RESOLUTION APPROVING NEGATIVE DECLARATION
AND PARKING DIMENSION VARIANCE AND CONDOMINIUM PERMIT
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a negative declaration has been proposed and application has been made for a
parking dimension variance and condominium permit for 3 -story. 12 -unit condominium building with
underground parkine at J 237-1241 Capuchino Avenue zoned R-3 Lap Kit &Cho -Rae Cheung 1525
Hayne Road Hillsborough CA 94010 property owners. APN: 026-096-050.
WHEREAS, the Planning Commission held a public hearing on said application on November
8. 1999, at which time said application was denied without prejudice;;
WHEREAS, this matter was annealed to City Council and a hearing thereon held on December
6. 1999 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by alis Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and negative declaration,
per Negative Declaration No. ND -500P is hereby approved
2. Said negative declaration and parking dimension variance and condominium permit are approved,
subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such negative declaration
and parking dimension variance and condominium permit are as set forth in the staff report, minutes and
recording of said meeting.
It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Department date
stamped October 25, 1999, sheets Al through A7, Site Plan, Floor Plans, Roof Plan, Elevations, Site
Section, and Sheet PL -i, Landscape Plan;
2. that the maximum elevation at the top of the roof ridge shall not exceed elevation +55.8' as
measured from the average elevation at the top of the curb along El Camino Real (+21.21') for
a maximum height of 34'-7", and that the top of each floor and final roof ridge shall be surveyed
and approved by the City Engineer as the framing proceeds and prior to final framing and roofing
inspections. The ground floor finish floor elevation shall be elevation +22.6'; first floor top of
0 plate shall be elevation +32.1'; second floor top of plate elevation shall be elevation +42.6'; the
Qthird floor top of plate elevation shall be +52.8' and the top of ridge elevation shall be +55.8'.
NShould any framing exceed the stated elevation at any point it shall be removed or adjusted so that
wlthe final height of the structure with roof shall not exceed the maximum height shown on the

August 11, 1999 memo shall be met;
4. that the property owner shall be required to work with the city and to pay the cost for installing a
timed parking or loading zone infront of the project site to facilitate deliveries to all the residents on
the street;
5. that `guest parking stall' shall be marked on the 3 guest stalls and designated on the final map and
plans, these stalls shall not be assigned to any unit, but shall be owned and maintained by the
condominium association, and the guest stalls shall be always accessible for parking and not be
separately enclosed or used for resident vehicular storage or any other non -parking use;
6. that the project shall include an intercom system outside the security gate with access to each unit
which will allow residents to allow guests to enter the secured parking area for access to the guest
parking;
7. that the parking spaces in the underground garage shall be designed with a minimum 8'-6" x 19'-0"
parking space dimension and shall be managed and maintained by the condominium association to
provide parking at no additional fee, solely for the condominium owners, and no portion of any
parking area and the egress aisles shall be converted to any other use or any support activity such as
storage or utilities;
8. that the Covenants Corffiitions and Restrictions (CC&Rs) for the condominium project shall require
that the 3 guest parking stalls shall be reserved for guests only and shall not be used by condominium
residents and that residents shall not park boats or other recreational vehicles in resident guest parking
on site;

9. that a bicycle rack, 8 - 28 SF storage closets and 19 wall/ceiling mounted storage units above the
parking spaces along the wall shall be provided in the underground garage; minimum clearance blow
the wall mounted storage units shall be 7' so that they will not obstruct parking;
10. that the final inspection shall be completed and a certificate of occupancy issued before the close of
escrow on the sale of each unit;
11. that the developer shall provide to the initial purchaser of each unit and to the board of directors of
the condominium association, an owner purchaser manual which shall contain the name and address
of all contractors who performed work on the project, copies of all warranties or guarantees of
appliances and fixtures and the estimated life expectancy of all depreciable component parts of the
property, including but not limited to the roof, painting, common area carpets, drapes and furniture;
12. that the trash receptacles, furnaces, and water heaters shall be shown in a legal compartment outside
the required parking and landscaping and in conformance with zoning and California Building and
Fire Code requirements before a building permit is issued;
13. that the design of the new building shall incorporate the seismic standards of the California Building
Code, 1998 Edition;
14. that the project shall be required to meet all the requirements of the California Building and Fire
Codes, 1998 edition, as amended by the City of Burlingame for structural stability;
15. that demolition of the existing structures and any grading or earth moving on the site shall be required
to comply with all the regulations of the Bay Area Air Quality Management District;
16. that this proposal shall comply with all the requirements of the Tree Protection and Reforestation
Ordinance adopted by the City of Burlingame in 1993 and enforced by the Parks Department;
complete landscape and irrigation plans shall be submitted at the time of building permit application;
17. that the applicant shall install fire sprinklers and a fire alarm system monitored by an approved central
station prior to the final inspection for the building permit;
18. that all construction shall abide by the construction hours established in the municipal code;
19. that the method of construction and materials used in construction shall insure that the interior noise
level within the building and inside each unit does not exceed 45 dBA;
20. that all new utility connections to serve the site, and which are affected by the development, shall be
installed to meet current code standards and local capacities of the collection and distribution systems
shall be increased at the developer's expense if necessary;
21. that sewer laterals from the site to the public sewer main shall be checked and shall be replaced to city
standards as required by the development;
22. that abandoned utilities and hookups shall be removed;

23. that the foundation and garage walls shall be built to withstand additional hydrostatic pressure to
reduce seepage to the minimum and a sump pump shall be installed to evacuate weepage, the City
Engineer shall approve the design prior to issuance of a building permit;
24. that the developer shall install an emergency generator to power the sump pump system; and the sump
pump shall be redundant in all mechanical and electrical aspects (i.e., dual pumps, controls, level
sensors, etc.); emergency generators shall be housed so that they meet the City's noise requirement;
25. that the sump pump for the underground garage shall drain to the gutter and shall ultimately go to
the storm drain system;
26. that all on-site drainage inlets or the sump pump basin for the underground garage shall provide a
petroleum absorbent system for treating all drainage flows from the automobile parking area;
that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
that this project shall comply with Ordinance No. 1477, Exterior Illumination Ordinance,
that any street trees shall be protected during construction; and
that should any cultural resources be discovered during construction, work shall be halted until they
are fully investigated by a professional accepted as qualified by the City Planner and the
recommendations of the expert have been executed to the satisfaction of the City..

reduce seepage to the minimum and a sump pump shall be installed to evacuate weepage, the City
Engineer shall approve the design prior to issuance of a building permit;
24. that the developer shall install an emergency generator to power the sump pump system; and the sump
pump shall be redundant in all mechanical and electrical aspects (i.e., dual pumps, controls, level
sensors, etc.); emergency generators shall be housed so that they meet the City's noise requirement;
25. that the sump pump for the underground garage shall drain to the gutter and shall ultimately go to
the storm drain system;
26. that all on-site drainage inlets or the sump pump basin for the underground garage shall provide a
petroleum absorbent system for treating all drainage flows from the automobile parking area;
27. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Discharge Control Ordinance;
28. that this project shall comply with Ordinance No. 1477, Exterior Illumination Ordinance;
29. that any street trees shall be protected during construction; and
30. that should any cultural resources be discovered during construction, work shall be halted until they
are fully investigated by a professional accepted as qualified by the City Planner and the
recommendations of the expert have been executed to the satisfaction of the City.
