ROLL CALL Present: Absent: Staff Present: MINUTES AGENDA Commissioners Deal, Ellis, Galligan, Graham, Jacobs, Kelly, Mink None Margaret Monroe, City Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Keith Marshal, Fire Marshal Keith Marshal introduced Tina Anders, new fire fighter, who was welcomed by the Commission. The minutes of the April 12, 1993 meeting were unanimously approved. - The Chair noted Item #3 (hillside area construction permit, 2760 Burlingview Drive) has been continued to May 10, 1993 or to a time when revised plans have been reviewed by staff and neighbors and new markers placed on site. Item 18 (sign exception, 1302 Bayshore Highway) has been withdrawn. Order of the agenda was then approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. SPECIAL PERMIT AMENDMENT FOR LONG TERM AIRPORT PARKING AND SPECIAL PERMIT FOR LANDSCAPING AT 615 AIRPORT BOULEVARD ZONED C-4 Requests: ensure existing mature bushes are retained; clarify CE's comments regarding curb cuts; are parking stalls at the north end of the property disabled accessible stalls, are they part of the required parking. Item set for public hearing May 10, 1993. 2. SPECIAL PERMITS FOR CONSTRUCTION OF A DETACHED GARAGE AT 125 COSTA RICA AVENUE ZONED R-1 Requests: does backup space from both covered parking stalls meet code; attic space will be used for storage but is counted as floor space, is Burlingame Planning Commission Minutes Page 2 April 26, 1993 there a reason for this, explain calculations; think maximum interior height at the ridge in the storage area would be 6.51, check these calculations; bathroom encroaches into the 20' parking stall width, check this; structural shows post down the middle of the garage but not on floor plan, this should be shown on the floor plans or removed; confirm height of garage from grade; why is the existing structure on property line at 124 Occidental directly behind this site mentioned; find approximate height of other structures which will be adjacent to this garage on adjacent properties; what will new FAR be with the proposed second story and new garage. Item set for public hearing May 10, 1993. ITEMS FOR ACTION 3. HILLSIDE AREA CONSTRUCTION PERMIT FOR A NEW SINGLE FAMILY DWELLING AT 2760 BURLINGVIEW DRIVE, ZONED R-1 (PUBLIC HEARING CONTINUED FROM APRIL 12, 1993) Continued to the meeting of May 10, 1993 or to a time when revised plans have been submitted and reviewed, and new markers placed on site. 4. NEGATIVE DECLARATION AND CONDOMINIUM PERMIT FOR A NEW TWO STORY, 11 UNIT TOWNHOUSE PROJECT AT 1209-1211 BAYSWATER AVENUE, ZONED R-4 Reference staff report, 4/26/93, with attachments. CP Monroe reviewed details of the request, previous project which required side setback variances, was withdrawn and redesigned, staff comments, study meeting questions, required findings. Twelve conditions were suggested for consideration at the public hearing. Chm. Mink opened the public hearing. Tim Brosnan, property owner and applicant, and Neil Gabbay, architect, were present. In response to a question Mr. Brosnan advised there would be fencing along the property line and between private open space areas. There were no audience comments and the public hearing was closed. C. Deal found there is no substantial evidence that the project will have a significant (negative) effect on the environment and moved for approval of the amended negative declaration ND -458P. He found the project meets all the required condominium guidelines/ criteria and provides five extra parking spaces. C. Deal moved for approval of the condominium permit by resolution with the following conditions: (1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped March 11, 1993 Sheets Al, A2, A3, A4, A5, A6, A8, Tentative Map and Sheet PL -1 Landscape Plan, and April 1, 1993 Sheet A7; (2) that the conditions of the Fire Marshal's March 15, 1993 memo, Chief Building Inspector's March 29, 1993 memo, Parks Director's March 22, 1993 memo and Associate Civil Engineer's April 19, 1993 memo shall be met; (3) that a security system with an intercom to each unit shall be provided for access to the designated guest parking in the garage and a mirror shall be installed halfway down the garage Burlingame Planning Commission Minutes Page 3 April 26, 1993 ramp for vehicles exiting the garage to see oncoming cars; (4) that a total of five guest parking stalls shall be designated and marked on the final map and plans, and not assigned to any unit, but shall be owned and maintained by the condominium association; (5) that the final inspection shall be completed and a certificate of -occupancy issued before the close of escrow on the sale of each unit; (6) that the developer shall provide the initial purchaser of each unit and to the board of directors of the condominium association an owner/purchaser manual which shall contain the name and address of allcontractors who performed work on the project, copies of all warranties or guarantees of .appliances and fixtures and the estimated life expectancy of all depreciable component parts of the property, including but not limited to the roof, painting, common area carpets, drapes and furniture; (7) that the parking garage shall be designed to city standards and shall be managed and maintained by the condominium association to provide parking at no additional fee, solely for the condominium owners and their guests, and no portion of the parking area and aisles shall be converted to any other use than parking or used for any support activity such as storage units, utilities or other nonparking uses; (8) that the furnaces and water heaters shall be shown in a legal compartment outside of the required parking and landscaping and in conformance with zoning and Uniform Building Code and Uniform Fire Code requirements before a building permit is issued; (9) that for the protection of pedestrians a'silent auto warning system shall be installed at.access/egress to the parking area; (10) that the location of trash receptacles shall be approved by the City Engineer; (11) that a handicap/disabled ramp shall be installed in the stairs at the front entrance gate 'off Bayswater Avenue; and (12) that the project, including egress and access requirements, shall meet all the requirements of the municipal code and Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Kelly and approved 7-0 on roll call vote. Appeal procedures were advised. 5. TENTATIVE CONDOMINIUM MAP AND TENTATIVE AND FINAL PARCEL MAP FOR LOT COMBINATION, LOTS 11 AND 12 AND PORTION OF LOTS 15 AND 16, BLOCK 8, POLO FIELD SUBDIVISION - 1209-1211 BAYSWATER AVENUE Reference Associate CE's agenda memo, 4/26/93. CE Erbacher advised the parcel map may be considered as a tentative and final map, maps may be recommended to City Council for approval with two suggested conditions. Responding to a question, CE said a post construction survey will be done, once the building is constructed it will be measured as built for the final map. C. Jacobs moved to recommend to City Council approval of the tentative condominium map and tentative and final parcel map with the following conditions: (1) a parcel map. combining the two lots will need to be recorded prior to the issuance of a building permit; and (2) at least one of the dwelling structures will need to be removed prior to the Burlingame Planning Commission Minutes Page 4 April 26, 1993 filing of the lot combination parcel map. Motion was seconded by C. Graham and approved unanimously on voice vote. Staff will forward to Council. 6. SPECIAL PERMIT AMENDMENT FOR EXPANDED REAL ESTATE USE (TITLE INSURANCE COMPANY) AT 1408 CHAPIN AVENUE 12, ZONED C-1 SUB AREA B1 Reference staff report, 4/26/93, with attachments. CP Monroe reviewed details of the request, previous applications and existing uses on this site, required findings. Four conditions were- suggested for consideration at the public hearing. The Chair suggested a change to suggested condition 14 requiring review in June, 1994 rather than June, 1993. He then opened the public hearing. Steve Cohn, property owner, was present. He advised the entire building is occupied; there is only one exit, to the outside not to the interior, from the 228 SF conference room applicant wishes to add. There were no audience comments and the puplic hearing was closed. C. Graham found this would be a reduction in number of people on the site and would not be a substantial change in use. She moved for approval of the special permit. amendment by resolution with the following conditions: (1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped April 10, 1992 Sheets Al and A3 and March 25, 1993 Sheets Al and A3; (2) that the title insurance company shall operate Monday through Friday 8:00 A.M. to 5:00 P.M. with no more than four employees and no more than eight people on site at any one time; (3) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame; and (4) that the project shall be reviewed for compliance in June, 1994 or upon complaint. Motion was seconded by C. Ellis and approved 770 on roll call vote. Appeal procedures were advised. 7. SPECIAL PERMIT AND PARKING VARIANCE FOR A FOOD ESTABLISHMENT AT 1675 ROLLINS ROAD SUITE E ZONED M-1 Reference staff report, 4/26/93, with attachments. -CP Monroe reviewed details of the request, staff comments, study meeting questions, required findings. Six conditions were suggested for consideration at the public hearing. It was noted no variance application was included in the packet, however the parking variance was included in the notice mailed to property owners.in the area. Chm. Mink opened the public hearing. Ms. Ozkah, applicant and Carl Knudsen, building manager, representing Herbert Humber, property owner were present. Mr. Knudsen addressed findings for the parking variance: on any given day 10-15 parking spaces are unused, they have a number of small businesses in the Burlingame Planning Commission Minutes Page 5 April 26, 1993 building and do not need a large amount of parking, they will have one handicap stall in front of Suite E and will add a ramp, there is an extra bathroom, if it would help to get the square footage closer to 850 SF the landlord could designate this bathroom for the deli. They expect the deli's customers to be tenants/ visitors of --the building, do not expect people to drive to the deli; their parking survey indicated 10-15 spaces are regularly unused, there was a trucking company which parked trucks at the rear, those spaces are unused now; the 10' x 17' spaces were to code when put in, have always been there. There were no audience comments and the public hearing was closed. C. Deal found the size of the deli is not too small for the area, there is no need to add the restroom to increase square footage. Regarding the parking variance, not many people will drive to this deli, can see no problem with parking. C. Deal moved for approval of the special permit and parking variance by resolution with the following conditions: (1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped March 17, 1993: Floor Plan, Site Plan and Parking Plan, with a minimum square footage of 660 SF and no cooking facilities; (2) that at no time in the future may the deli/coffee shop expand the square footage of the operation beyond 660 SF or add any cooking facilities requiring venting and Fire Department approval without an amendment to this special use permit; (3) that the deli/coffee shop will be open Monday through Friday from 7:00 A.M. to 3:00 P.M. with a maximum of two employees; (4.) that the one handicap parking stall and a ramp into the main entrance to the deli shall be maintained at all times; (5) that all proposed signs shall receive the appropriate sign permit from the Planning Department and/or Planning Commission; and (6) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Galligan. Comment on the motion: it is unusual to see a building totally rented in the M-1 zone, do not need to worry about growth, can see no problem with parking; this proposal will not expand an existing use, it will be taking away some people who are working there, there could be more people on site with an office use. Motion was approved 7-0 on roll call vote. Appeal procedures were advised. 8. SIGN EXCEPTION FOR ROUND TABLE PIZZA AT 1302 BAYSHORE HIGHWAY, ZONED C-4 Application withdrawn. CP reminded Commission of the second Housing Element Workshop on Wednesday, May 5 at 7:30 P.M. ADJOURNMENT The meeting was adjourned at 8:34 P.M. in memory of Eva L.
