RESOLUTION APPROVING CATEGORICAL EXEMPTION
CONDITIONAL USE PERMIT FOR NON-A`JTG RELATED BUSINESS,
AND INCREASED NUMBER OF EMPLOYEES
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS a cateeorical exemption has been proposed and application has been made for a
conditional use permit to allow a non -related business and _increased number ofemployees at 224
California Drive" zoned C-2. Auto -Row, APN• 029-213-010• Citi Properties Lie 2101 Market Street San

WHEREAS, the Planning Commission held a public hearing on said application on April 12. 1999

at which time said application was approved;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on May 3, 1999

at which time it reviewedandconsidered the staff report and all other written materials and testimony presented

at said hearing;

NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
I. On the basis of the Initial Study and the documents submitted and reviewed, and commentsreceivedand
addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth
above will have a significant effect on the environment, and a categorical exemption per Article 19, Section
15321, Class 21(a), actions by regulatory agency to enforce or revoke a lease, permit, license, certificate, or
other entitlement for use issued, adopted or prescribed by regulatory agency or enforcement of a law, general
rale, standard, or objective, administered by the regulatory agency is hereby approved.
2. Said conditional use permit for non -auto related business and increased number of employees is
approved, subject to the conditions set forth in Exhibit "A" attached hereto. -Findings for such conditional use
permit for non -auto related business and increased number of employees are as set forth in the staff report,
minutes and recording of said meeting. -
3. It is further directed that a certified copy of this resolution be recorded in the official records of the
County of San Mateo. rn _

Conditions of approval categorical exemption, CONDITIONAL USE PERMIT FOR NON -AUTO RELATED
BUSINESS AND INCREASED NUMBER OF EMPLOYEES

effective MAY 3, 1999
1. that the restaurant shall be open from 4:00 p.m. until 12:00 midnight on Mondays through Fridays, 11:00
a.m. until 1:00 a.m. on Saturdays, and from 11:00 a.m. to 12:00 midnight on Sundays with no service
to the public before the hours designated in this condition;
2. that before 6 p.m. the maximum number of employees on the site shall be limited to five with three of
these employees conducting deliveries and after 6 p.m. there may be a maximum of 10 employees on the
site with seven of them conducting deliveries;
3. that there shall be no patron/customer seating inside the business, no alcoholic beverages shall be sold
from the site, and 95% of the business from this site shall be by off-site delivery;
4. that deliveries of all supplies to the business shall be made from the loading zone on South Lane;
5. that if there is any change in the proposed operation, number of employees, delivery schedule, hours of
operation or addition of seating, this permit shall be amended;
6. that this use permit shall be reviewed for consistency with its conditions in one year's time (April 2000)
or upon complaint; and
7. that if any improvements are proposed on site the applicant shall apply for a building permit and the
improvements for the use shall meet all California Building and Fire Code requirements in the 1995
Edition as amended by the City of Burlingame.

RESOLVED by the CITY COUNCIL of the City of Burlingame that:
