ORDINANCE AMENDING FENCE AND HEDGE REOUIREMENTS
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ORDAIN as follows:
Section 1. Section 25.08.263 is hereby added to
the Burlingame Municipal Code to read as follows:
"25.08.263 Fence. Fence is a structure of wood,
masonry, metal, or other solid material built on or close
to a property line for the purpose of physically separating
properties."
Section 2. Section 25.08.337 is hereby added to
said code to read as follows:
"25.08.337 Hedge. Hedge is a compact planting of
any type of plant or shrub which acts or is intended to act
as a fence (see Section 25.08.263)."
Section 3, Section 25.78.020 of said code is
hereby amended to read as follows:
"25.78.020 Height of fences in R Districts.
(a) In any R district no fence or hedge which
exceeds five feet (5') in height, measured from the average
of the ground level at both sides of the fence, is
permitted in that part of the lot which is the front
setback.
(b) In any R district fences seven feet (7') in
height shall be permitted at side and rear property lines,
provided the last foot in height is of an open design
freely allowing light and air to pass through; all other
fences in these locations shall not exceed six feet (6')
in height."
Section 4. Section 25.78.025 is added to said
code to read as follows:
"25.78.025 Fence height in all other districts.
In all other districts, except as required for certain M-1
uses by Section 25.42.020(4), fences seven feet (7') in
height shall be permitted, provided the last foot in height
is of an open design freely allowing light and air to pass
through."
Section 5. Section 25.78.030 of said code is
amended to read as follows:
"25.78.030 Measurement of Height. Except as
provided in Section 25.78.020(a), height of a fence or
hedge shall be measured from the highest adjacent grade."
Section 6. Section 25.78.035 is added to said
code to read as follows:
"25.78.035 Building permit required. Any fence
exceeding six feet (6') in height, or masonry or concrete
wall with a fence stop exceeding six feet (6') in total
height, shall require a building permit."
Section 7. This ordinance shall be published as
required by law.

Burlingame, do hereby certify that the foregoing ordinance
was introduced at a regular meeting of the Burlingame City
Council held on the 7th day of August, 1989, and
was adopted thereafter at a regular meeting of the
Burlingame City Council held on the 21 day of
August. 1989, by the following vote:
