RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME APPROVING AWARD OF PURCHASE AGREEMENT
FOR AERIAL LIFT TRUCK TO ALTEC INDUSTRIES, INC. AND REJECTING BID
OF TECO AND REJECTING PROTEST OF PACIFIC UTILITY EQUIPMENT
COMPANY
WHEREAS, the City of Burlingame duly sought bids in order to purchase an aerial lift truck
for tree trimming in the City; and
and
WHEREAS, on September 20, 1999, the City opened the sealed bids submitted; and
WHEREAS, the apparent low bidder TECO's bid did not comply with City's specifications;
WHEREAS, Altec Industries, Inc. was the apparent next low bidder offering to sell the City
a truck that met all City specifications at a cost of $89,000; and
WHEREAS, the third lowest bidder, Pacific Utility Equipment Co., alleged in a letter that
the truck offered by Altec would be unsafe and was illegal; and
WHEREAS, the City has determined that the truck originally offered by Altec would be safe
and was not illegal; and
WHEREAS, in spite of originally meeting all of the City's specifications, Altec offered to
increase the spring strength of the offered truck to allay any possible concern regarding the truck's
safety and durability at no additional cost to the City; and
WHEREAS, in spite of this offer by Altec to ensure the public's safety at a fair price and to
meet the public interest, Pacific Utility Company has filed a formal protest, contending that Altec's
un -required generosity constitutes a reopening of the bidding process and Pacific Utility wants to
change its bid price; and
WHEREAS, Pacific Utility's original protest was not factual and its second protest seeks to
correct a bid that was too high, and is not in the public interest nor fair in any way to Altec,
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
1. The bid of TECO is rejected.
The protest of Pacific Utility Company is rejected.
The bid of Altec Industries, Inc. is accepted and approved, and the Parks & Recreation
Director is authorized to accept the additional offer of Altec to install heavier springs at no cost to
the City.

foregoing Resolution was introduced at a regular meeting of the City Council on the 18th day of
OCTOBER 1999, and was adopted thereafter by the following vote:
