There was a moment of silence, for positive thought, in tribute to Bill Key who is quite ill. ROLL CALL PRESENT: Commissioners Deal, Ellis, Galligan, Jacobs, Kelly and Mink ABSENT: Commissioner Key STAFF PRESENT: City Planner; Margaret Monroe, City Attorney; Jerry Coleman, City Engineer; Frank Erbacher, Fire Marshall; Keith Marshall MINUTES - The minutes of the October 24, 1994 meeting were amended, p. 6; Planner reports; to add: Agendize Sign Amortization for City Council/Planning Commission Joint Meeting, Saturday, April 22, 1995, 9.00 A.M. The minutes were then approved. AGENDA - The order of the agenda was amended to show that Item # 7, Variance for Lot Size, Tentative and Final Parcel Maps to resubdivide existing parcels into four parcels at 1500 to 1650 Bayshore Highway, zoned C-4 was continued to November 28, 1994. The order of the agenda was then approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. PARKING VARIANCES AND SIDE SETBACK VARIANCE AT 1237 BALBOA AVENUE, ZONED R-1 (FERESHTEH & KEIHAN EHSANIPOUR, PROPERTY OWNERS AND APPLICANTS). Requests: Hallways 36" wide are minimum code; asking too much of property; how does this relate to finding for side setback; do occupants have cars, if so, where will they park; plans need to show more clearly the rear handicapped ramp access dimensions having to do with the property; does not appear negotiable for a wheelchair as drawn; closets too small some not accessible; would like legend on plans addressing the walls; which walls are staying/going; how will the workshop be used; what are the exceptional circumstances having to do with the property; have rules regarding ambulatory changed, if not, handicapped access is not necessary other than if the caretakers are disabled; plans may need to be redrawn. -1- Burlingame Planning Commission Minutes November 14, 1994 The City Attorney noted that this should be reviewed as a 6 bedroom single family house with a parking variance. Item set for public hearing November 28, 1994 pending necessary responses in a timely manner. 2. SPECIAL PERMIT AT 125 BLOOMFIELD ROAD, ZONED R-1 (JOHN STEINER, PROPERTY OWNER AND PHILIP D. WILKINSON, APPLICANT). Requests: Is new carport 4' from existing second unit; need elevations of carport and roof with dimensions; roof should be solid; Special Permit application question #2 states, "proposed. addition will conform to the City of Burlingame General plan and zoning ordinance", if this is so why then the need for so many exceptions; history of building permits on property; how long has applicant owned this site; are both units rented; was consideration given to moving the curb cut and driveway to improve access to the carport; will palm and pine trees be removed. Item set for public hearing November 28, 1994. 3. REAR SETBACK VARIANCE FOR ADDITION TO HOUSE, SPECIAL PERMIT AND SIDE SETBACK VARIANCE FOR ADDITION TO GARAGE AT 1000 VANCOUVER AVENUE, ZONED R-1 (JOSEPH AND JANETE BOXES, PROPERTY OWNER AND APPLICANT). Requests: If accessory structure was attached to the house would it need height and side setback variance; contact neighbors for comments, especially next to rear; building permit history. Item set for public hearing November 28, 1994. 4. SPECIAL PERMIT AND PARKING VARIANCE AT 1525 ADRIAN ROAD, ZONED M-1 (GARY HIRSCH, PROPERTY OWNER AND DESIGN -BUILD SOLUTIONS. APPLICANT. Requests: Clarify driveways; define exceptional circumstances; existing plan shows all compact stalls, try a redesign approach to show maximum standard stalls possible then ask for a variance for the lesser spaces; try diagonal parking approach; Public Works to address size of parking stalls; where is the ramp located; address 10' easement given to City, where is it shown on layout; historical prospective, how many parking spaces originally at this site; door somewhat covered, keep door area completely open ; what is the required space for handicapped access from parking space to sidewalk to walkway to front door. Item set for public hearing November 28, 1994 if all information is available. ACTION ITEMS Chairman Galligan informed all applicants for action items that the rulers of procedure for the commission require a minimum of 4 affirmative votes of the seated Commissioners in order to pass a motion; there are only 6 members seated tonight. If any applicant would prefer to be heard by a full commission, they may request a continuance. There were no such requests. 5. FRONT SETBACK VARIANCE AT 128 CLARENDON ROAD, ZONED R-1 (MEHMET DEMIRKOL, PROPERTY OWNER AND THOMAS W. THOMPSON. APPLICANTI. Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, 'Tanning Department comments, and study meeting questions. Three conditions were suggested for consideration. -2- Burlingame Planning Commission Minutes November 14, 1994 Chm. Galligan opened the public hearing. Tom Thompson, 19 So. Delaware, San Mateo discussed the plan check, demolition process and the timeframe in which he discovered the Planning Department required a variance. The house was already 3/4 torn down, just the core of the existing house will remain and there are financial restraints which is why the garage is being retained at its current location. There were no other public comments and the Public Hearing was closed. A letter expressing concern about the size and compatibility of new houses from Evelyn Thomas, 105 Dwight Way was read into the record. Commissioners discussed the extension of the windows and stairs into the setback. They also noted that if built as proposed this house would encroach on to the street much more than the other existing houses in the block. C. Deal noted this addition is much too close to the front, the code is written f'or the good of the community and this proposal is not in keeping with the intention of the statutes. He then moved denial of this application with the reasons stated. Motion was seconded by C. Mink and passed on a 6-0-1 (C. Key absent) voice vote. Appeal procedures were advised. Commissioners further stated that this a very large lot with other opportunities for development since the addition is essentially a new building and needs to meet the new codes. 6. PARKING VARIANCE FOR SINGLE STORY ADDITION AND ACCESSORY STRUCTURE AT 459 CUMBERLAND ROAD, ZONED R-1 (PETER AND PATRICIA NEDWICK, PROPERTY OWNERS, AND KEN IBARRA, APPLICANT). Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. Commissioners discussed the code definition of a bedroom: i.e., four walls at. least the window and a door. Each dwelling is allowed a living room, dining room and kitchen. The number of parking spaces is determined by the number of potential bedrooms. Two covered and one uncovered parking space are required for five or more bedrooms. The variance goes with the property. There was further discussion of exceptions for family rooms. The City Attorney explained that code is written as it is because of the problems caused by parking with large houses. Chm. Galligan opened the public hearing. Ken Ibarra and Peter Nedwick stated that they want the addition to fit into the existing house and to retain intact the front entrance and living areas adjacent to the garage. Landscape drawings clarifying the new accessory structure in the rear yard were presented to the commission. There were no other public comments and the Public Hearing was closed. 1911 Burlingame Planning Commission Minutes November 14, 1994 C. Jacobs noted this request is necessary for the preservation and property right of the applicant and is in keeping with the general plan. She then moved approval of this application, by resolution, with the following amended and added conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped October 27, 1994 sheets A.1, A.2, A.3, A.7 and landscape plan; 2) that the 280 SF accessory structure shall be used solely for storage that the only utility to this structure shall be electricity and that any use other than storage shall require a special permit from the Planning Commission; 3) that the requirements of the Chief Building Official's memo (10/31/94) shall be met; 4) that no other rooms meeting definition of bedroom shall be added without an amendment to this variance; and 5) that the project shall meet all the requirements of the Uniform building code and Uniform Fire Code as amended by the City of Burlingame. There was further discussion on the practical reasons for the granting of a variance. This property now has 39.8% lot coverage so there will not be much room for expansion without a variance and subsequent review. The motion was then seconded by C. Ellis and passed on a 5-1-1 (C.. Mink dissenting and C. Key absent) roll call vote. Appeal procedures were advised. The Commission adjourned for a 10 minute break at 8:55 P.M. and reconvened at 9:05 P.M. 7. VARIANCE FOR LOT SIZE, TENTATIVE AND FINAL PARCEL, MAPS TO RESUBDIVIDE EXISTING PARCELS INTO FOUR PARCELS AT 1500 TO 1650 BAYSHORE HIGHWAY, ZONED C-4 (CHRISTOPHER O. VEITCH, PROPERTY OWNER AND DANIEL G. MACLEOD, APPLICANT). CONTINUED TO NOVEMBER 28, 1994 8. SPECIAL PERMIT FOR RESIDENTIAL CARE FACILITY AT 1733 CALIFORNIA DRIVE, ZONED C-1 (CALIFORNIA DRIVE PARTNERS, PROPERTY OWNER AND JOHN CIMINO, JR., APPLICANT). Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Six conditions were suggested for consideration. Chm. Galligan opened the public hearing. Paul Gumbinger, architect and John Cimino, 1060 Carolan #101 were present to answer the commission's questions. The need for additional parking for residents is eliminated by the use of a van for the disabled. Vince Mussi, 766 El Camino spoke in favor of the project. There were no other comments and the public hearing was closed. C. Ellis noted this Negative Declaration is consistent with the general plan and based on the initial study and tonight's comments will have no adverse environmental impacts. This special permit for the proposed use will be located and conducted in a manner that is consistent with the zoning and will not be detrimental to the vicinity. He then moved approval of this negative declaration and special permit application, by City of Burlingame Planning Commission Agenda November 14, 1994 resolution, with findings incorporated by reference and with the following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped September 22, 1994, Sheets Al -0 Site Plan, Sheet Al -1 Site Plan (Illustration Only), Sheet A2-1 First Floor Plan, Sheet A2-2 Second Floor Plan, and Sheet A3-1 Elevations; 2) that the conditions of the City Engineers' September 23, 1994 memo and the Fire Marshals' September 24, 1994 memo shall be met; 3) that during demolition and construction all work must comply with Bay Area Air Quality Management District regulations; 4) that the business shall be open 24 hours a day, seven days a week, with a maximum of eight employees at any one time; 5) that documentation from a licensed acoustical engineer showing; the maximum noise level in any sleeping area shall not exceed 45 dBA, shall be included with the building permit application, and shall be reviewed and accepted by the City Engineer and Chief Building Inspector; and 6) that the project shall meet all the requirements of the Uniform building and Uniform Fire Codes as amended by the City of burlingame. Motion was seconded by C. Jacobs and passed on a 6-0-1 (C. Key absent) voice vote. Appeal procedures were advised. 9. TENTATIVE AND FINAL PARCEL MAP FOR A LOT SPLIT AT 1733 CALIFORNIA DRIVE, ZONED C-1 (CALIFORNIA DRIVE PARTNERS, PROPERTY OWNER AND JOHN CIMINO, JR., APPLICANT). Two conditions were suggested for consideration. Chm. Galligan opened the public hearing. There were no comments and the public hearing was closed. C. Jacobs moved recommendation of this Tentative and Final Parcel Map to City Council with the following conditions: 1) the existing building will need to be demolished before the filing of this map; and 2) this mapping action should be considered as a tentative and final parcel map for the: lot split to speed processing. Staff will see that the Final Map is properly prepared. Motion was seconded by C. Ellis and passed on a 6-0-1 (C. Key absent) voice vote. 10. SPECIAL PERMIT AND PARKING VARIANCE FOR AUTO STORAGE AND SALES AT 1327 MARSTEN ROAD, ZONED M-1 (JOHN MICHAEL, PROPERTY OWNER AND MICHAEL J. MOLONEY. APPLICANT). Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. The issue of washing cars on site was discussed, it was noted if done inside would need a sewer permit, cannot be done outside. -5- City of Burlingame Planning Commission Agenda November 14, 1994 Chm. Galligan opened the public hearing. Michael Moloney, 1220 El Camino, #3 was present and answered parking questions: customers will park inside, cars for sale will all be inside. The first year there will be 1-7 cars at one time, maximum number that will fit is 12. Commission asked that the Traffic, Parking and Safety Commission address the yellow zone. C. Jacobs then noted this request will not be detrimental to the general vicinity and the ;proposed use, at the proposed location, is in a manner in accord with the general plan. She then moved approval of these applications, by resolution, with the following amended conditions : 1) that the area used for automobile sale and storage (1828 SF) shall be as shown on the plans submitted to the Planning Department and date stamped September 23, 1994; 2) that the business shall operate by appointment only, with one employee and no more than six visitors to the site in any one day; 3) that prior to occupying this site, the applicant shall provide documentation to the Planning Department showing the requirements the; Chief Building Inspector's (9/21/94) and Fire Marshal's (9/26/94) memos have been met; 4) that there shall be no outside washing of cars; and 5) that the project shall meet al the requirements of the Uniform Building and Uniform fire codes as amended by the City of Burlingame. Motion was seconded by C. Ellis and passed on a 5-1-1 (C. Galligan dissenting and C. Key absent) roll call vote. 11. SPECIAL PERMIT AND PARKING VARIANCE FOR A COUNSELOR (HEALTH SERVICE) AT 405 PRIMROSE ROAD, SUITE #301, ZONED C-1, SUBAREA. B, (BERTRAM HORN, ET AL, PROPERTY OWNERS AND BARBARA SEIFER. APPLICANT). Reference staff report, 11/14/94, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Three conditions were suggested for consideration. Chm. Galligan opened the public hearing. Terry Horn and Barbara Seifer defined the hours of operation. There were no other comments and the public hearing was closed. C. Deal noted this request will not have a major impact on uses in this area. He then moved approval of this application, by resolution, with findings incorporated by reference and with the following conditions: 1) that the project shall be used as shown on the plans submitted to the Planning Department and date stamped November 1, 1994, General Site/Floor Plan; 2) that there shall be only one full time employee (the applicant) at the site at any time and that all appointments shall have a 10 to 15; minute break between them; and 3) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Jacobs and passed on a 6-0-1 (C.
