INTERIM ORDINANCE PROHIBITING
ISSUANCE OF BUILDING PERMITS ON CERTAIN
PARCELS BOUNDED BY EDGEHILL DRIVE
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ORDAIN as follows:
The
Section 1. No building permits shall be issued or
any work,
other than maintenance and repairs, upon any
building
or parcel within that area bounded by Edgehill
Drive and California Drive as set forth in Exhibit "A"
attached
hereto (APN 029-022-050 through 029-022-180).

Section 2. The Planning Commission of the City of
Burlingame
is hereby directed to pursue a study of the
existing
general plan and zoning ordinances applicable to
the area
described in Exhibit "A", considering particularly
the effects of permissible development of the area under
existing
zoning upon adjacent residential areas and upon the
existing
uses of the area itself. The commission shall also
consider
any changes in the general plan and zoning which
might be
appropriate to preserve and protect such existing
uses.
Section 3. It is hereby declared that there is a
current and immediate threat to the public health safety
and welfare and this ordinance is therefore an urgency
measure as provided by law, and will take effect upon its
adoption.
The
facts
constituting such
urgency
are
as
follows:
The
subject area is currently
zoned C-2
but
is
almost
entirely
developed with residential
uses.
Construction of uses and buildings allowed by the C-2 zone
would be incompatible with those actual present uses.
Additionally, such uses and buildings would have a
substantial adverse impact upon the R-1 areas immediately
across Edgehill Drive from the subject area. A temporary
prohibition of the issuance of building permits in the
subject area is therefore necessary so that such development
of the subject area will not occur while changes in the
general plan and zoning ordinance are considered.
Section 4. Duration. This ordinance is intended to be
an interim ordinance. Unless this ordinance is extended as
provided by Government Code Section 65858 or superceded by
any other ordinances it shall automatically cease to have
force and effect forty-five days from its date of adoption.
Section 5. This ordinance shall be published as
required by law.
