ROLL CALL PRESENT: Commissioners Deal, Ellis, Galligan, Jacobs, Kelly, Key and Mink ABSENT: None STAFF PRESENT: City Planner; Margaret Monroe, Frank Erbacher, City Engineer; Keith Marshall, Fire Marshall MINUTES - The minutes of the October 11, 1994 meeting were approved as mailed. AGENDA - The order of the agenda was approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. VARIANCE FOR LOT SIZE, TENTATIVE AND FINAL PARCEL MAPS TO RESUBDIVIDE EXISTING PARCELS INTO FOUR PARCELS AT 1500 TO 1650 BAYSHORE HIGHWAY, ZONED C-4 (CHRISTOPHER O. VEITCH, PROPERTY OWNER AND DANIEL G. MACLEOD, APPLICANT. Requests: Parcel 4 is smaller than allowed, why is it not merged into next parcel; what is average lot size in area; and is this application compatible with the California Map Act; if approved, can 3 remaining properties be redivided, if so, is there a time limit on resubdivision; if the lots are subdivided must the existing development be made to conform to the current zoning or UBC standards; clarify the difference between 4 lot subdivision and 6 lot subdivision; why do the assessor maps show some of the requested lot lines; what is motivation for dividing these lots since there is one owner. SPECIAL PERMIT FOR AUTO SALES IN THE M-1 ZONE AT 1327 MARSTEN ROAD, ZONED M-1 (JOHN MICHAEL, PROPERTY OWNER AND MICHAEL J. MOLONEY, APPLICANT). Requests: what is unusual about this application to justify the conditional use permit and variance; is there any parking in front of this site; a variance application should be included; 28 SF does not seem adequate for office space. Item set for public hearing November 14, 1994. 3/4. SPECIAL PERMIT FOR RESIDENTIAL CARE FACILITY AND TENTATIVE AND FINAL MAP FOR A LOT SPLIT AT 1733 CALIFORNIA DRIVE, ZONED C-1 (BURLINGAME VILLA. PROPERTY OWNER AND JOHN CIMINO, JR., APPLICANT). Requests: where and how will deliveries be made; showers are not identified on the plans; provide average lot size from back adjacent residential to Trousdale; how will the required 45 dBA maximum in sleeping areas be achieved given the noise levels of BART/Caltrain; what is the address of the group facility on Balboa. Item set for public hearing November 14, 1994. ACTION ITEMS 5. FENCE EXCEPTION FOR HEIGHT AT 801 CROSSWAY ROAD, ZONED R-1 (VICKI COLLINS, PROPERTY OWNER AND APPLICANT) (CONTINUED FROM OCTOBER 11, 1994 PLANNING COMMISSION MEETING) Reference staff report, 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Three conditions were suggested for consideration. Chm. Galligan opened the public hearing. Vicki Collins, the applicant and Harley Brookins were present to answer questions. They explained the fence will be stair stepped down. There were no other comments and the public hearing was closed. Commission noted the fence requirements do cause an unnecessary hardship on this property. C. Jacobs noted the footprint of the property is somewhat reversed. She then moved approval of this application including the conditions and findings incorporated by reference along with the information from the neighbors, with the following conditions : 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped, September 22, 1.994, Site Plan; 2) that the conditions of the Associate Civil Engineer's memo shall be met; and 3) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. IiIM Burlingame Planning Commission Minutes October 24, 1994 6. FENCE EXCEPTION FOR HEIGHT AT 1320 CASTILLO AVENUE, ZONED R-1 (STEVE & PAT TRENT, PROPERTY OWNERS AND APPLICANTS). Reference staff report, 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. Chm. Galligan opened the public hearing. Patricia Trent, the applicant, was present to respond to questions. She thinks the deck is 15 to 20 years old, it was already in place when she bought the house a year and a half ago. She checked with the previous owner and it was there when he purchased the house. The applicant and her neighbor do not want the deck area secluded for security reasons by placing a screening fence on the deck. There were no other public comments and the public hearing was closed. C. Jacobs noted the slope of this lot and explained that replacing this fence will be an improvement. She then moved approval of this application with the following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department date stamped September 22, 1994 (site plan and fence elevation) and the overall height of the rear 50 linear feet of fence:, as measured from highest adjacent grade, shall not exceed 8'-0" and that the solid portion of the other 20 linear feet of new fence shall not exceed 6'-0" in height as measured from the highest adjacent grade; 2) that within 90 days, application for a retroactive building permit shall be made for the deck in order to meet the requirements of the Chief Building Official's September 26, 1994 memo; 3) that application shall be made to the Building Department for a permit to build the fence; and 4) that the project shall meet all Uniform Building and Uniform Fire Code requirements as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. 7. SPECIAL PERMIT FOR AUTOMOBILE SALES AND STORAGE AT 1291 WHITETHORN WAY, ZONED M-1 (NICHOLAS & STELLA CRISAFI, PROPERTY OWNERS AND L.R. SPENCER, APPLICANT). Reference staff report, 10/24/94, with attachments. CP Monroe discussed the; request, reviewed criteria, Planning Department comments, and study meeting questions. Eight conditions were suggested for consideration. Chm. Galligan opened the public hearing. Roy Spencer, 525 Park, San Mateo was present and explained this is really just a move to a better location. Many other businesses encroach on his 6 parking spaces. He plans to refinish the surface of the parking area for his tenant space and letter his address on each space. The cars are usually delivered individually for his business, however commission asked that the conditions be amended to reflect no truck off loading during regular business hours. Commission commented that the DMV criteria requires an available space for display not the actual display of the vehicle. There were no other comments and the public hearing was closed. Deal noted based on the information in the staff report, this request is :in keeping with the required findings and the proposed use will be located and conducted in a manner in accord with the Burlingame general plan, he then moved approval of this application, by resolution, with findings and with the following amended conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped September 9, 1994, Site Plan (81h X 11 "); 2) that the conditions of the City Engineer's September 12, 1994 memo and the Fire Marshal's September 12, 1994 memo shall be met; 3) that the business shall be open 9:00 A.M. to 5:00 P.M. Monday through Friday with a maximum of two employees including the proprietor, on site, at any one time; 4) that space for at least one vehicle will be available inside the building in accordance with the Department of Motor Vehicle dealers license requirements; 5) that none of the on-site parking shall be used to display or store cars for sale from this business; 6) that vehicles delivered to this site by truck transport to be sold or displayed by this business shall only be off loaded before or after regular business hours of other tenants on site and in the immediate area; no cars shall be off loaded on the public street or in such a way that required on site parking is blocked; 7) that any changes to this business operation as outlined in the application materials date stamped September 8, 1994 shall require an amendment to this special permit; and 8) that the use and any improvements for the use shall meet all the requirements of the Uniform Building and Uniform fire Codes as amended by the City of Burlingame. Motion was seconded by C. Kelly and passed on a 7-0 voice vote. Appeal. procedures were advised. 8. DETERMINATION AND SIGN EXCEPTION FOR SIZE AND HEIGHT AT 851 BURLWAY ROAD, ZONED O -M (WESTATES VENTURE, INC., PROPERTY OWNER AND WILLIAM A. RYAN, APPLICANT). Reference staff report, 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration. Two letters in opposition, received after preparation of the staff report, were presented to the commission. Also, a pictorial review was presented, as requested, depicting the signs visible along the freeway. State of California, Caltrans, regulates advertising signage within 660 feet of the paved edgeway of a highway. This particular signage is about 350' from the edge of Highway 101 and therefore falls within the corridor regulated by the Outdoor Advertising Act. This applicant must get an off -premise advertising permit from Caltrans as well as a sign exception from the city. The Caltrans approval should precede the issuance of a building permit by the city. The verbiage in the City's sign code is the same as the Outdoor Advertising Act as it relates to freeway oriented signs. A sign such as this cannot be within 500' of an interchange or another sign which has a permit from Caltrans. Chm. Galligan opened the public hearing. Joseph Ryan, 10 Millbarn Court, San Mateo, the business owner's representative and Thano Bounes, of Industrial Signs explained. the sign proposal to the commission. The business has no desire to sell the product being advertised in the U.S. at this time. The purpose of the sign is to make a statement with a sideview to marketing. Thano Bounes, Industrial Signs, testified that he spent much time evaluating the building and arriving; at a careful design which was cost effective and acceptable. He noted the sign is simple and elegant; he noted that he looked at the other side of the building but this is the most visible, best, place on the building. The front of the Burlingame Planning Commission Minutes October 24, 1994 building faces a dead end street few people will see. The proposed location has the advantage of being back far enough for the sign to be read and understood by traffic passing b;y on the freeway. The sign incorporates no flashing lights so it will not be a traffic hazard. He noted, "it is, indeed, a freeway sign to catch attention" but he is aware that there are economic problems in the neighborhood and you need the sign to show that there is business activity in the area. He reviewed briefly the analysis he did of the building to identify the location most visible from the freeway for placement of the sign. There were no other comments and the public hearing was closed. Chin. Galligan thanked the applicant for his compelling testimony, however, he noted the statements made regarding placement, size and visibility confirm the fact that this is, indeed, a freeway oriented sign. Other commissioners noted that there were other freeway oriented signs in the area which predated the sign code. The commissioners also discussed the appeal procedures for a determination. C. Kelly stated that based on the testimony given the sign is oriented to the freeway and should be determined to be prohibited by the code. Motion was seconded by C. Jacobs and passed on a 7-0 voice vote. On the motion commissioners noted the height, face of the building and projection of this sign clearly contribute to its freeway orientation. The sign needs to be reoriented so it can only be seen incidentally from the freeway, needs to help people find businesses on the site or identify the building. A parapet placed projecting sign is not the way to achieve this; the DHL parapet sigh was allowed because it was the only place to put the sign on a glass clad building. Commission and staff described the appeal process for the applicant, explaining that the only thing appealable is the action taken on the determination. 9. SPECIAL PERMIT AMENDMENT AT 1718 ROLLINS ROAD, ZONED M-1 (1718 ROLLINS ROAD PARTNERSHIP, PROPERTY OWNERS AND ROYAL ATHLETIC CLUB, APPLICANT). Reference staff report, 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Three conditions were suggested for consideration. Chin. Galligan opened the public hearing. Joe MacDonald, 430 Vallejo, San Francisco, the manager of the Royal Athletic Club was present to respond to the commissioner's questions. The request to remain open 24 hours is to accommodate the current membership whose employer pays for memberships and require they stay fit. They do not expect more members because of longer hours. They will be fully staffed 24 hours. There were no other comments and the public hearing was closed. C. Jacobs noted this request will not be detrimental to property in the vicinity, nor will it be detrimental to public convenience. She then moved approval of this application with an added condition that they conform to all previously approved conditions and that the snack bar conform to all the requirements of -5- Burlingame Planning Commission Minutes October 24, 1994 their liquor license, by resolution, with the following conditions: 1) that the hours of operation shall be 24 hours per day, 7 days per week as stated in this application with 60 parking stalls provided on-site and the deli shall extend its hours of operation so as it continues to comply with the requirements necessary to maintain its liquor license; 2) that any changes proposed to the athletic activities and/or facilities as a result of this application shall require a separate special permit application to the Planning Commission; 3) that this application shall conform with the November 12:, 1985 and August 4, 1992 conditions required as a part of previous approvals for requests for additional uses and changes to the site; and 4) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. 10. ONE YEAR EXTENSION OF PARKING VARIANCE AT 850 MITTEN ROAD, ZONED O -M (SILVER TERRACE NURSERIES, PROPERTY OWNER AND JAMES D. VALENTI, APPLICANT). Reference staff report, 10/24/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Chm. Galligan opened the public hearing. Robert Ruggeri, 569 So. Oak: Park Way, Redwood City explained the wholesale shipping operation and the reasons for the delay introducing the retail use. There were no other comments and the public hearing was closed. C. Jacobs noted this request extends the intention of the November 8, 1993 Planning Commission approval. She then moved approval of this application for one year and incorporated by reference the previously approved conditions. Motion was seconded by C. Ellis and passed on a 7-0 voice vote. Appeal procedures were advised. PLANNER REPORTS - The 1995 schedule for Planning Commission meetings was accepted as presented. - Review of City Council regular meeting of October 17, 1994.
