ROLL CALL Present: Commissioners Deal, Ellis, Jacobs, Kelly, Key, Mink and Galligan Absent: None Staff Present: Margaret Monroe, City Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Steve I,,angridge; Fire Captain MINUTES - The minutes of the March 27, 1995 meeting were approved as mailed. AGENDA - The order of the agenda was approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY There were no study items. ITEMS FOR ACTION 1. SIDE SETBACK VARIANCE FOR A SECOND STORY ADDITION AT 1355 DE SOTO AVENUE, ZONED R-1, (MARK A. & LISA L. ROTHROCK, PROPERTY OWNERS AND KEN IBARRA, APPLICANT). Reference staff report, 4/10/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Two conditions were suggested for consideration. Chm. Galligan opened the public hearing. Ken Ibarra, 600 El Camino, San Bruno, discussed the background of the application. He explained this would be less of an impact than a full second story since the house has a flat roof. The new house will have a pitched roof. Dan Dowrick, 1353 De Soto Avenue expressed concern about sewer capacity problems in the area -1- C Burlingame Planning Commission Minutes April 10, 1995 and did not want more water added. CE verified the sewer lateral test will have to be made and the connection replaced if minimum standards are not met. He also noted improvements were scheduled for the area and that Mr. Dowrick should call Don Chang or himself directly to answer the timing questions. There were no other comments and the public hearing was closed. C. Deal noted this is a minor request for a small addition to the side of the structure for a stairwell and there would be no impact to the neighborhood, he then made a motion to approve this side setback variance for 3' for a length of 8' and extension of the nonconforming side wall toward the rear, for a second story addition with the following conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department date stamped March 9, 1995, sheets A.1, A.2 and A.3; and 2) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Kelly and passed on a 7-0 voice vote. Appeal procedures were advised. 2. SPECIAL PERMIT FOR EDUCATIONAL THERAPY SESSIONS AT 1229 BURLINGAME AVENUE, ZONED C-1, SUBAREA A (BRUCE C. KIRKBRIDE ET AL. PROPERTY OWNER AND DARLENE ROSE DEMARIA, APPLICANT). Reference staff report, 4/10/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration. CP noted the applicant asked that condition #4 be amended to read; "that no more than two students shall be taught during a single session and no more than one student shall be tested in a single session". Chm. Galligan opened the public hearing. Darlene DeMaria, 101 Lorton Avenue #5, the applicant was present to answer questions. Commission asked that a map showing the meter time designations for the nearby public parking lots be made available to the applicant. There were no other comments and the public hearing was closed. C. Jacobs noted this application will not have a negative impact on the area for the reasons stated in the staff report and made a motion to approve the special permit application with the following amended conditions; 1) that the 165± in Suite #18 shall be used as set forth in the documents dated March 12, 1995 and any future tenant improvement shall be reviewed by the Planning Department prior to applying for a Building permit; 2) that the days and hours of operation shall not exceed Monday through Friday 8:00 A.M. to 7:00 P.M. with testing in the mornings; 3) that this business shall be a sole proprietor operation and any addition of employees/partners operating from this site shall require an amendment to this special permit; 4) that no more than two students shall be taught during a single session and no more than one student shall be tested in a single session, a 15 minute break shall be provided between sessions; and 5) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. -2- Burlingame Planning Commission Minutes April 10, 1995 Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. 3. SPECIAL PERMIT FOR AUTO REPAIR AT 1385 SUITE B, MARSTEN ROAD, ZONED M-1 (FERRUCCIO CORUCCINI ET AL, PROPERTY OWNER AND RUDOLF SINDELAR, APPLICANT). Reference staff report, 4/10/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Six conditions were suggested for consideration. Chm. Galligan opened the public hearing. Commission voiced concern about the ingress/egress to the indoor parking area given the location and width of the roll up door and asked that the conditions be amended to stipulate that the parking space be relocated to a location approved by the City Engineer. Rudolf Sindelar, 1006 W. Fifth, San Mateo, the applicant clarified that this is a small operation, they, himself included, will work on only 2 - 4 cars each day. Commission discussed the feasibility of 72 hour on -street parking limits and the reality that a Planning Commission condition is not enforceable by the Burlingame Police Department. There were no other comments and the public hearing was closed. In discussing the motion the commissioners noted that on -street parking in this area is very restricted and the possibility of this business storing cars to be repaired on the street would increase the problem; it was noted the excessive parking has been a problem on this street a long time and is caused by other businesses in the area; this is a low impact operation, 2 - 6 customers a day, good choice for this impacted street. C. Deal noted moved approval of this application, by resolution, with the following amended and added conditions: 1) that the auto repair shop shall be built as shown on the plans submitted to the Planning Department and date stamped March 30, 1995, Site Plan (11" X 17") and March 15, 1995 Floor Plan (11" X 17") with the addition of one parking stall (10' X 20') designated and marked on the inside of this tenant space at a location approved by the City Engineer; 2) that the conditions of the Chief Building Inspectors' March 20, 1995 memo (remove stairway at restroom, and waiting room exit shall be independent of the repair area) and the Fire Marshals' March 13 and March 20, 1995 memos (auto repair work restricted to tuneups' and minor repairs with no auto body work or pulling of engines allowed and a separate exit from the waiting room, other than to the repair area shall be provided) shall be met; 3) that the business shall be open 8:00 A.M. to 5:30 P.M. Monday through Friday with a maximum of three employees including the proprietor, on site, at any one time; 4) that one full size parking space inside the building and a part of this tenant's space shall be designated and accessible at all times for customer parking and no repair shall be done on the public street or on adjacent public or private property; 5) that a building permit shall not be issued until the plans are corrected and approved by the City Engineer; 6) that a sign shall be placed at the entrance to the building indicating that additional customer parking is available inside, this sign shall be 2' X 3' directional sign and not be counted in the on-site signage; and 7) that the use and any -3- Burlingame Planning Commission Minutes April 10, 1995 improvements for the use shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Key and passed on a 5-2 (Cms. Kelly and Galligan dissenting) roll call vote. Appeal procedures were advised. VIII. PLANNER REPORTS City Planner reviewed the City Council regular meeting of April 3, 1995 Zoning Corrections and Clarifications - Further Discussion Commission discussed Items #2 and #3 of the Commissioners proposals for changes to the zoning and sign ordinance.
