HomeMy WebLinkAboutOrd 1327ORDINANCE NO. 1327 ORDINANCE APIENDING S2EGULATION OF The CITY COUPSCIL of the CITY OF BUP,LINGAME does hereby as follows: Section to Chapter 18.18 of the Burlingame Municipal Code is hereby amended to read as follows° "CHAPTER 18.18 -- RADIO AND TELEVISION ANTENNAS Section 18.18.010 Definitions. a. Antenna shall mean any combination of wood, metal, wire or any other substance which either alone or in combination with any supports is erected or constructed for the purpose of receiving or transmitting radio, television or any other electronic or other type of signal. b. Satellite antenna is an antenna capable of receiving communications from a transmitter or a transmitter relay located in planetary orbit. C. Usable Satellite Signals are satellite signals, from the major communications that, when viewed on a conventional television set, are at least equal in picture quality to those received from local commercial television stations or by way of cable television. d. Ham and CB Antennas. Radio receiving and trans- r,itting antenna for ham,,amateur,;citizen and civilian band operati_, Section 18.18.020 -- Permitted antennas. Iv) R Zones. No antennas may be installed in front yards, side yards or rear yard setbacks. Satellite antennas and ham and CB antennas may only be installed in the rear yard and only with a special permit pursuant to Chapter 25.16 of this Code. A satellite antenna shall not be installed with any part thereof exceeding six (6) feet from the ground level directly beneath it; It shall be installed at the location upon the property, subject to the limitations set forth herein, which has least esthetic effect upon surrounding properties while receiving usable satellite signals. An applicant may be required to obtain site studies at his expense to determine such a location. Satellite antennas shall be screened by walls, fences or other permanent materials from view from the first floor of buildings onadjacentproperties and fro„i. any _public _rigllt-of -way`, within 500 :__feet. Other antennas in excess of fifteen (15) feet above the •roof of a building, or, if placed upon the ground, twenty-five (25) -1- feet above the ground, shall only be installed or constructed upon approval of a special permit pursuant to Chapter 25.16 of this Code. 2.) Antennas may be installed or constructed in a C or M Zone or upon unclassified lands only upon approval of a special permit pursuant to Chapter 25.16 of this Code. Section 18.18.030 Engineering report required. Where the gross weight of an antenna exceeds five hundred pounds or where the gross height above the ground, when built upon the ground, exceeds twenty-five feet above ground level, or where the gross height above the roof, when built upon a buil-ding, exceeds fifteen feet (15) above the roof, the building official shall require that a plan and engineering calculations for wind load, bracing and foundation be prepared by a licensed civil or struct- ural engineer. Such plans and specifications shall be prepared to meet or exeed the applicable requirements for such construction as set forth in Chapter 18.08 of this Code as adopted or as it may be subsequently amended. Section 18.18.040 - Existing Antennas. Antennas existing prior to the adoption of this ordinance and constructed or installed in compliance with applicable zoning and building codes shall be deemed non -conforming. Antennas constructed or installe without required building or use permits shall either be removed or an application for such permit(s) therefore filed within thirty (30) days of the effective date of this ordinance." Section 2. ordinance objectives. Most homes in Burlingame are built on lots on hillsides with substantial lot coverage, of relatively small size, or in a combination of these factors. Antennas, particularly satellite television, can cause understandable interference with views of natural vegetation and scenery. Therefore, in order to maintain the aesthetic objective of minimal intrusion into views and enjoyment of landscaping and other natural effects, it is necessary that satellite antennas in residential zones be placed in the lease intrusive site upon residential properties while still allowing usable satellite signals and that other antennas also be limited in their location. Section 3. This ordinance shall be published as required x r ,;Mayor -2- I, JUDITH A.
