WHEREAS, a categorical exemption has been proposed and application has been made for a hillside: area construction permit and side setback variance for a first and second floor addition subject to design review at 2228 Davis Drive. zoned R-1, APN: 025-191-040; .Paul and Susanne Vagadori_ property owners: WHEREAS, the Planning Commission held a public hearing onsaidapplication on June 28. 1998, at which time said application was denied without prejudice; WHEREAS, this matter was appealed to City Council and a hearing thereon held on August 2- 1998 at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Cotmctl that: 1. - On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this council, it is hereby found that there is no substantial evidence that the, project set forth above will have a significant effect on the environment, and Categorical Exemption, per Article 19. Section: 15303 - New Construction or Conversion of Small Structures Class 3 (a+e), Single-family residences not in conjunction with the building of two or more such units is hereby approved. In urbanized areas, up to three single-family residences may be constructed of converted under this exemption is hereby approved. 2. Said hillside area construction permit and side setback variance is approved, subject to the r- ndmip*s set forth In Exh;bit "A" attached hereto. MALFATTI, City Clerk of the City of Burlingame, do hereby certify that the foregoing resolution was introduced at a regular meeting of the City Council held on the 2nd day ofA. ugust , 1999 , and adopted thereafter by the following vote: AYES: COUNCILMEMBERS: JANNEY, KNIGHT, O-MAHONY, SPINELLI NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: GALLIGAN CITY CLERK �� EXHIBIT "A" Conditions of approval for categorical exemption, hillside area construction permit and side setback variance 2228 DAVIS DRIVE effective AUGUST 2, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped June 21, 1999, sheets A-1 through A-4; and date stamped May 14, 1999, sheet A5, with the replacement of the two 2.5 foot windows facing the rear yard in bedroom number 3 to a single 6 foot wide window centered in the wall, and that any changes to the footprint or floor area of the building shall require an amendment to this permit; 2. that any changes to the size or envelope of the second floor, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; 3. that the requirements of the City Engineer's March 2, 1999 memo shall be met; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as amended by the City of Burlingame.
