CALL TO ORDER A regular meeting of the Planning Commission, City of Burlingame was called to order by Chairman Galligan on March 13, 1995 at 7:30 P.M. ROLL CALL Present: Commissioners Deal, Ellis, Jacobs, Kelly, Key, Mink and Galligan Absent: None Staff Present: City Planner; Margaret Monroe, City Attorney; Jerry Coleman, City Engineer; Frank Erbacher, Fire Captain; Steve Langridge MINUTES - The minutes of the February 27, 1995 were corrected as follows; Page 3, Item #3, 1232 Cabrillo Avenue "Motion was seconded by Commissioner Jacobs and the motion to denyW was approved uphd by a 6-0-1 (Commissioner Kelly absent) voice vote; and Page 6, Item #5, 1108, 1110-1120 Burlingame Avenue; "Motion was seconded by C. Deal and passed on a-5 4-2 (C. Jacobs and Mink dissenting) - 1 (C. Kelly absent) roll call vote. The minutes were then approved. AGENDA - The order of the agenda was approved. FROM THE FLOOR There were no public comments. STUDY ITEMS 1. SPECIAL PERMIT AND PARKING VARIANCES AT 1219 BROADWAY AVENUE, ZONED C-1, BROADWAY COMMERCIAL DISTRICT (RONALD C. ROUSSEY, PROPERTY OWNERS AND DAVID ARMANINO, APPLICANT). Requests: Are 2 employees in 2 years a realistic projection and is the food self serve so waiters are not necessary; show trash enclosure on site plan; if this is 49 % lot coverage, where is the remaining 51 % and is it available for staff parking or how will it be used, is the outdoor seating area included in the 44 occupancy number; Item set for public hearing March 27, 1995. se Burlingame Planning Commission Minutes March 13, 1995 2. SPECIAL PERMIT AND PARKING VARIANCE AT 1826 ROLLINS ROAD, ZONED M-1 (P. J. BRALLIER, PROPERTY OWNERS AND SCHOOL APPAREL, INC., APPLICANT). Requests: What is difference between career apparel and school uniforms; are transactions at this site taxable - will city receive tax benefit; are any buildings on Rollins or in the M-1 zone total office use; why was ordinance originally passed allowing only 20 % office, existing parallel parking spaces only 20' long, how will you park in them; application notes an increase in landscaping, how much will be provided, where will it be located, what planting ig, anticipated, quantify area; Item set for public hearing March 27, 1995, if submittals are complete. 3. SPECIAL PERMIT AND PARKING VARIANCE AT 1688 GILBRETH ROAD, ZONED O -M (LEASEBACK INVESTMENTS, INC., PROPERTY OWNERS AND JOHN KOLBISEN, LE PETITE BALEEN, APPLICANT). Requests: What was previous use, was it retail; could parking be allowed in existing storage area at rear of site; will there be swimming competitions or shows; staff determined parking requirements for this use at 28, applicants letter indicates a different number, why; applicant should document overlap from class to class, can this be reduced for parking; staff to investigate parking formula at other swimming pool uses including local health clubs, i.e. Marlin's in Belmont; If there are showers and lockers why do children leave wet, if they change how will this affect overlap; Item set for public hearing March 27, 1995. 4. ANTENNA EXCEPTION FOR A TOWER AT 1730 GILBRETH ROAD, ZONED O -M (MR. AND MRS. STEVE BARKOFF, PROPERTY OWNER AND DALE MEYER. APPLICANT). Requests: what color will the tower and antenna be; do they change only the top antenna for testing; do we have a code definition of tower; what will be visible from north and south bound 101 and from Gilbreth - more concerned north than south on Gilbreth take pictures; radio frequencies, i.e., overlapping with San Francisco Airport frequencies; what happens when planes rerouted for foul weather; does this adhere to FAA regulations; what wattage will be used and what is the effective range; are there microwave transmissions; will it affect TV reception or transmissions from other antenna in the area; why not test within the building (inside vs. outside) and is the broadcasting within the perimeter of the building or to other locations; sending antenna and catching antenna, why so tall, what are the physics of the antenna; would the applicant consider a sunset clause in the approval (5 or 10 year) to their lease agreement; Item set for public hearing March 27, 1995, pending the receipt and review of the requested information. -2- Burlingame Planning Commission Minutes March 13, 1995 ITEMS FOR ACTION 5. SPECIAL PERMIT AND PARKING VARIANCE AT 1201 BROADWAY, ZONED C-1, BROADWAY COMMERCIAL AREA (RONALD SANTERO. APPLICANTS AND MR. AND MRS. FARKAS, PROPERTY OWNERS). Reference staff report, 3/13/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Seven conditions were suggested for consideration. Chm. Galligan opened the public hearing. Mike Nilmeyer, 128 Pepper, the architect representing the owner/applicant answered the commission's questions. Seating and employee numbers remain the same. The new restaurant area will be a larger portion of the building to accommodate ADA regulations (disabled accessible restrooms, wider aisles between tables, entrance ramps). The plans submitted show interior as it is now with all windows covered, the actual rebuild will depend on the insurance replacement value. the remaining retail space shown will be let to another tenant, not a part of the restaurant. There were no other comments and the public hearing was closed. C. Deal moved approval of special permit to expand floor area and parking variance, by resolution, with documentation and including testimony addressing that this increase is the result of meeting new code requirements and the restaurant will be the same with the same number of customers and employees therefore no greater parking impact their findings in the staff report were incorporated by reference, and the following conditions were also included; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 17, 1995, Site Plan, Floor Plans, and Elevations; 2) that the conditions of the City Engineers' February 21, 1995 memo, and the Chief Building Inspectors' February 13, 1995 memo, and the Fire Marshals' February 13, 1995 memo shall be met; 3) that the business shall be open 11:00 A.M. to 12:00 P.M. seven days a week, Monday through Sunday, with a maximum of five employees on site at any one time; 4) that an enclosed and ventilated garbage storage area shall be identified at the rear of the site and that garbage cans shall be kept in the storage area until such time garbage is picked up and upon pick-up cans shall immediately be returned to the storage area; 5) that the project shall provide adequate filtering and venting to avoid dissemination of odors on neighboring properties and a grease trap(s) shall be provided as approved by the City Engineer; 6) that the office areas shall not be separately leased; and 7) that all the improvements for the expanded eating establishment shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Ellis approved by a 7-0 voice vote. Appeal procedures were advised. -3- Burlingame Planning Commission Minutes PLANNER REPORTS March 13, 1995 - CITY PLANNER REVIEWED THE CITY COUNCIL REGULAR MEETING OF MARCH 6. 1995 - ONE YEAR EXTENSION OF HILLSIDE AREA CONSTRUCTION PERMIT AT 2509 HILLSIDE DRIVE, ZONED R-1 (MORDECHAI AND LINDA LICHENSTEIN, PROPERTY OWNERS) Commission reviewed the staff report, with attachments. CP Monroe discussed the request, reviewed criteria. Three conditions were suggested. C. Jacobs moved approval of the 1 year extension of the Hillside Area Construction Permit. The motion was seconded by C. Key and approved on an 7-0 voice vote. - ZONING CORRECTIONS AND MODIFICATIONS - FURTHER DISCUSSION Commission discussed staff proposals for corrections and minor changes to the zoning and sign ordinance and identified five issues for discussion at their March 27, 1995 meeting.
