HomeMy WebLinkAboutReso - CC - 040-1999RESOLUTION 40-1999 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND BAY AREA RAPID TRANSIT DISTRICT (BART) REGARDING LANDSCAPING AND TREE REPLACEMENT RESOLVED, by the City Council of the City of Burlingame: WHEREAS, the Bay Area Rapid Transit District (BART) is pursuing an extension of its rail line to the City of Millbrae, which would involve the construction of tailtracks within the City of Burlingame; and WHEREAS, BART and its designee, SamTrans, has to acquire certain rights of way to construct those tailtracks, which includes a portion of a 25 -foot wide easement owned by the City of Burlingame for tree planting and drainage purposes and two small parcels of land also owned by the City; and WHEREAS, BART has told the City of Burlingame that it will use the power of eminent domain and court litigation to acquire this property; and WHEREAS, the City does not endorse or approve the extension project or the tailtracks, the EIR's or EIS's prepared for the project or the tailtracks, or any aspect of the project or the tailtracks except as expressly compelled pursuant to the negotiated memoranda of understanding, executed deeds, and executed right of way contracts that are approved concurrently with this Resolution; and WHEREAS, after negotiation, BART and the City of Burlingame are prepared to enter into a series of memoranda and contracts that will provide compensation to the City for the removal of trees, implementation of a landscape barrier along the rail line, and reserve appropriate drainage easements for City purposes; and WHEREAS, the memorandum of understanding regarding landscaping and tree replacement will provide the funding to allow the City to replace trees that are being removed from former City property by the BART extension and to construct a landscaping barrier between the rail line and California Drive to reduce the visual impact of the extension project; and WHEREAS, the trees will not be replaced in the same area because of the expanse of the BART project, but will help beautify other portions of the City for the benefit of the public, NOW, THEREFORE, IT IS ORDERED: 1. The City Manager is authorized to execute the memorandum of understanding regarding landscaping and tree replacement contained in Exhibit A hereto by and behalf of the City of Burlingame subject to non -substantive changes as the Manager may deem necessary to effectuate the intent of the Council and subject to approval as to form by the City Attorney. 2. The City Clerk is directed to attest to the signature of the Manager. 3. The delivery of the memorandum of understanding is expressly conditioned on the execution and delivery of the following by BART or its designee: A. Technical MOU approved by concurrent resolution of the Council. B. Right of Way Contract for Assessor Parcel Numbers 025-164-010 and 025-165-010 and payment by SamTrans of $1,000 pursuant to the right-of-way contract. C. Payment of $116,100 by SamTrans or BART as provided in the Landscaping and Tree Replacement MOU. 4. RECITALS A. BART is constructing and intends to operate an 8.7 -mile extension of its existing regional transit system from the Colma Station to stations at the San Francisco International Airport and in Millbrae, known as the BART -San Francisco Airport Extension (the "Project"). B. The Project calls for construction of tailtrack and related facilities and structures within the City (collectively, the "Tailtrack"). C. In order to implement the Project, BART and the San Mateo County Transit District ("SamTrans"), BART's partner in the Project, intend to acquire certain properties within the City of Burlingame, including by the power of eminent domain, if necessary. The Parties acknowledge that the City does not support or endorse the Project. Both Parties recognize the expense, time, effort and risk in entering into eminent domain litigation. The terms set forth in this MOU, the Technical Memorandum of Understanding (the "Technical MOU"), and any deed 29 April 1999 or any Right of Way Contract entered into by and between the City and BART, or its partner SamTrans, have been agreed upon to avoid such litigation. D. BART has obtained from Mayne Tree Expert Company, Inc., two surveys of the trees located within the City that will be removed or otherwise affected by construction of the Tailtrack (the "Tree Surveys'). The Tree Surveys consist of a "Report on Impact of a Wall on a Row of Trees on California Drive, Burlingame, Re: SFO Airport Extension" dated November 19, 1997 (the "California Drive Tree Survey'), attached as Attachment A hereto; and a "Tree Survey, BART SFO Extension, Burlingame, California" dated February 4, 1999, with an Addendum dated April 21, 1999 (together, the "Landscaping Easement Tree Survey"), attached as Attachment B hereto. E. At the City's request, the plan for construction of the Tailtrack included a visual wall approximately seven feet to the east of California Drive, from Murchison Drive on the north to Dufferin Avenue on the south (the "Visual Wall") on property owned by the City and County of San Francisco, over which SamTrans has an Order for Possession. The Visual Wall was included as an option in BART's Contract No. 12YU-110. The City, as reflected in the vote of the City Council on June 10, 1998, desires that the Visual Wall be replaced with a landscaping barrier, including soil preparation, removing and replacing trees and other vegetation, irrigation, landscaping, systems and supporting structures (the "Landscaping Barrier"), in the area shown on Attachment C. The City is willing to construct the Landscaping Barrier, and BART is willing to contribute certain 29 April 1999 funds toward construction of the Landscaping Barrier that would have been used in construction of the Visual Wall. F. The City currently owns a landscaping easement (the "Landscaping Easement") over a parcel of property currently owned by the Texo Realty Corporation (the "Texo Property"). BART intends to acquire a portion of the Texo Property in fee and requires use of another portion temporarily during construction of the Project. In connection with its use of these portions of the Texo Property, BART will need to clear the City's interest in the Landscaping Easement from the areas listed as parcels D -3707-1D and D-3709-1, as shown on Attachment D, and further requires an encroachment permit over the area listed as parcels D-3707-4 and D- 3709-4, also shown on Attachment D, for the duration of the construction period. G. In connection with construction of the Project, BART intends to remove or cause to be removed one hundred thirty-three (13 3) trees owned by the City now located in the City's Landscaping Easement or on other property owned by the City (the "City Trees"), as identified in Attachment E. H. BART and the City enter into this MOU to provide for replacement of one hundred twenty-nine (129) of the City Trees, the City's construction of the Landscaping Barrier and BART's contribution thereto, and BART's acquisition of a portion of the City's interest in the Texo Property. I. Concurrently with the execution of this MOU, BART and the City are entering into the Technical MOUwith respect to construction of the Project within the City. Also concurrently with the execution of this MOU, the City and BART or BART's designee will enter into a Right of Way Contract under which the City 29 April 1999 will convey to SamTrans, on behalf of BART, grant deeds to certain real properties. AGREEMENT NOW, THEREFORE, BART and the City, for good and valuable consideration, the receipt and sufficiency of which is acknowledged, agree as follows: 1. City Tree Replacement. With the exception of the trees identified in Section LA below, BART will pay for replacement of all City Trees removed by BART or its contractor(s), on a 2:1 basis, plus planting costs. The City shall have no responsibility for removal of any trees within the BART right of way. A. Excluded Trees. The City acknowledges that BART will not be responsible to replace, to make any tree replacement payment under Section LB below or to pay any damage or removal claim by the City for: (i) four City -owned trees (numbered 10, 23, 24 and 117 in the Landscaping Easement Tree Survey) which will be removed for construction of the Tailtrack but which, according to the Landscaping Easement Tree Survey, are dead; (ii) any trees removed by BART or by the City from the Landscaping Barrier area; and (iii) any trees not owned by the City. B. City Tree Replacement Payment. With respect to each of the 129 City Trees to be removed by BART and replaced by the City, BART shall pay Three Hundred Dollars ($300) for each replacement tree, and One Hundred Fifty Dollars ($150) for the cost of planting each such replacement tree. BART will replace each of 4 29 April 1999 the 129 City Trees on a 2:1 basis. Thus, each of the 129 City Trees will be replaced by the City with two replacement trees, at a cost of $300 per tree and $150 for the planting of each tree, for a total payment of Nine Hundred Dollars ($900) for each of the City Trees to be replaced. The total BART payment for the replacement of City Trees shall not exceed One Hundred Sixteen Thousand One Hundred Dollars ($116,100). C. Time of Pg=ent. BART will make the City Tree replacement payments due under this MOU concurrently with the City's delivery to BART or BART's designee of the quitclaim deed described in Section 3 below. D. Tree Surveys, The City accepts as accurate the contents of the Tree Surveys as to the identities, locations and pre -construction conditions of all trees listed in the Tree Surveys. E. Location of Replacement Trees. The City must use any City Tree replacement payment from BART under this MOU to plant trees or have trees planted at any location within the City that the City chooses, except within Project property. F. BART Responsibility After Payment Other than BART's obligations under Sections LB of this MOU, BART shall have no further responsibility, obligation or liability of any kind to the City with respect to any trees, shrubbery, or landscaping located on Project property. BART shall have no responsibility to oversee the City's replacement program or any liability for any replacement trees planted by the City from funds paid under this MOU or for their maintenance. After construction of the Tailtrack is complete, any trees or plants located on Project property in the City will be maintained by BART in accordance with 29 April 1999 BART's normal policies and procedures for such trees and plants. BART shall have no maintenance responsibilities for trees, plants or landscaping located outside the Project property. 2. Landscaping Barrier. The Landscaping Barrier will be composed of new hedges, shrubbery, irrigation and trees, as the City may find suitable for the location, and its construction will involve removal of existing trees and vegetation, soil preparation and installation of landscaping support structure as necessary. The design and composition of the Landscaping Barrier will be the sole responsibility of the City, subject to Section 2.E of this MOU. The City agrees to design the Landscaping Barrier and put it in place, or to cause it to be designed and put in place. In accordance with the terms of this MOU, BART will pay the City its actual costs for design and construction of the Landscaping Barrier, not to exceed One Hundred Sixty-one Thousand Dollars ($161,000). Any costs of the Landscaping Barrier in excess of $161,000 shall be borne by the City. In no event shall BART pay more than $161,000 toward the Landscaping Barrier. The BART payment for the Landscaping Barrier will be made in two installments. A. Initial Payment. BART's initial payment for the Landscaping Barrier under this MOU shall be made only upon completion of Phase 1 of construction of the Landscaping Barrier and submittal of an acceptable invoice by the City. For purposes of this MOU, Phase 1 shall consist of design of the Landscaping Barrier; removing shrubs and half the trees located in the Landscaping Barrier area before BART construction; planting thirty-six (36) twenty -four -inch box trees; planting a hedge; pruning the remaining trees; and installing landscaping support structures 6 29 April 1999 and an irrigation system. Phase 1 shall be completed by December 31, 2000. The City's estimated cost for Phase 1 is One Hundred Twenty-nine Thousand Dollars ($129,000). B. Final Payment. Phase 2 shall consist of removal of the remainder of the existing trees, planting another thirty-six (36) twenty -four -inch box trees and such other planting or action as may be necessary to complete the Landscaping Barrier in accordance with the plans and specifications provided to BART under Section 2.E below. Phase 2 shall be completed by July 31, 2004. The City's estimated cost for Phase 2 is Thirty-two Thousand Dollars ($32,000). Upon completion of Phase 2, the City will invoice BART for its final payment no later than July 31, 2004 or six months prior to close out of BART's Full Funding Grant Agreement with the FTA (the "FFGA'), whichever is earlier. If BART has reason to believe that the FFGA close out will occur prior to January 31, 2005, BART will give the City at least fifteen months' prior notice of the projected date of the FFGA close out; the date for the City's completion of the Landscaping Barrier and the date for submission of the City's invoice shall be advanced, both to no later than six months prior to the projected FFGA close out date. C. Replacement of Visual Wall. The City agrees that BART shall not construct the Visual Wall and that BART shall have no further obligation to the City relating to construction of the Visual Wall. D. Trees Removed. None of the trees removed from the Landscaping Barrier area, whether by BART during construction of the Project or by the City, are subject to City Tree replacement payments under Section LA above or to tree damage and 29 April 1999 removal claims by the City, and BART shall have no liability for removal or replacement of such trees. In connection with construction of the Project, BART plans to remove eight trees (numbered 5,6,7,8,9, 10, 23 and 24 in the California Drive Tree Survey) from the Landscaping Barrier area, and the City agrees that no authorization is needed for such removal by BART or its contractor. If BART's construction schedule calls for it to remove any additional trees from the Landscaping Barrier area before the City does so, BART will notify the City of its intention to remove such trees and receive the City's authorization prior to removal. E. BART Review. The City agrees to construct the Landscaping Barrier in accordance with plans and specifications reviewed and approved by BART. BART shall have thirty (30) business days from receipt of final plans and specifications to respond. F. Failure to Complete In the event that the City has not completed the Landscaping Barrier on or before July 31, 2004, the City and BART will meet and confer, and BART in its discretion may elect to finish construction of the Landscaping Barrier in accordance with the City's approved plans and specifications. The City shall cooperate with BART in completion of the construction. The City's cooperation will include, but not be limited to, providing BART with (i) copies of any plans or designs for the Landscaping Barrier that BART may request; (ii) permits and authorizations as appropriate for finishing construction of the Landscaping Barrier; and (iii) access to the City property on which the Landscaping Barrier is being constructed at the location shown on Attachment C. BART will make no 29 April 1999 further payment to the City for the Landscaping Barrier if the Landscaping Barrier is not completed on or before July 31, 2004. G. Maintenance. The City shall be solely responsible for maintenance of any trees, plantings or landscaping that are, or may in the future be, located in the Landscaping Barrier. BART shall have no responsibilities for maintenance or otherwise of any trees, plants or landscaping located outside Project property. 3. Landscaping Easement and Texo Prop. In consideration of BART's undertakings in this MOU and the Technical MOU, and concurrently with the execution of this MOU, the City will quitclaim to SamTrans, on behalf of BART, all of its right, title and interest in the portion of the Texo Property labeled as BART parcels D -3707-1D and D-3709-1 on Attachment D, reserving to the City, as appropriate, easements for utilities currently located or being relocated within the Texo Property. The quitclaim deed to be delivered to SamTrans regarding the Texo Property and the Landscaping Easement shall be in the form of Attachment F. The City further agrees to provide BART or BART's contractor(s), following execution of this MOU and upon request by BART or BART's contractor(s), with access to the areas labeled as D-3707-4 and D-3709-4 on Attachment D under an encroachment permit in the form of Attachment G. 4. Miscellaneous A. Payment by BART pursuant to this MOU will be made within thirty (30) days of receipt of an acceptable invoice supported by such evidence as BART may 29 April 1999 reasonably require. All invoices shall be made in writing and delivered or mailed to BART as follows: The San Francisco Bay Area Rapid Transit District West Bay Extensions 800 Madison Street P.O. The City agrees to perform all work in accordance with rates which are (i) reasonable and (ii) usually and customarily charged by the City for work performed by the City in the normal course of its business. The City agrees that only actual allowable, allocable, necessary and reasonable costs are reimbursable by BART. Whether work is performed by the forces of the City or by a third party, no City profit is allowed. The City's costs (excluding third party costs) shall comply with OMB Circular A-87 and 49 CFR Part 18, and the City will conform with the applicable requirements of FTA Circulars 5010.B and 4220. ID. In the event third parties perform work on behalf of the City under this MOU, the cost principles set forth in OMB Circular A-87 or, as appropriate, 48 CFR Part 31 shall be used to determine the allowability, allocability, and reasonableness of costs subject to reimbursement by BART. 10 29 April 1999 C. BART reserves the right to review records, reports, payrolls, accounts, documents and any data relevant to this MOU for purposes of making determinations on the acceptability of any billing submitted by the City to BART. BART will notify the City of any billing or portion thereof which is not deemed acceptable and may withhold such amounts from any payments due to be made to the City or may request reimbursement of such amounts from the City. D. (i.) The City agrees to establish and maintain, and to require its contractor(s) to establish and maintain, records pertaining to the fiscal activities of work under this MOU, which records shall show the actual time devoted and the costs incurred by the City with respect to any work performed under this MOU. The accounting systems of the City and its contractor(s) shall conform to generally accepted accounting principles, and all records shall provide a breakdown of total costs charged to the Project, including properly executed payrolls, time records, invoices and vouchers. Upon written request, the City shall, at a mutually convenient time, permit BART, the Secretary of Transportation, the Comptroller General of the United States, and their representatives to inspect, examine, re- examine, and copy the City's and its contractor's books, records, accounts, and any and all data relevant to this MOU for the purpose of auditing and verifying costs charged to BART by the City pursuant to this MOU, and shall provide such assistance as may be reasonably required in the course of such inspection. The City and/or its contractor(s) shall, at BART's request, provide a letter of representation concerning its usual and ordinary charges for work similar to the 11 29 April 1999 work to be performed under this MOU, as well as the accounting systems utilized by the City and its contractor(s) for work to be performed under this MOU. (ii.) BART reserves the right, for itself, the Secretary of Transportation, the Comptroller General of the United States, and their authorized representatives, to examine and re-examine such books, records, payrolls, accounts and data during the three (3) year period after payments under this MOU and until all pending matters are closed, and the City and its contractor(s) shall in no event dispose of said books, records, payrolls, accounts and data in any manner whatsoever for three (3) years after the payments under this MOU or until all pending matters are closed, whichever is later. E. Pursuant to California Government Code Section 8546.7, the Parties shall be subject to the examination and audit of the State Auditor, at the request of BART or as part of any audit of BART by the State Auditor, for a period of three (3) years after all payments under this MOU. The examination and audit shall be confined to those matters connected with the performance of this MOU, including, but not limited to, the cost of administering the MOU. F. Neither BART nor any director, officer, agent or employee of BART is responsible for any damages or liability occurring by reason of anything done or omitted to be done by the City, its officers, agents, employees and consultants, under or in connection with any work, authority or jurisdiction assumed by or assigned to the City under this MOU. Pursuant to Government Code Section 895.4, the City will fully indemnify, hold harmless and defend in any claim or litigation BART, its directors, officers, agents and employees from any damage or 12 29 April 1999 liability occurring by reason of anything done or omitted to be done by the City, its officers, agents, employees and consultants under or in connection with any work, authority or jurisdiction assumed by or assigned to the City under this MOU. The duty of the City to indemnify and hold harmless, as set forth above, shall include the duty to defend as set forth in Section 2778 of the California Civil Code provided, however, that nothing herein shall be construed to require the City to indemnify BART, its directors, officers, agents and employees against any responsibility or liability in contravention of Section 2782 of the California Civil Code. G. Neither the City nor any officer, agent or employee of the City is responsible for any damages or liability occurring by reason of anything done or omitted to be done by BART, its directors, officers, agents, employees and consultants, under or in connection with any work, authority or jurisdiction assumed by or assigned to BART under this MOU. Pursuant to Government Code Section 895.4, BART will fully indemnify, hold harmless and defend in any claim or litigation the City, its officers, agents and employees from any damage or liability occurring by reason of anything done or omitted to be done by BART, its directors, officers, agents, employees and consultants under or in connection with any work, authority or jurisdiction assumed by or assigned to BART under this MOU. The duty of BART to indemnify and hold harmless, as set forth above, shall include the duty to defend as set forth in Section 2778 of the California Civil Code provided, however, that nothing herein shall be construed to require BART to 13 29 April 1999 indemnify the City, its officers, agents and employees against any responsibility or liability in contravention of Section 2782 of the California Civil Code. H. All notices required hereunder may be given by either personal delivery, U.S. mail, courier service (e.g. Federal Express) or telecopier transmission. Nothing in this MOU is intended to nor does establish the Parties as partners, co - venturers or principal and agent with one another. I This MOU shall be interpreted under and pursuant to the laws of the State of California. The Parties agree that the jurisdiction and venue of any dispute between the Parties to this MOU shall be the Superior Court of San Mateo County. K. This MOU shall be binding upon and inure to the benefit of the transferees, successors and assigns of each of the Parties to it, except that there shall be no transfer of any interest by either of the Parties to this MOU except pursuant to the terms of the MOU. L. No right or remedy conferred upon or reserved to BART or the City under this MOU is intended to be exclusive of any other right or remedy, except as expressly stated in this MOU, and each and every right and remedy shall be cumulative and in addition to any other right or remedy given under this MOU or now or hereafter existing at law or in equity or by statute, except such rights or remedies as are expressly limited in this MOU. M. In addition to specific provisions of this MOU, performance by either Party shall not be deemed to be in default where delays or defaults are due to war, insurrection, strikes, lockouts, riots, floods, earthquakes, fires, quarantine restrictions, casualties, acts of God, acts of the public enemy, epidemic, government restrictions on priorities, freight embargoes, shortage of labor or materials, unusually inclement weather, lack of transportation, court order, or any other similar causes beyond the control or without the fault of the Party claiming 15 29 April 1999 an extension of time to perform. An extension of time for any cause will be deemed granted if notice by the Party claiming such extension is sent to the other Party within thirty (30) days from the commencement of the cause and such extension is not rejected in writing by the other Party within thirty (30) days of receipt of the notice. Time of performance under this MOU may also be extended by mutual written MOU, signed by both Parties. N. No director, member, official, employee or agent of the City or BART shall be personally liable to any Party to this MOU or to any successor in interest in the event of any default or breach of this MOU or for any amount which may become due on any obligation under the terms of this MOU. O. If any term, provision, covenant or condition of this MOU is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions shall continue in full force and effect unless the rights and obligations of the Parties have been materially altered or abridged by such invalidation, voiding or unenforceability. P. This MOU shall not be effective without the execution by both Parties and delivery, under due legal authority, of the Technical MOU and the Right of Way Contract, and the delivery to BART or BART's designee of the executed Quitclaim Deed (Attachment F) and any deeds relating to the Right of Way Contract. Q. This MOU represents the full, complete and entire MOU of the Parties with respect to the subject matter hereof, and supersedes any and all other communications, representations, proposals, understandings or MOUs, whether 16 29 April 1999 written or oral, between the Parties with respect to such subject matter. This MOU may not be modified or amended, in whole or in part, except by a writing signed by an authorized officer or representative of each of the Parties. This MOU is made and entered into as of the date set forth above. Huntington 1.0 SUMMARY The Bay Area Rapid Transit District will require the removal of many of the trees east of the Southern Pacific Railroad Tracks, from Murchison Drive to Trousdale Drive in Burlingame, California. The trees to be removed are mostly bluegum eucalyptus that were planted as a windbreak nearly one hundred years ago. In addition, there are many seedlings and suckers. Many of the trees had been topped for utility line clearing purposes. Of the one hundred and fourteen trees inspected, only a couple can be considered good specimens. Although the total canopy cover to be removed is substantial, the loss of habitat for fauna is minimal, as a few vertebrates (or invertebrates) appear to be inhabiting the area. On January 20 and February 2, 1999, the trees east of the railroad tracks and west of the culvert opposite where Murchison Drive in Burlingame meets California Drive, were inspected. These trees extend in a straight line east of the railroad tracks opposite Trousdale Drive. The purpose of the inspection was to provide information on the species, size, condition and functional value of each tree. This information can be used to arrive at an appraised value of the linear stand, composed of one hundred and fourteen trees. 3.0 METHOD A tree, for purposes of this report, is a woody single or multiple trunk specimen that is a least four (4) inches in diameter, measured fifty-four inches high. This measurement, given as diameter in inches, is known as diameter breast high (DBH). Where several trunks exist at fifty-four inches in height, the largest diameter, plus one-half the sum of the remaining diameters, is given as a single trunk size. This size appears in parenthesis. Sometimes it is more appropriate to measure the diameter at a height other than DBH, and to extrapolate to the DBH. When this occurs, the estimated diameter is again presented in parentheses. There are many suckers and seedling volunteers from the parent trees that are undersized and are not included in the report. In addition, there are some stumps of large trees that were cut down that developed watersprouts. Unless the watersprouts attained the minimum diameter, they too were not included in this report. Huntington The trees were located in the field with the aid of the Site Grading, Drainage and Paving Plans, dated June 12, 1997, and two aerial photographs. Each tree was identified and tagged with a 1/2 x 1 inch green plastic strip stapled to the trunk about 5 feet high. The tree number is embossed on the strip. This same number is used to identify the trees in this report as well as on the tree location maps found in the Appendix of this report. The condition of each tree relates to the noted vitality and stability. Many of the trees in this stand are coppice sprouts or suckers from roots and have low condition ratings. The are as follows: 0-29 ....................... Very poor 30-49 ..................... Poor 50-69 ..................... Fair 70-89 ...................... Good 90-100 .................... Excellent structural from stumps condition ratings The placement of each tree refers to where the tree is growing and its contribution to the environment from that particular placement. The scale of ratings is the same as that for the condition. In most cases, the placement rating is fair (60), unless the trees were growing beneath utility lines or were too close together. The latter causes competition, which affects the form or architecture of the tree, as well as the vitality. The contribution rating in most cases is also fair, as the row acts as a windbreak and a screen from the adjacent manufacturing plants and the railroad. The entire area (site) is rated as 70% (good), as it is in a high value commercial (light industry) area. The tree factors: condition, placement and site, are averaged to provide a location percentage. This percentage is necessary for appraisal purposes. The remarks column generally reflects on the condition or placement rating. Since these trees are to be removed in order to make the improvements, no remedial tree work advice is given. Huntington The lineal stand of primarily eucalyptus trees has been severely abused over the years. Many trees have been cut down, with the falling trunks damaging the surrounding trees. Others have been topped, allowing decay, weakly attached limbs and poor root growth to occur. Still others have been constantly side trimmed, causing an imbalance in the trees. It is my opinion that this lineal stand is inappropriate for an area that will be frequented by the general population, as the risk of tree failures (entire or limbs) is too high. Even without a high value target, the stand is an attractive nuisance that can lead to injuries to transients, adventuresome children and others. It is my opinion that clearcutting this stand is in the best interest of the community.
