CALL TO ORDER

A regular meeting of the Planning Commission, City of Burlingame was
called to order by Chairman Galligan on Monday, July 25, 1994 at 7:32
P.M.
ROLL CALL

and Mink

MINUTES - The minutes of the July 11, 1994 meeting were approved
as mailed.
AGENDA - Item Number 7, 1445 E1 Camino Real was continued to the
August 8, 1994 meeting. The order of the agenda was
then approved.

There were no public comments.
ITEMS FOR STUDY
1. HEIGHT AND PARKING VARIANCES TO RENOVATE THE FIRST STORY AND BUILD
A SECOND STORY ADDITION AT 1617 BALBOA AVENUE, ZONED R-1 (FRANK
SKOGLUND, PROPERTY OWNER AND CHU DESIGN & ENGINEERING, APPLICANT).
Requests: Clarify through Public Works, Engineering the 5.5' property
line setback, are there any utilities within that setback; existing
garage has a 3' side setback, is that a minor modification with a
complete remodel; express feeling once demolition begins there will be
very little of the existing structure left, variance should address
that fact; what is average front setback on Balboa; variance for height
not just parking; contact landowner - lady living there does not know
of project - set time for commissioners to examine; need scale drawing
to adjoining properties re privacy impact (window to window); explain
why garage can't conform (length and width). Item set for public
hearing August 8, 1994.
2. VARIANCES TO RETAIN AN ILLEGALLY CONVERTED GARAGE AS A LIVING UNIT
AT 34 ANITA ROAD, ZONED R-3 (ROSA AND YVETTE MEDINA, PROPERTY
OWNERS AND YVETTE MEDINA, APPLICANT).
Requests: do the number of units conflict with the housing element -
does this conform or not conform; would Engineering comment about
parking at this site if this application were approved; would applicant

consider asking for fewer variances; letter from applicant about
unusual circumstances (financial reasons don't apply); where do
existing tenants park now; does everything need to be brought to code
and what is the expense of bringing this structure to code; reconcile
6/23 letter about their claim of disclosure vs information in staff
report, they state they were unaware 3rd unit was not legal; cause of
fire to main structure; check with engineering on feasibility of 7.5'
driveway in terms of access and rear parking; would addition of unit to
main structure be more cost effective than detached structure, have
applicant address in terms of cost analysis; if' all information
available, set for hearing August 8, 1994.
3. PARKING VARIANCE FOR OFFICE USE ON THE SECOND FLOOR AT 311-315
PRIMROSE ROAD, ZONED C-1 SUBAREA A (RONNIE GOLDFIELD, PROPERTY
OWNER AND APPLICANT).
Requests: why 2 full bathrooms for office space (1,000 SF limit);
nature of office business proposed; clear answer regarding whether
sprinkler system was installed; office space for gallery use or as
tenant space; compare old approval with new proposal; plans inadequate
and difficult to read, please revise incorporating 1st and 2nd floor;
Set for hearing August 8, 1994 if plans adequate.
4. PARKING VARIANCE FOR SIX STALLS TO ALLOW SECONI) FLOOR RETAIL USE
AT 851 CALIFORNIA DRIVE, ZONED C-R (PAUL C. LEE, PROPERTY OWNER
AND APPLICANT).
Requests: number of customer rentals during week (laser & movie);
letter to building owners in April, 1992, stating they could trade
retail top floor, take it to first floor and leave the second floor
vacant; in 1993 won a SAMMY award for interior space design, show
timeline for installation - planned well in advance - 8 mo.
construction timetable from applicant; when was SAMMY applied for and
when awarded; when did Mr. Lee buy building, was he aware of the
restrictions placed on the building; need to address 4 factors for
exceptional or extraordinary circumstances as they relate to property,
not use; no one challenging business aspect, application needs to be
streamlined to issues not feelings; what are the steps necessary to
revoke 1992 action and return the property to the 1988 approval;
mechanism to recover staff time expended for code violations. If all
questions answered set item for public hearing August 8, 1994.
ITEMS FOR ACTION
5. SPECIAL PERMIT AND PARKING VARIANCE FOR AUTOMOBILE DETAILING AND
RETAIL SALES AT 1281 WHITETHORN WAY, ZONED M-1 (NICHOLAS & STELLA
CRISAFI, PROPERTY OWNERS AND WILLIAM R. SUTTON, APPLICANT).
Reference staff report, 7/25/94, with attachments. Planner Gomery
discussed the request, reviewed criteria, Planning Department comments,
and study meeting questions. Four conditions were suggested for
consideration.

Chm. Galligan opened the public hearing. William Sutton, 1281
Whitethorn Way was present to answer questions. There were no other
comments and the public hearing was closed.
C. Deal noted the application will not be detrimental nor will it have
a negative impact on the area, he then moved to approve this
application, by resolution, with the following conditions; 1) that the
project shall be built as shown on the plans submitted to the Planning
Department and date stamped June 9, 1994, Site Plan (8'k" X 1101) and
June 16, 1994, General Floor Plan (8z" X 1111); 2) that the conditions
of the City Engineers' June 13, 1994 memo and the Fire Marshals' June
201 1994 memo shall be met; 3) that the business shall be open 9:00
A.M. to 6:00 P.M. Monday through Friday with a maximum of three
employees at any one time; and 4) that the project shall meet all the
requirements of the Uniform Building and Uniform Fire Codes as amended
by the City of Burlingame.
Motion was seconded by C. Kelly. The motion passed on a 7-0 voice
vote. Appeal procedures were advised.
6. SPECIAL PERMIT AMENDMENT FOR A CELLULAR TELEPHONE ANTENNA ON CITY
RESERVOIR PROPERTY AT 1321 SKYVIEW DRIVE, ZONED R-1 (CITY OF
BURLINGAME, PROPERTY OWNER AND SMART SMR OF CALIFORNIA, INC.,
APPLICANT).
Reference staff report, 7/25/94, with attachments. Planner Gomery
discussed the request, reviewed criteria, and Planning Department
comments. Six conditions were suggested for consideration. Two
letters were received after the packet had been prepared and were
presented to the commission. The second letter contained the
signatures of 20 residents (all from Skyview Drive). They noted that,
there are only 22 homes on Skyview Drive.
Chm. Galligan opened the public hearing. Laura Albright, Smart SMR,
and Mike Mangeneti, 475 - 14th Street, Oakland, the applicants,
answered questions relating to frequency bands and equipment and
explained the project.
Paul Grech, 1315 Skyview Drive, Edward Hammill, 1304 Skyview Drive, Lou
Marini, 1344 Skyview Drive, and Stephen Holquist, 1305 Skyview Drive
spoke in opposition to the project and expressed health and other
safety and aesthetic concerns. There were no other comments and the
public hearing was closed.
C. Ellis noted this use is not compatible with this residential
location, he then moved denial of this application. Commissioners
expressed feelings that there were enough health and other concerns to
justify this denial. There were feelings expressed that more study of
the exposure and impact of the microwaves could have enhanced the
application.
Motion was seconded by C. Jacobs and passed on a 7-0 roll call vote.
Appeal procedures were advised.

The Commission adjourned for a short break at 9:05 P.M. and reconvened
at 9:12 P.M.
8. MASTER SIGN PROGRAM AND SIGN EXCEPTIONS AT 1801. TO 1887 EL CAMINO
REAL (BURLINGAME PLAZA), ZONED C-1 (JOHN BRITTON, APPLICANT).
Reference staff report, 7/25/94, with attachments. Planner Gomery
discussed the request, reviewed criteria, and Planning Department
comments. Three conditions were suggested for consideration.
Chm. Galligan opened the public hearing. Mr. Pederson, 2105 Summit
Drive addressed the commission. He elaborated on the fabric flags and
the need for more signage. There were no other comments and the public
hearing was closed.
C. Deal moved approval of this master sign program and sign exception
application, by resolution, subject to the three conditions discussed;
stating that the signs are not obtrusive and add ambience and identity
to the plaza; the conditions are as follows; 1) that the project shall
be built as shown on the plans submitted to the Planning Department and
date stamped June 23, 1994 8k" X 11" Site Plan and 11" X 17" Sections
and Elevations with a maximum flag size of 4' in the vertical dimension
and 5' in the horizontal dimension (maximum 20 SF); and 2) that the
conditions of the city Engineer's June 24, 1994 memo (the City reserves
the right to change the sign locations if the signs will block the
traffic right of way) and the Chief Building Inspector's June 23, 1994
memo (foundation and seismic/wind details will be required for a
building permit) shall be met; and 3) that the project shall meet all
Uniform Building and Uniform Fire Code requirements as amended by the
City.
It was noted, for the record, that there are a number of parcels on
this block and it is appreciated that the request could be amalgamated.
Motion was seconded by C. Key and approved on a 6-1 (C. Jacobs
dissenting) voice vote. Appeal procedures were advised.
9. SPECIAL PERMIT FOR MICROWAVE DISH ANTENNA AND NINE (9) CELLULAR
PANEL ANTENNAS AT 330 PRIMROSE ROAD, ZONED C-1 SUBAREA A (EDWARD
A. KEITH, PROPERTY OWNER AND MATTHEWS LAND COMPANY, APPLICANT).
Reference staff report, 7/25/94, with attachments. Planner Saisi
discussed the request, reviewed criteria, and Planning Department
comments. Four conditions were suggested for consideration.
Chm. Galligan opened the public hearing. Walt Phillips, representing
Matthews Land Company, discussed the size of the panels, the technology
and relay signals. There were no further comments and the public
hearing was closed.

C. Mink stated that this antenna is suitable and compatible with the
character of a commercial application in a commercial zone and moved
approval of this application, by resolution, with the following
conditions: 1) that the installation of the antennas be consistent
with the plans submitted to the Planning Department and date stamped
June 21, 1994; 2) that the top of the dish antenna shall not be higher
than 13'-8" above the roof deck and shall not rise above the top of the
mechanical enclosure; 3) that all antennas shall be non -reflective and
painted to match the surface of the mechanical penthouse; 4) that the
conditions of the building official's memo dated June: 23, 1994 shall be
met; 5) that any increase in the amount cellular equipment on the roof
shall require an amendment to this permit; and 6) that the project
shall meet all requirements of the Uniform Building and Fire Codes as
amended by the City.
Motion was seconded by C. Jacobs and passed on a. 7-0 voice vote.
Appeal procedures were advised.
VIII. PLANNER REPORTS
- Planner Gomery reviewed City Council regular meeting of July
11, 1994.
IB. ADJOURNMENT
The meeting was adjourned at 9:37 P.M. in memory of Edith Warne, mother
of City Planner Margaret Warne Monroe. The commissioners extend CP
Monroe's father and family their good wishes and support.
