ROLL CALL Present: Commissioners Ellis, Jacobs, Kelly, Key, Mink and Galligan Absent: Commissioner Deal Staff Present: Margaret Monroe, City Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Keith Marshall; Fire Marshal MINUTES - The minutes of the April 10, 1995 meeting were amended to add details to Item #3, 1385 Suite B, Marsten Road as follows: "The Commission discussed whether a condition should be added prohibiting the repair of cars while parked in the public right-of-way/on street. Commission decided that parking in the area was such a problem that such a condition was not warranted at this time. " The minutes were then approved. AGENDA - The order of the agenda was approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. SPECIAL PERMIT, SIDE SETBACK VARIANCE, AND PARKING VARIANCE FOR A DETACHED GARAGE AND FIRST AND SECOND FLOOR ADDITION AT 1421 BERNAL AVENUE, ZONED R-1, ( BOB AND CANDACE SAVOIE, PROPERTY OWNERS AND APPLICANT). Requests: eaves should be shown on drawing; applicant needs to clarify what the unnecessary hardships are on the property to justify the variances; if garage were moved back to the rear 35% of the lot, the special permit and 2 variances would not be necessary, why is this not considered or discussed; could eaves be trimmed at that corner, thus eliminating need for a special permit; Provided all requested information is received this item is set for public hearing May 8, 1995. -1- Burlingame Planning Commission Minutes ITEMS FOR ACTION April 24, 1995 2. SPECIAL PERMIT FOR TAKE OUT FOOD AT 1241 BROADWAY, ZONED C-1, BROADWAY COMMERCIAL AREA (PATRICIA A. BRITTON, PROPERTY OWNER AND NOURIJAN "JOHN" KEVRANIAN. APPLICANT.) Reference staff report, 4/24/95, with attachments. CP Monroe discussed the request, reviewed criteria for findings, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. Chm. Galligan opened the public hearing. The applicant, John Kevranian, 2530 Sherwood Drive, San Bruno, was present to answer questions. His lease agreement limits his sales to candy and ice cream products, there will not be a deli. There is no manufacturing on-site. His does not intend to sell nuts since they are perishable and have an infestation problem. There were no other comments and the public hearing was closed. C. Jacobs moved approval of the special permit for take-out food application with the additional conditions limiting take-out to ice cream and that no on-site manufacturing of food products and with the conditions in the staff report; 1) that the ice cream freezer shall be installed as shown on the floor Plan submitted to the Planning Department and date stamped March 23, 1995; 2) that the applicant shall provide and maintain a trash receptacle at the front door of the store (as stated in the City Engineers' March 24, 1995 memo) and that the applicant shall collect at least once each day or more frequently all take-out debris in front of the store and within 50' east and west, of 1241 Broadway Avenue; 3) that take-out sales shall be limited to ice cream products, and no food products shall be manufactured on site; and 4) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 6-0-1 (C. Deal absent) voice vote. Appeal procedures were advised. 3. ANTENNA EXCEPTION AT 1730 GILBRETH ROAD, ZONED 0-M (MR. AND MRS. STEVE BARKOFF, PROPERTY OWNERS AND DALE MEYER, APPLICANT). Reference staff report, 4/24/95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Six conditions were suggested for consideration. -2- Burlingame Planning Commission Minutes April 24, 1995 Chm. Galligan opened the public hearing. Dale Meyer, 840 Hinckley Road, #123, the applicant, was present to answer questions. He explained the original proposal had a fixed tower on the roof and this application has a tower that will be raised only when antenna are being tested. Commission asked the applicant what number of testing days would be appropriate on the high end of average. 10 days a month would be the greatest number of days the antenna would be in use; some months when the weather is bad no antennas will be tested. Testing time for each antenna will be ± 3 hours. Sven Kjaersgaard, the president of Swedcom Corporation, was present to answer technical questions. There were no other comments and the public hearing was closed. C. Mink noted the application meets the criteria required for an antenna exception he then moved approval, by resolution, with the following amended and added conditions: 1) that the wooden platform, tower and antenna, as built, shall be consistent with the plans submitted to the Planning Department and date stamped April 14, 1995, sheets A-1 through A-6, and shall conform to all FAA requirements; 2) that the installation of the stairwell, platforms and tower requires separate application to the Building Department, with submittal of plans as required for a building permit and that the location of the two stairwell enclosures on the roof shall not change; 3) that the height of the platform, tower and antenna (when employed) shall not exceed 81.5' from grade, nor rise more than 54' above the roof deck, and that the platforms and tower shall be painted with a light color nonreflective paint as approved by the Planning Department unless FAA has other safety requirements which affect the color at the tower structure and that the nonreflective paint surface shall be permanently maintained by the applicant; 4) that the maximum number of testing days each month shall be (10) ten; 5) that the platforms, tower and antenna shall be removed at the time this tenant (Swedcom) vacates this premise and if the new tenant wishes to install any antenna they shall comply with all the code requirements in effect at that time; 6) that any modification to the antenna testing facility or its location shall require an amendment to this use permit; and 7) that as installed, the stairwell, platform and antenna tower shall meet all the requirements of the Uniform Building and Uniform Fire Codes, including connections from the antenna inside the building to any equipment. Motion was seconded by C. Ellis and passed on a 6-0-1 (C. Deal absent) voice vote. Appeal procedures were advised. VIII. PLANNER REPORTS - City Planner reviewed the City Council regular meeting of April 17, 1995 -3- Burlingame Planning Commission Minutes April 24, 1995 - Zoning Corrections and Clarifications - Further Discussion Commission continued discussion of Items #4 and #5, of the Commissioners proposals for changes to the zoning and sign ordinance, to the May 8, 1995 Planning Commission Meeting and added Items 7, Proposal for Minor Modification of small office lease and #8, clarification of the covered tandem parking prohibition and the possibility of 2 car covered off street requirements for new residential construction.
