RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME REJECTING ALL BIDS
FOR BAYSIDE PARK, PHASE 1-- CITY PROJECT 9117(7)
WHEREAS, the City of Burlingame wishes to complete the improvements to the former
landfill site by constructing a softball field, lagoon trail, and dog run; and
and
WHEREAS, the City issued plans and specifications for the project pursuant to State law;
WHEREAS, on August 5, 1999, the date set for opening of sealed bids for the project, the
City had received only two bids, which it opened as set forth in the bid documents; and
WHEREAS, the two bids received were almost fifty percent higher than the engineers
estimate for the work; and
WHEREAS, the key high bid item was electrical installation, which may require additional
definition to obtain a reasonable bid from licensed contractors; and
WHEREAS, pursuant to Public Contracts Code sections 20166, the City may reject all bids
and re -advertise; and
WHEREAS, the bidders should be eligible to be considered for such a readvertised contract,
because the bidders submitted validly prepared bids; and
WHEREAS, the Director of Public Works is authorized to amend the Request for Bids and
Specifications to ensure that the request is clear and that the specifications call for construction
generally within the budget established for the project,
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
All bids received for Project No. 9117(7) are hereby rejected.
2. All bonds and security received in connection with the bids received shall be returned
to the bidders.
The Director of Public Works is hereby authorized to amend the Request for Bids,
and Plans and Specifications to ensure that they are clear and generally subject to construction within
the budget for the project and then readvertise the project for bids.

foregoing Resolution was introduced at a regular meeting of the City Council on the 16th day of AUGUST
1999, and was adopted thereafter by the following vote:
