RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AUTHORIZING THE CITY MANAGER TO VOTE TO ESTABLISH
THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY (SBWMA) IN PLACE OF
THE SOUTH BAYSIDE TRANSFER STATION AUTHORITY (SBTSA) AND FOR THE
SBWMA TO PURCHASE SOLID WASTE TRANSFER FACILITIES
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, a majority of the members of the South Bayside Transfer Station Authority
(SBTSA) wish to exercise the authority given in SBTSA's agreement with Browning-Ferris
Industries, Inc. (BFI) to purchase the transfer station in San Carlos currently owned by BFI; and
WHEREAS, there is no obvious benefit to the citizens of Burlingame from such a purchase;
and
WHEREAS, however, the joints powers authority does provide important support in dealing
with the State of California's mandates for waste stream reduction, a single point of contact with BFI
on waste collection matters, and a coherent approach to recycling programs for member cities; and
WHEREAS, one of the key advantages of the joint powers agency arrangement is that City
staff is relieved of routine solid waste collection oversight, but that relief cannot occur if the joint
powers agency does not retain sufficient personnel and expertise to manage its own affairs; and
WHEREAS, the management and oversight of the multi-million dollar transfer facility
requires additional dedication by member agencies in the SBWMA and retention of professional staff
to provide daily, ongoing oversight; and
WHEREAS, this powerful agency should be subject to full public scrutiny at all times,
NOW, THEREFORE, IT IS RESOLVED AND ORDERED:
1. The City Manager or the Manager's designated representative is authorized and directed
to vote to approve the reorganization of SBTSA into SBWMA and for purchase of the transfer
facility in San Carlos on the following understandings:
A. The representatives of member agencies attending SBWMA meetings shall be elected or
staff members of the agency with a sufficient level of authority and experience to meaningfully
participate in those meetings as designated in writing by each agency.
B. Meetings of the SBWMA shall be conducted to encourage public participation, including
varying the times and locations of the meetings throughout the SBWMA area.
C. SBWMA shall seek and retain professional staff to oversee and manage the transfer
facility in San Carlos as well as solid waste and recycling programs.
D. The good faith and credit of the City of Burlingame shall in no way be pledged or
implicated by any issuance of any indebtedness by SBWMA for any purpose.
2. The Clerk is directed to attest to the signature of the Manager.

DECEMBER 1999, and was adopted thereafter by the following vote:
