RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDERS ON BEHALF
OF THE CITY OF BURLINGAME IN A TOTAL AMOUNT OF UP TO FIFTEEN
PERCENT OF THE ORIGINAL CONTRACT PRICE
IF WITHIN THE PROJECT BUDGET
RESOLVED, by the City Council of the City of Burlingame:
WHEREAS, it is important that staff be given authority to expeditiously execute change
orders to City contracts so that contractors and consultants are not delayed in performing work
under a contract and so that unnecessary costs are not incurred by the City; and
WHEREAS, a project budget should be the primary control on project costs, and limited,
justified change orders within that project budget should be subject to staff approval,
WHEREAS, the State Public Contract Code and Chapter 2.28 of the Burlingame Municipal
Code require formal bid procedures for public works contracts in excess of $75,000, and this
resolution would allow change orders for such contracts as described in this resolution,
NOW, THEREFORE, IT IS RESOLVED AND ORDERED:
1. The City Manager or the Manager's duly authorized designee is hereby authorized to
execute change orders to City project agreements with contractors and consultants in a total amount
of up to fifteen percent (15%) of the original contract price, so long as the total of any such change
orders will not cause the project to exceed the approved project budget.
2. The City Manager shall require submission of Exhibit A with each request for a change
order pursuant to this resolution.
