APN' 026-332-080; 330 BEACH STREET INVESTORS. LLC.. 1091 Industrial Road Suite 102 San Carlos CA 94404 property owners: WHEREAS, the Planning Commission held a public hearing on said application on April 26. 1999 , at which time said application was denied; WHEREAS, this matter was appealed to City Council and a hearing thereon held on June 7. 1999 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and a categorical exemption per Article 19, Class, l (a), Section 15301, Interior or exterior alterations involving such things as interior partitions, plumbing, partition walls and electrical conveyances, is hereby approved. 2. Said landscape variance and conditional use permit are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such variance and conditional use _Permit are asset forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. MAYOR I, JUDITH A. L%IFA EXHIBIT "A" Conditions of approval categorical exemption, use permit, variance 330, 340 BEACH ROAD effective JUNE 7, 1999 1. that the project shall be built as shown on the plans submitted to the Planning Department titled Preliminary Site Plan date stamped May 11, 1999, with a total of 40 off-street parking spaces and a total of 2510 SF of landscaping, 1083 SF of which is located in the front 30 feet of the site and plans date stamped April 6, 1999, entitled "Existing Building Conditions - Eastern Portion", Sheets A2.1, and AD2.1; 2. that the conditions of the Fire Marshal's February 22, 1999 memo shall be met; N• N 3. that the landscape design as proposed shall be installed with irrigation and maintained r1 pursuant to the plans submitted to the Planning Department, date stamped May 11, Ota No" 1999, failure to maintain the on-site landscaping shall result in review of the variance No o and possible revocation, and the final inspection shall not be scheduled until the landscaping and irrigation system are installed; Ot m a m mom 4. that the property owner shall not enter into any off-site parking agreement which permits tenants from buildings other than 330 Beach Road and 340 Beach Road to use the parking lot at this site; 5. that during the demolition and reconstruction of this parking lot and landscape plan, the applicant shall comply with Burlingame's Storm Water Management and Discharge Ordinance, and shall apply Best Management Practices (BMPs) pursuant to C.S. 15.14.140.3 to the greatest extent possible to reduce off-site erosion and sedimentation resulting from this project; and 6. that any improvements for the use shall meet all California Building and Fire Codes, 1995 Edition as amended by the City of Burlingame.
