OPDINANCE EXTENDING INTERIM ORDINANCE IMPOSIP?G
A MORATORIUDi OF SATELLITE
THE CITY COUNCIL of the CITY OF BURLINGAME does hereby
ORDAIN as follows:
Section 1. Extension of Moratorium. The moratorium
upon satellite antennas, enacted by Ordinance 1319 on April 7,
1986,is hereby extended through July 21, 1986.
Section 2. PToratorium upon civilian band and ham
antennas. The moratorium adopted by Ordinance 1319 and extended
by Section 1 hereof shall also apply to radio receiving and
transmitting antennas for civilian band and ham operations.
Section 3. Urgency. It is hereby declared that this
ordinance is an ordinance for the immediate preservation of the
public peace, safety, health and welfare, and is an emergency
measure as provided by law, and shall take effect upon its
adoption.
The facts constituting such urgency are as follows:
The Federal Communications Commission has adopted a rule,
effective March 14, 1986, which severely restricts local control
of the installation and construction of satellite antennas, and
may invalidate. current Burlingame ordinances on the subject as of
that date. Said rule allows the .adoption of ordinances vahich
regulate all antennas alike or which regulate dish.
antennas for health, safety or esthetic reasons. It is necessary
and desirable that such an ordinance be considered by this Council
and pending its consideration, construction or installation of
such antennas be halted. It is also necessary and desirable that
civilian band and ham antennas be subject to this moratorium so
that they may be considered within the Federal Communication
Commission's uniformity requirements.
Section 3. Duration. This ordinance is intended to
extend the interim urgency zoning ordinance. Unless this ordinance
is extended as provided by Government Code Section 65858 or
superceded by any other ordinance it shall automatically cease to
have force and effect after July 21, 1986.
Section 4. Publication. This ordinance shall be
lished as required by law.
