HomeMy WebLinkAboutOrd 1383ORDINANCE NO. 1383 ORDINANCE REGULATING AUTOMOBILE RENTAL BUSINESSES IN THE M-1 AND C-4 DISTRICTS The CITY COUNCIL of the CITY OF BURLINGAME does ORDAIN as follows: Section 1. Section 25.08.095 is added to the Burlingame Municipal Code to read as follows: 1125.08.095 Automobile leasing. Automobile leasing is the business of renting, leasing, or bailing of vehicles for a term exceeding four months and for a fixed rate or price." Section 2. Section 25.08.097 is added to said code to read as follows: "25.08.097 Automobile rental. Automobile rental is the business of renting, leasing, or bailing of vehicles for a term not exceeding four months and for a fixed rate or price." Section 3. Section 25.42.030 is amended to read as follows: "25.42.030 Conditional uses requiring special permit. The following are conditional uses requiring a special permit: a. Airplane or airplane engine manufacturing or repairing; b. Airports or aircraft landing fields, including heliports; c. Animal hospitals or kennels; d. Automobile leasing or rental; e. Automobile sales lot; f. Building materials storage and wholesaling; g. Contractors storage yard; h. Commercial recreation establishments, including, but not limited to, outdoor theater, archery, skating, bowling. Facilities provided may include sale of food or beverages; i. Establishments for sale of goods or services at retail; j. Establishments for the retail of food or beverages; such establishments shall not be the primary use of a building or structure, not be within three hundred feet of the waterfront commercial (C-4) district, and shall meet the following size minimums: eight hundred fifty square feet of gross floor area, twenty feet in length and fifteen feet in width; k. Foods for animals, processing and packing; 1. Gasoline and oil storage, wholesale; m. Hotels and Motels. Facilities provided may include meal and beverage service, barber and beauty shops, smokeshops, and similar services which are clearly incidental to the providing of lodging accommodations; n. Lumberyard or planing mill; provided, that disposal and storage of sawdust and wood wastes shall be so controlled as not to create a nuisance; 2 o. Office buildings; p. Retail sales of alcoholic beverages; q. Trucking, truck storage, motor freight terminals; r. Any use similar in nature to one for which a permit is required in this or any other district; s. A permit shall be required for any use requiring outdoor treatment or processing of materials and the planning commission may determine reasonable provisions to carry out the intention of this title; t. Any use with a structure that is more than thirty-five feet in height; U0 Any use with a structure that covers more than sixty percent of the lot area; v. Structures in which more than twenty percent of the gross square footage is used for office purposes; w. Not more than one dwelling designed to be used, and used in connection with an industrial establishment. It shall be occupied by the owner or lessee of such establishment and his family, or by an employee of such owner or lessee, and his family, subject to any requirements or restrictions necessary for public health, safety and welfare." �ti\ Section 4. read as follows: Section 25.42.04�z is added to said code to �3 "25.42.048 Automobile rental businesses. 1. Automobile rental businesses as defined in Section 25.08.097 shall be a conditional use in the portion of the M-1 district east of Highway 101 and a prohibited use in the portion of the M-1 district west of Highway 101, 2. Automobile rental uses in the portion of the M-1 district east of Highway 101 shall comply with the following minimum standards: a. The use is the sole tenant and only occupant of any building or area on the site; b. The site shall have a minimum size of one acre; c. Parking shall be provided on site for storage of at least 25% of the cars rented monthly, based on an annual average from the site; d. Parking shall be provided for all employees and customers on site; e. The use shall meet all the other requirements of development in the M-1 district, including peak hour trip generation at the critical intersections as defined in the traffic analyzer and Specific Area Plan for the Bayfront/Anna areas." Section 5. Section 25.41.020-c is amended to read as follows: 0 "25.41.020 Permitted uses. The following uses are permitted in the waterfront commercial district: (c) Motels and hotels: facilities provided may include meal and beverage services, barber and beauty shops, smoke shops, automobile rental desks to serve only hotel guests so long as the operation does not use parking required for the primary hotel use, convention and meeting facilities, and similar services which are clearly incidental and accessory to provision of lodging accommodations;" Section 6. This ordinance shall be published as required by law. I, JUDITH A.
