ROLL CALL Present: Commissioners Deal, Ellis, Jacobs, Kelly, Key, Mink and Galligan Absent: None Staff Present: City Planner; Margaret Monroe, City Attorney; Jerry Coleman, City Engineer; Frank Erbacher, Fire Marshal; Keith Marshall MINUTES - Page 4, paragraph 4, line 9, of the minutes of the January 23, 1995 meeting were amended to read: small variances no one will have a place to wer- park; as a successful restaurant there will be more than 37 customers", the minutes were then approved as amended. AGENDA - The order of the agenda was adjusted, items #5 (50 California) and #6 (405 Primrose Road were reversed in an effort to hear two requests from the same applicant. The order of the agenda was then approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. SPECIAL PERMIT, LOT COVERAGE AND PARKING VARIANCES AT 100 BLOOMFIELD ROAD, ZONED R-1 (RUDY & KATHARINA FROEHLICH, PROPERTY OWNERS AND RAY VIOTTI, JR.. APPLICANT) Requests: are this property and the property next door, on Bayswater, owned by the same person, there is a stairway between them; identify the reasons why the curb cut should not be closed, explain why variance necessary. Item set for public Item set for hearing February 27, 1995. 2. PARKING VARIANCES AT 2011 DAVIS DRIVE, ZONED R-1 (MR. & MRS. STEVEN WILK, PROPERTY OWNERS AND KEN IBARRA, APPLICANT). Requests: item D of Ibarra response dated January 25 - would like pictures to show the referenced "other" like construction in the area; same page item A, not "every" dwelling has the same problem; clarify whether the issue is a parking variance for number of spaces since the driveway is 8'-6" long or a dimension issue; explain how dimensions of garages are made to determine parking; why was the narrow dimension allowed when the garage was built? CONFERENCE ASSOC. OF THE SEVENTH DAY ADVENTIST CHURCH, PROPERTY OWNER AND DONALD NEPTUNE. APPLICANT. Item set for public hearing February 27, 1995. 4. SPECIAL PERMIT AND PARKING VARIANCE AT 1108,1110-1120 BURLINGAME AVENUE, ZONED C-1 SUBAREA A (LORENZ KAO & LOUISA ZEE KAO, PROPERTY OWNERS AND APPLICANTS). Requests: need structural engineer to explain cost effectiveness of this alternative over others studied; would like engineering study regarding the system and how it will tie to the lateral support of the existing building; clarify location of uses within building; is the site one lot or two; any approval would be with plans specifically date stamped and those plans need to be very specific, any change would require resubmittal and an independent review and findings. Item set for public hearing February 27, 1995, if submittals are complete. ITEMS FOR ACTION 6. SPECIAL PERMIT FOR A FINANCIAL INSTITUTION AT 405 PRIMROSE ROAD, ZONED C- 1, SUBAREA B1 (BERTRAM HORN AND FAMILY, REPRESENTED BY TERRY HORN, PROPERTY OWNER AND MARY BATES, APPLICANT). Reference staff report, 2/13/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. If approved four conditions were suggested. A letter from Alan Horn, 409 Primrose Road, in opposition to the application was read into the record. Chm. Galligan opened the public hearing. Terry Horn explained the location of the office in the building noting that without windows it was unlikely to be used more heavily than proposed. He noted the low intensity of the use and the small impact on parking and activity in the area. He expressed agreement with the conditions. There were no other comments and the public hearing was closed. C. Jacobs noted this project that will not be detrimental to the neighborhood, is a small space and meets the office parking requirements in Subarea A. She then moved to grant approval of the this application, by resolution, with the following conditions; 1) that the investment management business shall be limited to 216 SF in Suite 212, at 405 Primrose Road as shown on the plans submitted to the Planing Department and date stamped December 20, 1994 Floor Plan (8'/z" X 11"); 2) that the investment management business shall be open 9:00 A.M. to 4:00 P.M. Monday through Friday with a maximum of two employees including the proprietor, on site, at any one time; 3) that any changes in operation, floor area, use, or number of employees, which exceeds the maximums as stated in these conditions shall require an amendment to this use permit; and 4) that the use and any improvements for the use shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. MASTER SIGN PROGRAM AND SIGN EXCEPTION AT 50 CALIFORNIA DRIVE, ZONED C-2 (PUTNAM LEASING, INC., PROPERTY OWNER AND ROBERT ROGERS, BARBER SIGN COMPANY, APPLICANT). Reference staff report, 2/13/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. If approved six conditions were suggested. Chm. Galligan opened the public hearing. Robert Rogers of Barber Sign Company in Vallejo and Joe Putnam, owner of the property, were present to answer questions. There was discussion of the corporate preferences related to the proportions of signs, corporate logo, trademarks, registered copyrights and the reasons that the dealer cannot alter the signs which are made in the East by the corporation. The commission discussed sign amortization and the possibility of changing some of the rules. The applicant indicated they would comply with the conditions and any sign not specified on the plans will be removed. There were no other comments and the public hearing was closed. C. Jacobs noted this project does not constitute a grant of special privilege and is in a unique area. She then moved approval of the this application with the following conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped January 31, 1995 Sheet 1, Plan, Elevations and Photo; 2) that the conditions of the Chief Building Inspectors' December 5, 1994 memo (pole signs B1 & B2, D1 & D2 will require engineering and wind/seismic load calculations for a building permit) and the City Engineers' December 5, 1994 memo (pole signs shall be placed within the property at least eight feet from all driveway openings) shall be met; 3) that all the existing signs along California Drive shall be removed except the 'Putnam" roof sign (3' X 2-' per side for a total sign area of 120 SF); 4) that all existing secondary frontage signs (rear frontage - railroad tracks, and side frontages - adjacent to 98 California Drive and 2 California Drive) shall be removed except the existing 'Putnam Toyota Burlingame' wall sign at the rear of the building along the railroad tracks and the wooden sign on the south fence noting "used cars" shall remain; 5) that all the temporary bunting signs on the lighting poles along California Drive (all bunting materials and the sings) shall be removed prior to issuance of building permit for installing the new signs; and 6) that the project shall meet Uniform Building and Uniform Fire Codes as amende d by the City of Burlingame. Motions was seconded by C. Kelly and approved on a 5-2 (C. Ellis and Mink dissenting) roll call vote. Appeal procedures were advised. 7. SIGN EXCEPTION AT 3 CALIFORNIA DRIVE, ZONED C-2, (JOE PUTNAM JR., PROPERTY OWNER AND ROBERT ROGERS. BARBER SIGN COMPANY. APPLICANT. Reference staff report, 2/13/95, with attachments. Robert Rogers, Barber Sign Company, Vallejo explained this was the addition of one sign and removal of one 80 SF double faced, 16' pole sign in order to add another brand to the site. The manufacturer requires the new sign, he noted his interpretation of the signs, the calculation of square footage and expressed a desire to create uniformity. There were no other comments and the public hearing was closed. C. Mink moved approval of the application subject to the following conditions; 1) that the signs shall be installed as shown on the plans submitted to the Planning Department and date stamped January 31, 1995 except that Sign A shall be built with a total of 72 SF (35.7 SF per side) of signage and as described on the Sign permit forms dated December 19, 1994 and sign 6 shall be removed; 2) that all illegal bunting signs shall be removed from the light poles along California Drive (all bunting materials and the signs) prior to issuance of a building permit; and 3) that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City. Motions was seconded by C. Deal, and was approved on a 7-0 voice vote. Appeal procedures were advised. 8. MASTER SIGN PROGRAM AND SIGN EXCEPTION AT 1017-1025 ROLLINS ROAD, ZONED C-2 (ALFRED MOLAKIDIS. PROPERTY OWNER AND ALLEN DAVID. APPLICANT). Reference staff report, 2/13195, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. If approved four conditions were suggested. Chin. Galligan opened the public hearing. Allen David, Bay Area Collision Center, was present to answer the commissioners' questions and explain his need for this signage. He is in agreement with the addition of the condition stating the sign shall not be illuminated. There were no other comments and the public hearing was closed. C. Deal moved approval, by resolution, of this master sign permit and sign exception for the number of signs, area and height finding that this does not grant special privilege, with the following amended conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped January 9, 1995 site plans and sign elevations, that the sign shall have 8' of clearance below the bottom of the sign to the ground below and shall not be illuminated in any manner; 2) that the property owner or tenant shall apply for a sign exception for any additional signs to be placed on these parcels prior installation of the sign; 3) that the applicant apply for permits through the Building Department for the proposed sign within 30 days of action on this application, and 4) that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City. The motion was seconded by C. Kelly and approved on a 6-1 (C. Galligan dissenting) roll call vote. Appeal procedures were advised.
