CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was
called to order by Chairman Galligan on Monday, June 27, 1994 at 7:30
P.M.
ROLL CALL
Present: Commissioners Deal, Ellis, Galligan, Jacobs, Kelly, Key
and Mink
Absent: None

MINUTES - The minutes of the June 13, 1994 meeting were corrected
as follows:
Notation was made that the header on -the
original minutes was incorrect and has
been revised to read June 13, 1994; and
on page 3, paragraph 4, "Motion was
seconded by C. Rey d-aeebsand approved
on a 5-0-2 (Crs. Ellis and Kelly absent)
voice vote."
The minutes were then approved as amended.
AGENDA - Item Number 3, 211 Chapin Avenue was withdrawn, the
order of the agenda was then approved.

There were no public comments.
ITEMS FOR STUDY
1. SPECIAL PERMIT FOR FREIGHT FORWARDING COMPANY AND PARKING VARIANCE
FOR BACK UP AT 1415 NORTH CAROLAN AVENUE, ZONED M-1 (PAUL LAND
MICHELE BOGHOSSIAN, PROPERTY OWNER AND LARRY WEINSTEIN,
APPLICANT).
Requests: Does dimension of handicapped parking meet code; CE should
check to see if wider spaces could compensate for a narrower back up
aisle, how many spaces would be lost by widening; dimension of vans,
where located at night; have applicant readdress exceptional
circumstances portion of application; times and frequency of delivery
of small vans and clarify 4 times per month delivery for the large
vans; general job descriptions of various employees; could this qualify
for minor modification; if the applicant would prefer to reduce the
number of spaces that would need to be included in the public notice.

ITEMS FOR ACTION
2. VARIANCES TO FRONT AND REAR SETBACKS AND FLOOR AREA RATIO AT 2022
RAY DRIVE, ZONED R-1 (JERRY AND EILEEN CEGLIA, PROPERTY OWNERS AND
TAMARA HARMON, APPLICANT).
Reference staff -report, 6/27/94, with attachments. CP Monroe discussed
the request, reviewed criteria, Planning Department comments, and study
meeting questions. Three conditions were suggested for consideration.
Chm. Galligan opened the public hearing. Tamara Harmon, T. H. Designs,
Inc., addressed the commission on behalf of the applicant. Letters of
support from the residents at 2210 Ray Drive, 2013 Devereux Drive and
1609 Monte Corvino Way were presented to the commission. Explained
only 19' of foundation was new. The exceptional circumstances include
shape of lot and difficulty in designing around the existing interior
structures, i.e., fireplace and heat ducts in this untraditional "L"
shaped house. Attention was given to the impact of the elevations. If
an interior lot would have 300' more FAR and only be over 390, corner
lot is hardship. They have complied with the exterior corner/side
setback and requirements. Reducing the project by 300 SF would
eliminate the garage extension, possibly one bedroom and bathroom.
Attempting to trim 167 SF from the project would have to be from the
upstairs and the lower level family room. The applicant indicated some
changes were possible. There were no other comments and the public
hearing was closed.
The commissioners discussed the various portions of the project needing
variances and how they relate to each other; and expressed the opinion
that the denial of any portion of the project would affect the other
segments of the project as each piece is related and the visibility of
the front of the triangular lot aggravates the problem, therefore the
commissioners decided that they should act on whole and not deny some
requests and approve others.
C. Ellis noted that there are no exceptional or extraordinary
circumstances or conditions applicable to this property that would
permit the granting of these applications. The increase in floor area
ratio is not in keeping with the direction given by City Council.
Concern was expressed that the mass and bulk of this addition would not
be compatible with, would be detrimental to and would have an adverse
effect on the neighbors and to the existing users in the general
vicinity based on the reasons stated and the information supplied in
the packet, he moved to deny, without prejudice, these variance and
floor area ratio applications.
Motion was seconded by C. Kelly and passed on a 7-0 voice vote. Appeal
procedures were advised.
4. SPECIAL PERMIT FOR AIR/OCEAN FREIGHT FORWARDING BUSINESS AT 50
EDWARDS COURT, ZONED M-1 (ROBERT F. EDWARDS TR, PROPERTY OWNER AND
NEW JAS INTERNATIONAL INC.. APPLICANT).

the request, reviewed criteria, Planning Department comments, and study
meeting questions. Four conditions were suggested for consideration.

Chm. Galligan opened the public hearing. Mike Wong, JAS International,
Inc,. was present to answer questions. He made it very clear that the
conditions, as stated, would not be a problem in any way. Any
perishable items are delivered direct to the airport eliminating any
off load urgency. There were no other comments and the public hearing
was closed. Planning Commission noted that there was little need at
this location to limit hours of delivery or unloading, or use by day of
the week and -directed conditions be modified to take out these
limitations.
C. Ellis moved, based on the information supplied in the packet and
provided by the applicant, moved to approve this special permit
application, by resolution, with the following modified conditions; 1)
that the configuration of warehouse and office areas shall be
consistent with the plans submitted to the Planning Department and date
stamped May 20, 1994; 2) that the business shall operate with a maximum
of nine employees and a maximum of two company vehicles; 3) that within
30 days of action on this item, the applicant shall contact the Fire
Department for an inspection of the automatic sprinkler system and that
any alterations to the sprinkler system shall require a separate permit
to the Building and Fire Departments; and 4) that the project shall
meet all requirements of the Uniform Building and Fire Codes as
amendment by the City.
Motion was seconded by C. Jacobs and passed on a 7-0 voice vote.
Appeal procedures were advised.
5. VARIANCE TO FLOOR AREA RATIO AT 340 PEPPER AVENUE, ZONED R-1
(SCOTT AND ALEXIS DANIELSON, PROPERTY OWNERS AND APPLICANTS).
Reference staff report, 6/27/94, with attachments. CP Monroe discussed
the request, reviewed criteria, Planning Department comments, and study
meeting questions. Four conditions were suggested for consideration.
Chm. Galligan opened the public hearing. The applicant was not
available. There were no comments and the public hearing was closed.
C. Jacobs observed the unusual configuration of this lot and observed
there are many exceptional and extraordinary circumstances and
conditions applicable to this property since the exterior of the house
would be the same with or without the vaulted ceilings. The granting
of the application would not be detrimental to the vicinity or have an
adverse effect on the neighbors because of the dense vegetation on the
lot, based on the reasons stated and the information supplied in the
packet she moved to approve these variance and floor area ratio
applications, by resolution, with the following conditions: 1) that
the project shall be built as shown on the plans submitted to the
Planning Department and date stamped June 15, 1994, Sheets SP -1, A-1,
A-2, A-5, A-6, A-8, and A-11; 2) that the ceiling heights in the studio
(572 SF), living room (347 SF), dining room (247 SF) and master bedroom
(300 SF) shall not exceed 14'-011, 15'-611, 15'-6" and 12'-6" respective-
ly; 3) that the maximum height of the two story portion of the house at
the front of the lot shall be no greater than 30'-0" to the top of the
finished material at the ridge from elevation 50; and 4) that the
project shall meet all Uniform Building and Uniform Fire Code
requirements as amended by the City of Burlingame.

Commission discussed the purpose of the FAR concerns as directed by
Council. The addition of ceilings at 12' within the pitched roofs
would eliminate the need for this variance but would not affect the
mass or bulk of this structure. Even though this project exceeds the
FAR requirements it does fit into the declining height envelope.
Further, if a cathedral ceiling is included in a design it causes a
double count of space, this limits some of the architectural ingenuity.
Motion was seconded by C. Kelly
C. Jacobs asked that her motion be withdrawn, her second declined and
the motion stood, the motion to approve the variance then passed on a
4-3 (C. Deal, Mink and Galligan dissenting) roll call vote. Appeal
procedures were advised.
6. TEMPORARY TENT PERMIT FOR THE HYATT REGENCY HOTEL AT 1333 BAYSHORE
HIGHWAY, ZONED C-4 (HTKG DEVELOPMENT ASSOCIATES, PROPERTY OWNER
AND STEVE TRENT, APPLICANT).
Reference staff report, 6/27/94, with attachments. CP Monroe discussed
the request, reviewed criteria, Planning Department comments, and study
meeting questions. Six conditions were suggested for consideration.
Chm. Galligan opened the public hearing. Larry Builta, Hyatt Director
of Engineering, 1333 Bayshore, was present to answer commission
questions. The tent is a clear span, metal frame and is designed to
withstand 80 MPH winds. In response to parking problem questions Mr.
Builta reported there were 14 instances (12 day - 2 evening) in 1993
and thus far in 1994 where parking demand exceeded spaces onsite and
created an overflow. Sixty percent of their residency rate is fly in
customers. Parking impact is created when an event draws from the
local community. There were no other comments and the public hearing
was closed.
C. Jacobs moved approval of this application with an added condition
noting that the granting of the application would not be detrimental to
the vicinity or have an adverse effect on any neighbors, based on the
reasons stated and the information supplied in the packet she moved to
approve this temporary tent permit application with the following
conditions; 1) that the ±5,000 SF tent shall be installed as shown on
the 8'k" X 11" and 11" X 17" plans submitted to the Planning Department
and date stamped June 13, 1994 Aerial Plan; Model 2000/290/603/000
Section; and Site Plan; 2) that the conditions of 'the Fire Marshals'
June 13, 1994 memo (tent structure shall be protected by an automatic
fire sprinkler and connected to a fire alarm system which meets all ADA
requirements); the Chief Building Officials' June 13, 1994 memo (tent
is subject to all the requirements of the State Building Code) shall be
met; 3) that the temporary tent shall be removed on December 31, 1994
and the parking spaces shall be restored to their original condition
and use; 4) that all employees whose parking spaces have been
temporarily displaced by this tent shall park on -sate in the primary
parking structure of the hotel; 5) that the project shall meet Uniform
Building Codes and Uniform Fire Codes as amended by the City of
Burlingame; and 6) that a parking survey count be undertaken each time
the tent is in use, noting number of vacant parking spaces at the peak

use time of the tent event and at dinner service hours; and 7) that the
site shall be inspected for removal of the tent on January 3, 1995.
Motion was seconded by C. Mink and passed on a 7-0 voice vote. Appeal
procedures were advised.
