RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME AUTHORIZING THE DIRECTOR OF PUBLIC
WORKS AN INCREASE IN THE CONTINGENCY AUTHORIZATION FOR THE
LANDFILL CLOSURE, PHASE HI, PROJECT NO. 9117(2)
WHEREAS, the City of Burlingame is completing the closure of the City Landfill and
conversion to recreation and open space uses;
WHEREAS, Resolution No. 12-1999 authorizes the Director of Public Works to execute
change orders of up to fifteen percent of a contract amount if sufficient funds are budgeted for the
project; and
WHEREAS, on May 17, 1999, the Council adopted Resolution No. 51-1999, awarding the
contract for lower deck improvements to Tyree Organization for the amount of $665,688.70 to cap
and seal the landfill in the lower deck area; and
WHEREAS, the Contractor has encountered unmapped, excess debris and clay which
require removal, and which constitute extra work as well as delay to the Contractor; and
WHEREAS, the change orders caused by this work will exceed the current contingency; and
WHEREAS, there is need to do additional work on this job site for winter due to rejection
of the next phase of work, Bayside Park, Phase I; and
WHEREAS, sufficient funds are budgeted for this project to increase the contingency from
fifteen percent (15%) [$99,900] to twenty percent (251/6) [$166,400]; and
WHEREAS, this increased is justified by site conditions and proper completion of the
project for the long term,
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
The contingency for Project 9117(2) is increased from $99,900 to $166,400, and the
Director of Public Works is authorized to execute change orders pursuant to this contingency as
provided in the Project Specifications.

foregoing Resolution was introduced at a regular meeting of the City Council on the 16th day of August
1999, and was adopted thereafter by the following vote:
