RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
ADOPTING RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION
GUIDELINES AND PROCEDURES
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, the City of Burlingame may acquire real property in the near future; and
WHEREAS, State law provides certain procedures for acquisition that protect the rights
of the property owners and occupants; and
WHEREAS, in order to properly acquire property, State law requires the City to adopt
rules and regulations to implement the relocation requirements of State law; and
WHEREAS, the California Department of Housing and Community Development has
adopted Guidelines that implement State law for acquisitions by State agencies and that the City
can adopt by reference to fulfill its requirements,
NOW, THEREFORE, IT IS RESOLVED AND ORDERED:
1. The Relocation Assistance and Real Property Acquisition Guidelines adopted by the
California Department of Housing and Community Development (Title 25, Section 6000 and
following of the California Code of Regulations) ("Guidelines") are adopted as the City's Rules
and Regulations for Relocation Assistance and Real Property Acquisition subject to the following:
A. If Chapter 16 of Division 7 of Title 1 of the Government Code ("Act") or the
Guidelines are amended, the City's Rules and Regulations adopted pursuant to this Resolution are
automatically amended to be consistent with the Act and the Guidelines, as amended.
B. Any reference in the Guidelines to "public entity" shall mean the City of Burlingame
unless the context requires otherwise.
C. Any reference in the Guidelines to the "head of the public entity" shall mean the City
Manager of the City of Burlingame, or the City Manager's designee.
D. In accordance with Section 6032 of the Guidelines, the City will provide relocation
advisory assistance. The relocation advisory assistance will satisfy the requirements of Article 2
of the Guidelines.
E. In the event that a review pursuant to Section 6152 is sought by any person entitled
thereto, the review will be conducted and determined by either the City Manager of the City of
Burlingame or the City Manager's designee. In the event that a formal review and
reconsideration is sought by any person entitled thereto, the review and reconsideration will be
conducted and determined by the City Manager.
F. In addition to making the payments required by the Act and the Guidelines, the City
may make any additional payments that in the City Council's sole discretion may be reasonably
necessary under the circumstances of the specific case to carry out the City's purposes and to
further the City's goals set forth for the specific project or acquisition.
G. This Resolution shall not apply retroactively to actions undertaken by the City prior to
the adoption of this Resolution.
