HomeMy WebLinkAboutReso - CC - 056-1999RESOLUTION NO. 56-1999 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME SUBMITTING A MEASURE TO THE VOTERS WHETHER THE OFFICE OF CITY CLERK SHOULD BE APPOINTIVE and RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the Office of City Clerk is a vital part of the functioning of City government; WHEREAS, it is important for the City to seek the best qualified person to be the City Clerk; and WHEREAS, the current City Clerk, Judith Malfatti, is retiring after superb service to the City, having served as Deputy City Clerk by appointment, and then being elected to the office; and WHEREAS, State law provides that only means by which there can be any qualification other than age and residency for the position is for the position to be appointive rather than elective; and WHEREAS, in order to ensure that the office is filled by a qualified person who will devote her or himself to the duties expected and required of the Burlingame City Clerk, the position should be appointive, NOW, THEREFORE, IT IS RESOLVED AND ORDERED: 1. Pursuant to Government Code Sections 36509 and 36509, the following question shall be submitted to the voters at the general municipal election on November 2, 1999: "Shall the office of Burlingame City Clerk be appointive?" 2. The City Clerk is requested to place this measure on the ballot for the general municipal election on November 2, 1999, and the City Attorney is directed to draft the impartial analysis of the measure pursuant to Elections Code Section 9280. MAYOR I, JUDITH A.
