CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order by Chairman
Jacobs on Monday, June 12, 1995 at 7:30 P.M.
ROLL CALL
Present: Commissioners Deal, Ellis, Galligan, Jacobs and Mink
Absent: Commissioner Kelly and Key
Staff Present: Margaret Monroe, City Planner; Frank Erbacher, City Engineer; Keith

MINUTES The minutes of the May 8, meeting were amended to read: "Present:
Commissioners Deal, Ellis, Galligan, Gfahafn, Jacobs, Kelly, Key and Mink,
and the minutes of the May 22, 1995 meeting were amended to read: "Present:
Commissioners Deal, Ellis, Galligan, Greham, Jacobs, Key and Mink. The
May 22, 1995 minutes were then approved.
AGENDA The order of the agenda was modified to withdraw Item #7, 778 Burlway
Road, and to continue Item 9, 620 Airport to the July 24, 1995 Planning
Commission meeting. The order of the agenda was then approved.
FROM THE FLOOR There were no public comments.
STUDY ITEMS
1. TWO SPECIAL PERMITS AND LOT COVERAGE VARIANCE FOR A DETACHED GARAGE
AT 18 ARUNDEL ROAD, ZONED R-1 (THOMAS CONDON, PROPERTY OWNER AND
APPLICANT) .
Requests: C. Galligan represented Mr. Sofas and his estate so will abstain from any discussion or vote
on this item. Item set for June 26, 1995.
2. SPECIAL PERMIT FOR FREIGHT FORWARDING AT 1336 MARSTEN ROAD, ZONED M-1
(SCHROEDER -WALCH PARTNERSHIP, PROPERTY OWNER AND PILOT AIR FREIGHT,
APPLICANT).
Requests: how many trucks come to this site during the day, in the evening, on week ends. Item set for
Public Hearing June 26, 1995.

The applicants were advised that 5 of 7 Commission members were present. The rules of procedure for
the Commission require a quorum (4) affirmative votes to pass a motion on action items. The Chair
asked if any of tonight's applicants would like to delay their action until a full commission is seated. Item
9, 620 Airport asked to be continued to the July 24, 1995 Planning Commission meeting.
3. SPECIAL PERMIT, SIDE AND REAR SETBACK VARIANCES, AND PARKING VARIANCE
AT 309 BAYSWATER AVENUE, ZONED R-1 (JEFFREY AND BARBARA MOORE,
PROPERTY OWNERS AND DEBRA KAUFMAN, APPLICANT). (CONTINUED TO JUNE
26, 1995 PLANNING COMMISSION MEETING).
Reference staff report, 6/12/95, with attachments. CP Monroe discussed the request, reviewed criteria
for findings, Planning Department comments, and study meeting questions. Two conditions were
suggested for consideration.
C. Jacobs opened the public hearing. Debra Kaufman, 924 Beach Park Road, Foster City and Jeff
Moore, 309 Bayswater Avenue, discussed the application. They suggested increasing the width of the
carport 6" to improve maneuverability noting that this would increase lot coverage. It was pointed out
that the deck may be under 30" so would not count. They did not know exactly how high the deck was,
but guessed it was very close to 30". The CP noted a lot coverage variance had not been noticed so
could not be acted upon at this meeting. The CE noted that the distance between the post and wall inside
the carport was less than 9'-6" so, whether or not it was moved closer to property line the structure
would need to be made 6" wider and lot coverage would be affected. The alternative as far as lot
coverage was concerned was to remove a part of the building. The applicant's designer noted
maneuvering into the carport and garage was tight but felt it could be done without hitting the house.
The circumstances under which a survey of the side property line would be required was discussed. CE
asked for clarification regarding the one hour wall, its location and possible movement of the garage
toward the property line. There were no other comments and the public hearing was closed.
C. Galligan noted that there are unresolved issues regarding lot coverage. He moved to continue this
application to the June 26, 1995 meeting if the required information has been submitted so that the
planning office can prepare a staff report.
Motion was seconded by C. Mink, and approved on a 5-0-2 (Cers. Kelly and Key absent) voice vote.
Appeal procedures were advised.

4. SPECIAL PERMIT AMENDMENT AT 1208 DONNELLY AVENUE, ZONED C-2 SUBAREA
B1 (BRUCE HORN, PROPERTY OWNER'S REPRESENTATIVE AND RANDALL C. DELUE,
APPLICANT).
Reference staff report, 6/12/95, with attachments. CP Monroe discussed the request, reviewed criteria
for findings, Planning Department comments, and study meeting questions. Two letters were read into
the record, one in support and one in opposition. Concerns about noise levels were mentioned in both.
Ten conditions were suggested for consideration.
C. Jacobs opened the public hearing. Randall DeLue, 817 Fairfield Road, described this permit
amendment application, the applicant stated there were 750 members when he purchased this business
approximately two years ago, there are now 950 members. The membership has been pretty stable at
950 but he would like to the have the ability to expand to 1,100 members. The capacity of the club is
about 1,500 members. Mr. DeLue also discussed the possibility of leasing the facility in the afternoon
to a ballet school. He commented that he shares the exit corridor to Lorton with Il Fornaio. Recently
they have stored some things in the corridor. He has asked to have them remove them, but has some
problem getting their attention. He does not want to be responsible for their violation of his conditions.
He noted he was aware of the conditions when he bought the business; but then it grew quickly and he
let it happen. The people who came at noon can't come any other time; 12 is too small to cover the cost
of a class since instructors are paid based on class size; if he loses instructors it could hurt his reputation
as an aerobics club. He noted he did not expect much more growth; he expected a maximum of 1,100.
The commission noted that there was no on site parking; key is not the total number of members but the
number on site at one time, not have that information; concern was expressed about the applicant
understanding the significance of the conditions and the commission's original concern about the parking
impact of this use at this location. The commissioners then inquired about the noise problem. The
applicant noted that there is no relationship between the class size and the noise problem. He understands
the noise problem but has difficulty getting cooperation from his instructors. He did not understand that
noise was a concern of the commission. Allan Horn, 1325 Paloma spoke in favor of the application and
Eugene Cazoli, 309 Lorton spoke in opposition to the application citing the noise problems of being
awakened very early in the morning, of calling and asking for it to be turned down and being ignored;
the failure to abide by conditions now and concern about the future actions. There were no other
comments and the public hearing was closed.
C. Mink noted he cannot find justification to increase the class size, to eliminate the intervals between
classes or to change the hours of operation, these restrictions were placed for specific reasons which have
not changed. The applicant's request has the potential to increase the problems without offering any
solutions. There is compelling evidence that with the present operation this site is overused. He then
moved to deny the application.

Motion was seconded by C. Galligan and denied on a 5-0-2 (Cers. Kelly and Key absent) voice vote.
Appeal procedures were advised.
Commissioners asked Mr. DeLue why he had such a cavalier attitude about the existing conditions and
what would cause him to adhere to new conditions. There was further discussion about the noise level
and possible enforcement of the General Plan dBA requirements and other forms of relief such as
reducing the ambient noise level by installing new windows or internal air conditioning. Parking was a
problem in 1992 when approved amendment. That is why 15 minutes were required between classes and
class size was limited to 12 during peak hour, now there is a request to increase class size in spite of a
recognized parking problem, consideration needs to be given to the relationship of this business to others
in the area; most compelling evidence not to change lunch time class size is data showing almost everyone
in those classes drives to them; we really need some solution to the noise problem like air conditioning
so the doors do not have to be opened. The commission challenged the applicant to come back with
solutions to the problems.
5. SPECIAL PERMIT FOR REAL ESTATE OFFICES AT 1412-1416 CHAPIN AVENUE, ZONED
C-1 SUBAREA B (MO BIANCHI, PROPERTY OWNER AND STEPHENS REAL ESTATE,
APPLICANT).

for findings, Planning Department comments, and study meeting questions. Six conditions were
suggested for consideration.
C. Jacobs opened the public hearing. Steve Patrick, 831 Midglen Way, Woodside, the applicant,
presented a rendering of the project and explained the process this project has been through. Allan Horn,
1325 Paloma, Adam Kotowski, 1450 Bellevue and Steve Cohen, 1408 Chapin spoke in favor of the
application. There were no other comments and the public hearing was closed.
C. Deal noted this application is similar to the original application submitted 5 years ago, and there is
adequate parking. He then moved to approve the negative declaration for the project and special permit
application for a Real Estate Office, by resolution with an amended condition as follows; 1) that the 5154
SF, first floor office area shall be built as shown on the plans submitted to the Planning Department and
dated May 30, 1995, sheets 1, 2, 3 & L1, and shall be used for a real estate office which shall have a
maximum of 36 full-time and part-time agents and 3 full-time staff; 2) that the real estate use shall not
be extended to the second floor (4,490 SF) of this building nor shall a separate real estate business be
located on the second floor of this building without amendment to this use permit nor shall the number
of full-time and part-time agents in this real estate business be increased without an amendment to this
use permit; 3) that this real estate business shall operate seven days a week from 9:00 A.M. to 6:00 P.M.
and that the on-site parking shall be retained for the employees on site and their clients/customers without
any charge to users or businesses; and shall never be sublet to any other business; 4) that the sign(s)
proposed for this site shall require a separate sign permit from the Planning Department prior to
installation; 5) that the lot combination map shall be filed and approved prior to the issuance of a building

permit for this project; and 6) that all construction shall comply with the Uniform Building and Uniform
Fire Codes as amended by the City of Burlingame.
Motion was seconded by C. Ellis, and approved on a 5-0-2 (Cern. Kelly and Key absent) voice vote.
Appeal procedures were advised.
6. TENTATIVE AND FINAL MAP FOR REAL ESTATE OFFICES AT 1412-1416 CHAPIN
AVENUE, ZONED C-1 SUBAREA B (TITO BIANCHI, PROPERTY OWNER AND STEPHENS
REAL ESTATE, APPLICANT).
Reference staff report, 6/12/95, with attachments. CE Erbacher discussed the request, reviewed criteria
for findings, Public Works comments, and study meeting questions.
Comments were received from the public along with the special permit application (Item #5).
C. Galligan recommended approval of this application to City Council, subject to the conditions in the
staff report.
Motion was seconded by C. Mink and approved on a 5-0-2 (Cers. Kelly and Key absent) voice vote.
Appeal procedures were advised.
7. TENTATIVE AND FINAL MAP FOR LOT COMBINATION AT 778 BURLWAY ROAD,
ZONED C-4 (DKBERT ASSOC., PROPERTY OWNER AND ROBERT C. HUTTON,
APPLICANT) (CONTINUED FROM MAY 8, 1995 MEETING).
This item has been withdrawn from the agenda of this meeting and will be resubmitted in a different
format at a later date.
8. FINAL MAP FOR 1128 CHULA VISTA AVENUE, ZONED R-3 (BOREL/POPLAR
DEVELOPMENTS, PROPERTY OWNER AND APPLICANT). (CONTINUED TO JUNE 26,
1995 PLANNING COMMISSION MEETING).
9. SPECIAL PERMITS FOR NEW RESTAURANTS AT 620 AIRPORT BOULEVARD, ZONED C-4

10. SPECIAL PERMIT AMENDMENT AT 615 AIRPORT BOULEVARD, ZONED C-4 (JONATHAN
WU, APPLICANT REPRESENTING ALL PROPERTY OWNERS). (CONTINUED TO JUNE
26. 1995 PLANNING COMMISSION MEETING).
Reference staff report, 6/12/95, with attachments. CP Monroe discussed the request, reviewed criteria
for findings, Planning Department comments, and study meeting questions. A letter from Jonathan Wu
and Chris Robinson listing the required work completed and the remaining work to be done was submitted
to the commission. Fifteen conditions were suggested for consideration.
C. Jacobs opened the public hearing. Jonathan Wu, 518 Spring Street, Sausalito and Chris Robinson,
Moss Beach, the applicants, explained the application to the commissioners. Reviewed the work
completed and discussed difficulty they have had getting the owners to commit the money for the last
phase; number of cars parked regularly on the site (was ±300 now ±800) makes staging work more
difficult; current owners wanted to find an operator who would do the final phase at their expense, no
one would; these same lights have been in place for 20 years never had an accident, thefts have been
minor; security has not been a problem; have hired professional lighting engineer, admittedly lighting
inefficient there will be dark spots in coverage but should not use professional standards even of
pedestrian safety because of nature of this lot. Applicant objected to City engineer's requirement because
of lighting bus wait until car backs out of stall, will really slow up delivery of customers; when they
proposed the improvements they did not have any experience operating a long term airport parking
facility, now they do, revisions based on new knowledge; CE pointed out existing poles are too low to
light entire site evenly, even at lower pedestrian safety requirement, a mix of low and high poles would
work better; applicant discussed problem with timing construction. Public hearing was closed.
Commission discussion: Concerned about the long time applicant has had and has not yet completed
project, we need progress; this is a temporary use; do the owners know it can be terminated at any
anniversary; only remaining issue is lighting, all other requests seem feasible; suggest continue matter
to next meeting to see if applicant can work with CE and find a way to reduce high level of contrast and
arrive at an acceptable level of overall lighting, this might be done by adding lights in dark areas. A
professional lighting engineer should be employed and make suggestions which address the issue of
reducing the contrast of very dark and very light areas across the site.
There were no other comments and the public hearing was closed.
C. Galligan moved to continue this application to the next meeting, June 26, 1995, providing the applicant
could meet with staff and provide the needed additional lighting information in time for the packet
preparation. The focus should be on adding light standards in the dark ares of the site.
Motion was seconded by C. Deal and approved on a 5-0-2 (Cers. Kelly and Key absent) voice vote.
