ROLL CALL Present: Commissioners Deal, Ellis, Galligan, Jacobs, Kelly and Key Absent: Commissioner Mink Staff Present: Jane Gomery, Planner; Sheri Saisi, Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Bill Reilly, Assistant Faire Chief MINUTES - The minutes of the August 8, 19,94 meeting were approved as mailed. Chairman Galligan informed all applicants for action items that the rules of procedure for the commission require a minimum of 4 affirmative votes to pass a motion, there are only 6 members seated tonight and on Item #5 one of the commissioners will abstain. If a vote ties the motion it does not pass. If an applicant would prefer to' be heard by a full commission, they may request a continuance. There were no such requests. AGENDA - Items Number 9, and 10, 311-315 Primrose Road and 1440 Chapin Avenue, were continued to September 12, 1994. The order of the agenda was then approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. SPECIAL PERMIT FOR A SNACK BAR WITH TAKE OUT FOOD AT 601 CALIFORNIA DRIVE, ZONED C-2 SUBAREA B (ROGER AND BETH SPERRING. PROPERTY OWNERS AND ROGER L. SPERRING, APPLICANT). Requests: What is the proximity of residential uses to the site; what other sites in Burlingame have special permits for snack bars and do they have service bays; Is there an ability to move the propane tank to add parking spaces; do they plan to move surplus cars. Item set for public hearing September 12, 1994. 2. TWO PARKING VARIANCES AT 35 INGOLD ROAD, ZONED M-1 (SUSAN LAMBERTSON, PROPERTY OWNER AND SCHULZE MANUFACTURING, APPLICANT). Requests: Explain the increase from 106 to 119 for 13 additional stalls; will the applicant participate in the Public Transit (TSM) program. SPECIAL PERMIT FOR OVERSIZED DETACHED GARAGE AT 21 PARK ROAD, ZONED R-3 (JOSE ABURTO, PROPERTY OWNER AND STANLEY E. YORKE, APPLICANT). Reference staff report, 8/22/94, with attachments. Planner Saisi discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. Letters of objection from Parkwoods Homeowners Association and Nadine Gille were noted for the record. Chm. Galligan opened the public hearing. Jose Aburto, 665 Stanford, Redwood City, was present to answer any questions. He discussed his need for the storage space, the number of vehicles and equipment, type of business, no storage of materials, etc. Nadine Gille, 33 Park Road spoke in opposition to the project along with Bob Regal and submitted a drawing to the commission. Lynn Haslow, 19 Park Road spoke favorably about the application. There were no further comments and the public hearing was closed. C. Deal noted this use is permissible in the R-3 zone and that the current placement of the accessory structure is the only feasible solution, he then moved approval of this application, by resolution, with the following amended conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped June 29, 1994 Sheet 1 and 2, with the exception that the height shall be 10' for the entire structure; 2) that the property owner obtain a home occupation permit and a business license for the home business he is currently engaged in; 3) that a second driveway access shall never be created off of E1 Camino Real; and 4) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Kelly and passed on a 6-0-1 (C. Mink absent) voice vote. Appeal procedures were advised. 4. VARIANCES TO RETAIN AN ILLEGALLY CONVERTED GARAGE AS A LIVING UNIT AT 34 ANITA ROAD, ZONED R-3 (ROSA AND YVETTE MEDINA, PROPERTY OWNERS AND YVETTE MEDINA, APPLICANT). Reference staff report, 8/22/94, with attachments.. Planner Saisi discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration. Chm. Galligan opened the public hearing. Yvette Medina, 139 Madrid Street, San Francisco, applicant, was present to answer questions and explain the misinterpretation when the property was purchased. There were no further comments and the public hearing was closed. -2- Burlingame Planning Commission Minutes August 22, 1994 C. Jacobs noted this is R-3 zoning designation, meaning only one residential structure is allowed. Commission was unable to find any exceptional circumstances for this request to be granted 5 variances. There are no specific findings and this development does not meet minimum standards. This structure needs to be brought up to code. She then moved for denial of this application. Motion was seconded by C. Deal and passed on a 6-0-1 (C. Mink absent) voice vote. Appeal procedures were advised. 5. SPECIAL PERMIT FOR MARTIAL ARTS INSTRUCTION AT 1247 BROADWAY, ZONED C-1 (WALTER RENNER, PROPERTY OWNER AND SCOTT WOODS, APPLICANT). Reference staff report, 8/22/94, with attachments. Planner Saisi discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Seven conditions were suggested for consideration. Commissioner Deal abstained from the discussion and the vote. Chm. Galligan opened the public hearing. Terry Baker, 18500 Von Karman Avenue, Irvine, was present representing the applicant. She clarified the hours of operation, number of students at any one time and the use of a kick bag. There were no further comments and the public hearing was closed. C. Jacobs noted this use will not be injurious to property in the vicinity and the proposed use will be located and. conducted in a manner in accord with the Burlingame General Plan and the purposes of this title. She then moved approval of this application, by resolution, with the following amended and added conditions: 1) that the location and configuration of the self defense studio shall be consistent with the plans submitted to the Planning Department date stamped July 15, 1994; 2) that the: business hours shall be 12:00 p.m. to 9:00 p.m. Monday through Thursday, 12:00 p.m. to 6:00 p.m. Fridays and 10:00 a.m. to 4:00 p.m. Saturdays with no more than two (2) employees and fifteen (15) students; 3) that group lessons shall occur no earlier than 5:00 p.m. on weekdays and shall conclude no later than 2:00 p.m. on Saturdays, 4) that no tournaments or large assembly events occur from this site; 5) that no kick bag(s) shall be used at this site; 6) that any change in the hours of operation, class size, number of employees shall require an amendment to this special permit; 7) that the project shall meet all requirements of the Uniform Building and Fire Codes as amended by the City; and 8) that this application be reviewed in one year (September, 1995) for compliance and thereafter upon complaint. Motion was seconded by C. Key and passed on a 5-0-1-1 (C. Deal abstaining and C. Mink absent) voice vote. Appeal procedures were advised. -3- Burlingame Planning Commission Minutes August 22, 1994 6. SPECIAL PERMIT FOR TAKE OUT FOOD AT 1236 BURLINGAME AVENUE, ZONED C-1 BURLINGAME AVENUE COMMERCIAL AREA SUBAREA A (KEIL SONOMA CORP., PROPERTY OWNER AND BRIAN DAVISI APPLICANT). Reference staff report, 8/22/94, with attachments. Planner Gomery discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Six conditions were suggested for consideration. There was clarification of the two items received after preparation of the staff report showing authorization from the property owner to proceed. Chm. Galligan opened the public hearing. Brian Davis, 1236 Burlingame Avenue, the store manager, answered the commission's questions. There were no further comments and the public hearing was closed. C. Key noted the comments in the staff report and then moved approval of this application, by resolution, with the following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped July 20, 1994 Store Floor Plan (83,-" X 1411) and August 2, 1994 Sheet 1, General Structure Floor Plan (11" X 17"); 2) that the conditions of the City Engineers' August 8, 1994 memo shall be met; 3) that the business will be open 9:00 A.M. to 7:00 P.M. Monday through Saturday and 10:00 P.M. to 5:00 P.M. Sunday with a maximum of six employees at any one time; 4) that the applicant shall provide and maintain at least daily, more often if necessary, a trash receptacle at the door along Burlingame Avenue, or at locations approved by the City Engineer and Fire Department; 5) that the applicant shall remove once a day or more frequently, all take out debris in front of the store and within 50' of the store; and 6) that the project shall meet all the requirement: of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Jacobs and passed on a 6-0-1 (C. Mink absent) voice vote. Appeal procedures were advised. 7. TENTATIVE AND FINAL PARCEL MAP TO RESUBDIVIDE 6 EXISTING PARCELS INTO 4 PARCELS AND A VARIANCE TO STREET FRONTAGE AT 025-169-160 & 170, 025-168-130 AND 1742 ROLLI19S ROAD, ZONED M- 1 (ARTHUR MICHAEL AND JOHN T. MICHAEL - R.W.R. PROPERTIES, PROPERTY OWNERS AND ARTHUR MICHAEL. APPLICANT'). Reference staff report, 8/22/94, with attachments. CE Erbacher discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Seven conditions were suggested for consideration. Commissioners asked questions pertaining to the future uses and the conditions that would apply. Any use or variance requests would have to come before the City Council for approval. -4- Burlingame Planning Commission Minutes August 22, 1994 Chm. Galligan opened the public hearing. Art Michael, was present to answer questions relating to future uses, i.e., a warehouse building with variances; additional parking, etc. There were no further comments and the public hearing was closed. C. Jacobs noted this is a routine procedure and in accord with the reasons cited in the staff report, moved recommendation to City Council with the following conditions: 1) that no ;site development is approved by approval of this map; 2) that a covenant on the Final Map create all the necessary easements shown on the Tentative Map; 3) that all fill material presently stockpiled. in the drainage right-of-way be removed from the site prior to recording of the Final Map; 4 ) that all conditions of the Planning Memo dated August 8, 1994 shall be met; 5) that a special Encroachment Permit be obtained from the Burlingame City Council for any development within the 140' drainage right-of-way; 6) that flooding must be allowed in the 140' easement and any proposed uses or regrading must accommodate this flooding; and 7) that conditions 2 and 6 shall be shown as developmental conditions on this Parcel Map. Motion was seconded by C. Deal and passed on a 6-0-1 (C. Mink absent) voice vote. 8. SPECIAL PERMIT FOR TRUCK AND EQUIPMENT STORAGE AT 970 DAVID ROAD, ZONED M-1 (JOEL BECK, PROPERTY OWNER AND APPLICANT). Reference staff report, 8/22/94, with attachments. Planner Gomery discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. Chm. Galligan opened the public hearing. Joel Beck., the applicant, was present to answer question. The applicant asked that condition #3 be eliminated and they be allowed to park on the street. They have been doing so for two years and there have been no complaints. CA Coleman advised condition #3 be replaced conditioning the installation of a curb cut. There were no further comments and the public hearing was closed. C. Deal noted the amended conditions in the staff report, he then moved approval of this application, by resolution, with the following amended conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped July 12, 1994 Sheet 1, Assessors Parcel Map; 2) that the truck and equipment storage facility will be open 7:00 A.M. to 5:00 P.M. Monday through Sunday with a maximum of four employees at any one time; 3) that applicant shall install to City standards a curb cut on Davis Road as approved by City Engineer; and 4 ) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. SPECIAL PERMIT FOR REAL ESTATE USE ON THE FIRST FLOOR AT 1440 CHAPIN AVENUE, ZONED C-1 SUBAREA B1 (CORTINA INVESTMENTS LTD, PROPERTY OWNER AND CAROL RODONI OF CORNISH AND CAREY, APPLICANT).
