" Conditions of approval negative declaration and special permits 1860 ROLLINS ROAD effective JANUARY 6, 1997 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped November 18, 1996 Parcel Map, and Sheet C-3 Plans for Drainage Easement Future Parking; and date stamped November 4, 1996, Sheet C- 4 Future Landscaping, Irrigation and Paving, and Sheet C-5 Future Parking Layout; and date stamped September 24, 1996 Sheet C-1 and C-2 Grading and Drainage except the proposed concrete drainage channel was never built; that the conditions of the Engineering Departments November 14, 1996 memo and the Fire Departments' October 21, 1996 memo shall be met and the installation of the parking lot and landscaping improvements shall be conditioned on receiving an encroachment permit from the City Council; that the proposed paved parking area cannot be used for any expansion of permitted or conditional uses on any adjacent parcel of land or for required parking for any use on any adjacent property; 4. that the project shall meet all the requirements of the California Fish and Game Department, Regional Water Quality Board, U.S. Fish and Wildlife, and U.S. Army Corps of Engineers, and obtain approvals and permits where necessary; 5. that all applicable requirements of National Pollutant Discharge Elimination System (NPDES) shall be adhered to in the design and during construction. During construction bales of hay should be placed alcng tha top of the bank of the channel to identify the top of bank and to provide erosion control protection. All construction shall occur only between May and September. To contain dust, graded areas must be sprinkled continuously during construction with reclaimed water. Stockpiles of debris, construction materials and trucks hauling materials shall be covered, their wheels washed before exiting onto a public street, and during construction the driveway and street shall be swept of any debris at regular intervals as required by the City. Runoff shall be collected and filtered in the storm water drainage system before it is discharged into the head wall of the existing channel; that the drainage plan submitted and approved by the City shall be designed to accept worst case flood conditions as determined by the City Engineer so that the parking lot and new drainage channel shall not impede the flow of storm water to the pump station; 7. that the drainage plan shall include a system of catch basins approved by the City Engineer for collection and filtration of hydrocarbons and petroleum products from the storm water runoff in the parking lot, this system shall be placed in front of any pumps used to pump water into the storm water collection system, and shall meet the requirements of the National Pollutant Discharge and Elimination System (NPDES). It shall be regularly cleaned and maintained by the owner according to a schedule approved by the City Engineer; EXHIBIT "A" Conditions of approval negative declaration and special permits 1860 ROLLINS ROAD effective JANUARY 6, 1997 page -2- 8. that no new grades for the improvements can exceed elevation 4.0' mean sea level (MSL) within the drainage easement to insure the holding capacity of the basin during flooding. The property owners shall agree to relocated all the vehicles during flood incidents and to assume all responsibility for flooding or storm drainage problems and to hold the City harmless and defend the city from any claims arising from such incidents. Also all construction and paving shall be above the elevation of the existing top of bank (4.36' to 3.33') with no grading or improvement made below the top of bank within the existing drainage channel; 9. that the project shall meet the standards of the Bay Area Air Quality Management District (BAAQMD) and the applicant shall submit proof of that permit and a copy of approved plans before receiving a building permit, including construction equipment emissions shall be in compliance with the standards of the Bay Area Air Quality Management District. 10. that it shall be the responsibility of the property owner to maintain the 20' clear fire lane (as approved by the Fire Department) from Rollins Road through the site with a turning area for emergency access to the drainage and utility easements. This access shall be available at all times and shall be unobstructed by parked cars or other vehicles or materials; 11. that the property owner shall prepare a landscaping and irrigation plan for the entire site to be approved by the City Parks Director, and the property owner shall install landscaping according to the approved plan within 90 days of final inspection and prior to issuing an occupancy permit; 12. that the landscaping and irrigation system shall be maintained by the property owner including but not limited to weed control and vehicular clearance for fire access roadways and replacement of plant material as necessary to maintain the landscape design; 13. that vehicle movements into and off the site shall never occur during peak traffic times (7:30 a.m. to 9:00 a.m. and 4:30 p.m. to 6:30 p.m.) to reduce the impacts on the Broadway/Rollins interchange and on the Broadway overpass. Peak hour traffic times shall be reviewed and revised by the City Engineer during and after BART construction along Millbrae Avenue. The facility shall be open daily, Monday through Sunday with a maximum of one (1) employee and a total of three (3) employees and managers on site at any one time; 14. the property owner shall provide access easement rights to the City of Burlingame for maintenance of the drain; the City of Burlingame shall be held harmless for any property damage which might occur as a result of doing maintenance work within the drainage easement or on the adjacent spur track right-of-way; 15. that no fencing shall obstruct existing drainage into and through the channel from the adjacent parcels and all fencing that is visible from the street shall require landscaping on the side that is visible from the public right-of-way and that on-site security shall be enhanced by providing barbed wire on all perimeter fencing; EXHIBIT "A" Conditions of approval negative declaration and special permits 1860 ROLLINS ROAD effective JANUARY 6, 1997 page -3- 16. that all lighting of the lot shall be provided at intensities required for safety of people and property and shall be installed so light is focused on the site, shielded for glare and does not extend beyond any property line or top of fence or hedge onto adjacent properties, and shall meet the requirements of Municipal Code Section 18.16.210; 17. that all grading, paving and other construction shall be done during the hours and days specified by the California Building Code as amended by the City of Burlingame (Municipal Code Chapter 18.07.130 - Construction Hours); 18. that the project design shall conform to the requirements of the municipal code and of the 1995 edition of the California Building and Fire Codes as amended by the City of Burlingame, and the grading plan shall be prepared by a licensed Engineer and approved by the City Engineer; and 19. that this use permit shall be reviewed for compliance with all its conditions, including public access and landscape maintenance, (annually in December) or upon complaint.
