HomeMy WebLinkAboutOrd 1362ORDINANCE N0. 1 URGENCY ORDINANCE INCREASING MINIMUM LOT FRONTAGES AtiTD MINIMUM BUILDING SETBACKS. The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as follows: Section 1. Subsection 1 of Section 25.28.060 of the Burlingame Municipal Code is amended to read as follocas: "1. Lots of 6,999 square feet or less must have an average width of not less than fifty (50) feet and all such lots or parcels of land shall have a frontage on a public street of not less than fifty (50) feet; lots of 7,000 square feet to 9,999 square feet must have an average width of not less than fifty feet and all such lots or parcels of land shall have a frontage on a public street of not less than fifty- five (55) feet; and lots of 10,000 square feet or more must have an average width of not less than fifty (50) feet and all such lots or parcels of land sha].1 have a frontage on a public street of not less than sixty (60) feet; provided, however, that lots or parcels which face on the curve of a curved street, where the radius of such curvature is less than forty- five (45) feet may have a lesser frontage but not less than thirty (30) feet for a 6,999 square foot or less lot or parcel, thirty-five (35) feet for a 7,000 square foot to 9,999 square foot lot or parcel, or forty (40) feet for a 10,000 square foot or larger lot. or parcel." Section 2. Section 25.66.050 of said code is amended to read as follows: "25.66.050 Measurement of side yards and rear yards. A11 buildings, structures, improvements, or portions thereof, which are used or hereafter erected for dwelling purposes in any portion of the City shall provide side yards and rear yards in accordance with the following table, except as herein provided. SIDE YARD (in feet) Lots 42' Wide Lots Over 42' and Lots 51° Wide or Under Less Than 51' and Less -Than 54' 3 4 5 Lots 61' Wide and �., 7 -1- Lots 54' Wide and Less Than 61' 6 REAR YARDS (in feet) 1 AND 2 STORY MORE THAN TWO STORIES The side yard requirements set forth are the minimum require- ments for single story buildings and shall be increased one foot for each additional story above the first story." Section 3. Urgency. It is hereby declared that this ordinance is an ordinance for the immediate preservation of the public peace, safety, health and welfare, and is an emergency measure as provided by law, and shall take effect upon its adoption. The facts consituting such urgency are as follow: Many of the remaining buildable lots in Burlingame and many lots with older homes likely to be demolished are on large sites which need to be limited in development. Such limits are necessary to preserve the existing lot patterns for uniform development and because the existing infrastructure was installed for the existing densities. Additionally, the pattern of division could lead to lots with inadequate frontages, odd shapes, steep driveways, limited developable areas due to slope, and difficult to serve by emergency vehicles because of restricted access. It is therefore necessary to adopt this ordinance so that development of such lots will be controlled by establishment of minimum widths and building setbacks for the health, safety and welfare of the residents of Burlingame.
