CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was
called to order by Chairman Deal on Tuesday, October 12, 1993 at 7:30
P.M.
ROLL CALL

Absent: Commissioner Mink

MINUTES - The minutes of the September 27, 1993 meeting were
unanimously approved.
AGENDA - Items 12 and 13 (Negative Declaration, Condominium
Permit and Tentative Map, 808-820 El Camino Real) and
Item 16 (Special Permit, 868 Burlway Road) were
continued to the meeting of October 25, 1993. Item 14
(Extension of Variances, 1420 Burlingame Avenue) was
moved to the end of the agenda. Order of the agenda was
then approved.
FROM THE FLOOR
There were no public comments.
ITEMS FOR ACTION
1. SPECIAL PERMIT FOR ACCESSORY STRUCTURE OVER 500 SF AT
836 FAIRFIELD ROAD, ZONED R-1
Reference staff report, 10/12/93, with attachments. CP Monroe
discussed details of the request, staff comments, required findings.
Letters in opposition were noted from the following: Virginia Hvid, 845
Paloma Avenue and Ludmilla Tripolski, 841 Paloma Avenue. Two
conditions were suggested for consideration at the public hearing.
A Commissioner discussed with staff definition of structure and asked
for clarification of how much of this deck was more than 30" above
grade and how staff had determined the 555 SF deck size.
Chm. Deal opened the public hearing. Christo and Olga Daskalakis,
applicants and property owners, were present. Speaking to the fact
that this is a code enforcement item, Mr. Daskalakis said they didn't

realize they needed a permit for the deck since it was in the rear 30%
of the lot, he noted they had taken out building permits for other
improvements to the property and will bring the deck up to building
code standards; previously there was nothing but a broken fence in this
area; they had told a neighbor at the rear about the deck and discussed
that the fence around the deck would protect his privacy; deck was
built by a contractor about three months ago. Commission discussed the
plans with applicants: it was determined the front of the deck is 6" up
from the concrete patio, the deck is built around the trees in the
back, they were very careful in placing the posts not to disturb the
roots of these trees, only trimmed dried out branches on a few low
hanging ones ; applicants were aware of the required building code
corrections and willing to do whatever is necessary.
There were no audience comments in favor. The following spoke in
opposition: Natalie Kanatoff-Mavridis, property owner, 837 Paloma
Avenue and Ludmilla Tripolski, 841 Paloma Avenue. Their concerns:
aesthetics, loss of privacy and seclusion. It was determined that no
trees/bushes were removed from the property of the neighbors on Paloma.
A Commissioner pointed out 7' fences are allowed in -the back yard, with
the existing fence privacy of adjacent properties will be protected.
Ms. Mavridis thought it was a comparison of looking at greenery or a
wooden structure. Ms. Tripolski was concerned about a livable deck -
which will provide space for more people and more trash. Responding to
a question she said no trees were removed from the property when the
deck was built.
There were no further audience comments and the public hearing was
closed.
C. Jacobs spoke of her site inspection and conversation with the
neighbor on the north side, she also inspected the easement, this
neighbor said the property has been upgraded, there had been a mess in
the easement and back yard in the past. C. Jacobs found the proposal
was not a problem, the house is a large house, lot coverage will not be
exceeded with the addition of the deck, greenery in the easement will
grow, the deck will upgrade the property, fence around deck will
provide privacy for the neighbors on Paloma.
C. Jacobs moved for approval of the special permit for an accessory
structure over 500 SF by resolution with the following conditions: (1)
that the project shall be built as per the Chief Building Inspector's
memo (September 27, 1993) and that the plans shall be reviewed and
approved by the Chief Building Inspector prior to the issuance of a
building permit; and (2) that the project shall meet all the
requirements of the Uniform Building and Uniform Fire Codes as amended
by the City of Burlingame.
Motion was seconded by C. Graham. Comment on the motion: if deck were
lowered applicants could have the same deck area and be within code; if
the deck area which is less than 30" above grade were subtracted from

the total the deck would be less than 500 SF; this .is a nice addition,
applicants must rebuild to building code; it is a big change to the
people on Paloma but basically would be allowed under the code with
just a building permit.
Motion was approved 6-0 on roll call vote, C. Mink absent. Appeal
procedures were advised.
2. NEGATIVE DECLARATION AND CONDOMINIUM PERMIT FOR A 19 UNIT
RESIDENTIAL CONDOMINIUM AT 808-820 EL CAMINO REAL. ZONED R-3

These items were continued to the meeting of October 25, 1993.
5. SPECIAL PERMIT FOR RETAIL SALES AT 302-304 LANG ROAD, ZONED M-1
Reference staff report, 10/12/93, with attachments. CP Monroe
summarized the request and reviewed staff comments, required findings.
Five conditions were suggested for consideration at 'the public hearing.
Chm. Deal opened the public hearing. Robert Miller, applicant, was
present. He noted they have been at 324 Lang Road for two years and
have had no problems, they would like an opportunity to fulfill their
dreams consolidating retail sales, manufacturing and storage at one
location; the corner lot will be more convenient for customers,
particularly from Coyote Point. Regarding sailboard painting, if there
are problems they will work them out with'the Fire Department.
Michael Engemann, 810 Alpine Avenue spoke in support: two sailboard
shops in the immediate vicinity have left, it would be nice to have one
nearby; he could see no problem with the Bay Area Air Quality
Management District since applicants have been manufacturing in
Mountain View. There were no further audience comments and the public
hearing was closed.
C. Graham found no problem with this request, the proposed use will not
be injurious or detrimental to property or improvements in the
vicinity, it will follow all guidelines of the city and other agencies.
C. Graham moved for approval of the special permit for retail sales by
resolution with the following conditions: (1) that the project shall be
built as shown on the plans submitted to the Planning Department and
date stamped September 17, 1993, General Floor Plan for 302-304 Lang
Road and Site Plan, 302 to 332 Lang Road, with 41 parking spaces on
site; (2) that the conditions of the Fire Marshal's September 20, 1993
memo shall be met; (3) that the sailboard shop will operate Monday
through Friday 12:00 P.M. to 6:00 P.M. and Saturday and Sunday 10:00
A.M. through 4:00 P.M. with a maximum of three employees at any one
time; (4) that the project shall meet the standards of the Bay Area Air

Quality Management District (BAAQMD) and the applicant shall submit
proof of that permit(s) and a copy of BAAQMD approved plans before
receiving a building permit; and (5) that the project shall meet all
the requirements of the Uniform Building and Uniform Fire Codes as
amended by the City of Burlingame.
Motion was seconded by C. Ellis with the comment this location will be
better than their present site at 724 Lang Road, it will be easier to
park on the corner, it is a good use for the location. Motion was
approved unanimously on voice vote, C. Mink absent. Appeal procedures
were advised.
6. SPECIAL PERMIT FOR AUTOMOBILE STORAGE AT 868 13URLWAY ROAD 0200,
ZONED M-1
Item continued to the meeting of October 25, 1993.
7. SPECIAL PERMIT FOR RADIO ANTENNA ON THE ROOF AT 1499 BAYSHORE
HIGHWAY, ZONED M-1
Reference staff report, 10/12/93, with attachments. CP Monroe reviewed
the request and required findings. Two conditions were suggested for
consideration at the public hearing. Responding to at question, CP said
this code enforcement matter was brought to Planning's attention by a
building inspector.
Chm. Deal opened the public hearing. David Aghighi, applicant, was
present. He said his branch of Waiters on Wheels just opened the
office in Burlingame, the business has been in operation in San
Francisco for five years; installation of the antenna was done by
Motorola and Bear Communications, Inc.; there are other antennas on the
building and perhaps these were the ones to which the building
inspector referred; their antenna is correctly and securely attached.
There were no audience comments and the public hearing was closed.
C. Jacobs commented the building inspector had good vision, it is very
difficult to see this antenna on the building. She moved for approval
of the special permit by resolution with the following conditions: (1)
that as installed the antenna shall meet all the requirements of the
Uniform Building and Uniform Fire Codes, including connections from the
antenna inside the building to the radio equipment; and (2) that the
antenna shall be removed. at the time this tenant relocates from this
suite and another use permit shall be obtained if the tenant relocates
within the same building or wishes to install a different antenna.
Motion was seconded by C. Kelly and approved unanimously on voice vote,
C. Mink absent. Appeal procedures were advised.

S. AMENDED MASTER SIGN PROGRAM AND SIGN EXCEPTION FOR NUMBER OF SIGNS
AT THE HYATT REGENCY, 1333 BAYSHORE HIGHWAY. ZONED C-4
Reference staff report, 10/12/93, with attachments. CP Monroe reviewed
the request, master sign program approved in 1988 and sign exception
approved in 1991, required findings. Two conditions were suggested for
consideration at the public hearing. Responding to a question CP
advised a reapplication would not be necessary if the names .on the two
canopy signs on either side of the main entrance were to change, but
they would be restricted to the same size as those approved in this
master sign program/sign exception.
Chm. Deal opened the public hearing. Bill Wagar, Hyatt Regency SFO,
applicant was present. He stated they wanted to balance the look at
the front of the hotel, adding the "Scalini" sign on one side to
balance the "Knuckles" sign on the other side of the main entrance; the
entrance to Knuckles is underneath the canopy, there isn't an entrance
on the Scalini side, customers will be directed after they enter the
hotel. There were no audience comments and the public hearing was
closed.
C. Jacobs commented she had always wondered why signs in front were not
balanced, this is a neat hotel, she found no problem locating this sign
at the front of the hotel. C. Jacobs moved for approval of the amended
master sign program and sign exception for number of signs at the Hyatt
Regency with the following conditions: (1) that the master sign program
shall be amended to include the 'Scalini' restaurant sign, a 15 SF
canopy sign, which shall be built as shown on the plans submitted to
the Planning Department and date stamped September 20, 1993 Sign
Elevation 'Scalini', Site Plan of sign locations, Photograph of canopy
location, and Awning Details (four sheets); and (2) that the project
shall meet all Uniform Building and Uniform Fire Code requirements as
amended by the City of Burlingame.
Motion was seconded by C. Kelly and approved unanimously on voice vote.
Appeal procedures were advised.
4. REQUEST FOR EXTENSION OF VARIANCES FOR FLOOR AREA RATIO AND
PARKING FOR A SEISMIC RETROFIT AND REMODEL AT 1420 BURLINGAME
AVENUE, ZONED C-1 BURLINGAME AVENUE COMMERCIAL AREA, SUB AREA A
Reference staff report, 10/12/93, with attachments. CP Monroe reviewed
the request and noted no public hearing is required, Planning
Commission should review the request and take action.
It was noted this request had been received subsequent to the
expiration date of the variance approval. CA advised consideration of
the request is at Commission's discretion. Applicant was not present.

C. Graham moved for approval of an extension to September 9, 1994 of
variances for floor area ratio and parking for a seismic retrofit and
remodel at 1420 Burlingame Avenue, seconded by C. Ellis and approved
5-1 on roll call vote, C. Jacobs voting no, C. Mink absent.
CP Monroe reviewed City Council actions and discussion at its October
4, 1993 regular meeting.
