HomeMy WebLinkAboutOrd 1377ORDINANCE NO. 1377 LIMITING NUMBER OF CATS UPON A PREMISE TO THREE The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as follows: Section 1. Sections 9.04.054 and 9.04.055 are hereby added to the Burlingame Municipal Code to read as follows: "9.04.054 - Number of Cats on Premises Limited. It is a public nuisance for any person, firm or corporation to have, keep or maintain or cause to be kept or maintained on any premises within the City, more than three cats, either male or female of the accepted age of two months and over. Maintenance shall include the feeding of cats, whether or not they are allowed within the buildings on the premises, and whether or not ownership is claimed. 9.04.055 - Kittens under Two Months Excepted from Limitation of Number on Premises. In the event of the breeding of any cat on any premises within the City, the kittens shall not be permitted to remain on the premises for a longer period than the weaning time of same, which is hereby fixed at not later than two months from birth of the kittens, nor shall it be permitted to remove the kittens to any other premises within the City, after the period of two months, so as to cause an excess, including the kittens of a three cat limit on any premises." Section 2.- Section 9.04.060 of said code is amended to read as follows: "9.04.060 - Permit to Keep More than Two Dogs or Three Cats. - Consent of Neighbors. The provisions of Sections 9.04.040 to 9.04.055 are subject to the exception that the City Council may grant a permit to an adult resident of the City to have or keep more than two dogs or three cats, but not to exceed five dogs and/or cats in all, when such resident presents to the City Council a verified petition containing the bona fide signatures of a majority of adult residents within four hundred feet of the boundary lines of the premises of the applicant. The petition shall be accompanied by a drawing showing all adjoining or adjacent property within four hundred feet from the boundary lines and adult residents owning or in possession of such property shall be eligible to sign the petition. The permit shall be revocable at any time by the City Council, upon its own motion or upon a petition by a majority of adult residents within the radius." Section 3. This ordinance shall be published as required by law. 0 D I, JUDITH A.
