ROLL CALL Present: Commissioners Deal, Ellis, Galligan, Mink, Wellford and Chairman Jacobs Absent: Commissioner Key Chairman Jacobs introduced and welcomed Commissioner Wellford. Staff Present: Margaret Monroe, City Planner; Jerry Coleman, City Attorney; Donald Chang, Associate Engineer; Keith Marshall, Fire Marshal MINUTES - The minutes of the June 26, 1995 Planning Commission meeting were approved as corrected. AGENDA - The order of the agenda was approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. VARIANCE FOR FLOOR AREA RATIO AT 2609 HILLSIDE DRIVE, ZONED R-1 (DEAN NICHOLSON, PROPERTY OWNER AND APPLICANT). Requests: ask applicant to prepare a clear chronology of original FEMA and subsequent FEMA extension applications and authorizations; how are FEMA and the SBA related; who did the drawings/they are unsigned, when were they done, did he research the Burlingame codes; need timeline on preparation and amendments to plans; explain specifics of February 12, 1993 FEMA reinstatement (expired or cancelled); size of house at time of earthquake; impact on FAR, if wall opened and number of bedrooms reduced from 5 to 4; how does recent code amendment requiring two covered parking spaces for new construction affect this request, if garage reduced to one car how would it affect FAR? SPECIAL PERMITS FOR NEW RESTAURANTS AT 620 AIRPORT BOULEVARD, ZONED C-4 (JACKIE LAM - BIC DEVELOPMENT, PROPERTY OWNER AND APPLICANT) (CONTINUED FROM JUNE 12, 1995, PLANNING COMMISSION MEETING). Reference staff report 7.24.95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Seventeen conditions were suggested for consideration. Chin. Jacobs opened the public hearing. Steve Douglas, 1825 Patio Drive, San Jose, representing Burlingame Investment Company Development and Rob Little, S.J. Sung and Associates, architects for the project, exhibited renderings and slides, including a photo montage, and described the site and the conceptual landscape plans for the 5 acre site, as they were presented to San Francisco Bay Conservation and Development Commission (BCDC). They noted BCDC required that they gain control of the leasehold adjacent to their site. They spent months with the State Lands Commission and have now satisfied BCDC. They will maintain the public access. It was estimated that revenue to the city from the project would be approximately $120,000. Helaine Darlene, 3100 Margarita, spoke in opposition to the project and expressed concern about the small number of public access parking spaces. The applicant noted that this was not the only site in the area with public access parking. There were no other comments and the public hearing was closed. C. Ellis made a motion to reaffirm the Negative Declaration NP464-P, based on the initial study and comments received, there will be no significant impact on the environment. Motion was seconded by C. Mink and passed on a 6-0-1 (C. Key absent) voice vote. Appeal procedures were advised. C. Galligan noted both the City and BCDC requirements have been met by the proposed project and there has already been substantial mitigation with regard to landscaping and FAR, the developer made the point that the building is measured from end post to end post and there are substantial open spaces. Also, the addition of the bay access area defacto widens the site giving the perception of less view blockage; the 7.7 % landscaping in the parking area meets the spirit of the requirement since plants will not grow in the parking areas under the structure and about 10% of the parking area outside the footprint of the building is landscaped. He then made a motion to approve this application for special permits, by resolution, noting the previous findings and with the following conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped April 20, 1995 Sheet A-1 Parcel Map, and Sheets A-2 through A-11; 2) that the conditions of the City Engineers' August 2, 1993 and April 24, 1995 memos and the Chief Building Inspectors' April 24, 1995 memo and the Parks Directors' September 17, 1993 and May 4, 1995 memos shall be met; 3) that the restaurants shall be open 11:00 A.M. to 12:00 P.M. midnight, Monday through Sunday, with 6►A Burlingame Planning Commission Minutes July 24, 1995 a maximum of 110 employees and a total of 810 employees and customers on site at any one time; 4) that the restaurants shall provide and maintain trash receptacles at the door, and at the borders of the property adjacent to the lagoon, or at adjacent locations approved by the City Engineer and Fire Department; 5) that the mitigation measures numbered one (1) through thirteen (13) as listed on pages 7, 8, and 9 in the 'Suishaya Restaurant - Geotechnical Issues Memorandum' and date stamped August 9, 1993 shall be met; 6) that the project shall meet the standards of the Bay Area Air Quality Management District (BAAQMD) and the applicant shall submit proof of that permit and a copy of approved plans before receiving a building permit; 7) that the applicant shall prepare and implement a Traffic Systems Management program for all employees at the restaurants; 8) that the property owners shall agree to assume all responsibility for flooding or storm drainage problems and to hold the City harmless from any claims arising from such problems; 9) all construction work shall occur only between May and September, with areas subject to grading to be sprinkled continuously using reclaimed water and sprinkled in sufficient amounts to control dust during construction. Landscaping sufficient to control erosion shall be installed before the rainy season. Stockpiled debris, construction materials, soil and trucks hauling materials shall be covered. Trucks shall have their wheels washed before entering onto a public street and the driveway and the street shall be swept of debris at regular intervals as required by the City; 10) all pile driving, grading, paving and other construction shall be done during the hours set by the Uniform Building Code as amended by the City of Burlingame; 11) that lighting of the lot shall be provided at intensities required for safety of people and property and shall be installed so light is focused on the site, shielded for glare and does not extend onto adjacent properties; 12) that the property owner shall prepare a landscaping and irrigation plan for the entire site to be approved by the City Parks Director, and the property owner shall install landscaping according to the approved plan within 90 days of final inspection and prior to issuing an occupancy permit; 13) that the landscaping and irrigation system shall be maintained by the property owner including but not limited to weed control, pedestrian and vehicular clearance along the sidewalks and bike path, and replacement of plant material as necessary to maintain the landscape design; 14) that the applicant shall receive a permit from the Bay Conservation and Development Commission and shall submit proof of that permit and a copy of approved plans before receiving a building permit; 15) that the applicant shall receive a permit from the County of San Mateo for the on site well(s) and submit proof of that permit and a copy of approved plans before receiving a building permit; 16) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame; and 17) that this use permit shall be reviewed for compliance with all its conditions, including public access and landscape maintenance, in two years (June, 1997) or upon complaint. Motion was seconded by C. Mink and passed on a 5-1-1 (C. Jacobs dissenting and C. Key absent) roll call vote. SPECIAL PERMIT AND PARKING VARIANCE FOR AUTO BODY AND SALES BUSINESS AT 1384 ROLLINS ROAD, ZONED M-1 (BRIAN McBRIDE, PROPERTY OWNER AND VASKEN MANOUGIAN, APPLICANT). C. Galligan absented himself from the public hearing as he has had judicial contact with the applicant. The applicant was advised that 5 of 7 Commission members would be present for the presentation and vote on this application. The rules of procedure for the Commission require a quorum (4) affirmative votes to pass a motion on action items. The Chair asked if the applicant would like to delay his action until a full commission is seated. The applicant choose to proceed. Reference staff report, 7.24.95, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Six conditions were suggested for consideration. Chm. Jacobs opened the public hearing. Matthew Bolak, 3351 Madera, Oakland, representing the applicant, explained to the commission that sales will only be 10 to 15% of his business, the major portion of the business will be fixing cars and he felt he would not need additional parking. Commission informed the applicant that cars being repaired or waiting for repair could not park in required parking so there was little room left for auto repair. They also questioned the applicant about employee parking. He noted the employees would probably park on the street as others did in the area; commission expressed their concerns about there only being three parking spaces on site. The display space needed because of car sales cannot be used by customers or employees. The space allocated for working on a vehicle only allows one vehicle to be worked on at a time and there would then be no movement of vehicles possible. There were no other comments and the public hearing was closed. C. Deal noted the proposed use is too intense for this site and there are no findings for the variance since there is nothing unusual about this property; he then moved denial of this application. Motion was seconded by C. Mink and denial was passed on a 5-0-1-1 (C. Key absent, C. Galligan abstaining) roll call vote. Appeal procedures were advised. PLANNER REPORTS CP reviewed the City Council regular meetings of July 6 and 17, 1995. CP discussed with Planning Commission how they wished to review the changes to the M-1 district regulations proposed by the M-1 district review Committee appointed by City Council. The Commission decided to identify their areas of concern with the regulations at the next meeting so they could be sent to the committee members. The Commission will begin their review in September.
