ROLL CALL Present: Commissioners Ellis, Galligan, Jacobs, Kelly, Mink Absent: Commissioners Deal and Graham Staff Present: Margaret Monroe, City Planner; Jane Gomery, Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Ken Musso, Assistant Fire Chief MINUTES - The minutes of the November 22, 1993 meeting were unanimously approved. AGENDA - The order of the agenda was approved. CEREMONIAL Resolution of Commendation for Ann Sprague presented in recognition of her retirement after twenty years of service to the City as Planning Department Secretary and as recorder for the Planning Commission. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. SPECIAL PERMIT FOR SCHOOL DISTRICT OFFICES AT 1131-1141 VANCOUVER AVENUE, ZONED R-1 (BURLINGAME ELEMENTARY SCHOOL DISTRICT, PROPERTY OWNER AND APPLICANT). Requests: number of employees with each existing tenant; does trip generation chart include only school district personnel or tenants also, if only district personnel, please add tenants; ask average attendance for Board meetings. Item set for Public Hearing January 10, 1994. 2. AMENDMENT TO MASTER SIGN PROGRAM AND SIGN EXCEPTION AT 1160 PALOMA AVENUE, ZONED C-1 (KWOK WONG, PROPERTY OWNER. AND MAX FATEMI OF CLASSIC IMPORT RUGS, APPLICANT). Requests: sketch of whole sign -panel as existing & with tenant sign; master sign program responsibility of property owner, would like Burlingame Planning Commission Minutes Page 2 December 13, 1993 property owner specify actions proposed to enforce existing master sign program in an effort to bring other tenants into conformance with master sign program. Item set for Public Hearing January 10, 1994. - 3. SPECIAL PERMIT FOR CLASSES AT 1160 CAPUCHINO AVENUE, ZONED C-1 (DAVID AND ANNE HINCKLE, PROPERTY OWNERS AND LEdN CATCHATOORIAN, APPLICANT). Requests: clarify who uses parking lot behind; how existing parking in lot does not conform to current code dimensions; coffee shop proposed (application) how impact area; hours of business conflict with peak parking period; would applicant consider classes not start at noon; explore removable sign board referred to in letter; what are intentions and advise him of current sign code; check with Fire Department to review occupancy code and number in classes. Item set for Public Hearing January 10, 1994. The applicants were advised that 5 (of 7) Commission members were present. The rules require 4 affirmative votes to pass a motion on action items.- No applicants asked for a continuance. ITEMS FOR ACTION 4. SPECIAL PERMIT AMENDMENT AND PARKING VARIANCE TO EXPAND AN EXISTING RESTAURANT AT 224 PRIMROSE ROAD, ZONED C-1 SUBAREA A (MR. & MRS. FRANK DUFFIELD, PROPERTY OWNERS AND ANGELO DOKOS, APPLICANT. Reference staff report, 12/13/93, with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. If recommended to Council for approval, 6 conditions were suggested. Clarified history, eating establishment opportunity made available in December, 1992 when another- eating establishment closed. Use Permit requested for expansion. Fire Department clarified the second exit meets requirements but noted, if required access ceases to exist, the mezzanine restaurant use will have to be removed. C. Ellis questioned the variance requirements and noted the applicant had not identified any exceptional or extraordinary circumstances pertaining to the property. Acting Chm. Galligan opened the public hearing. James Verreos, 14 Corte Balboa, Millbrae, addressed the Commission, stated the additional usage would mainly be in.the evening hours and additional parking would be available in the evening at the public parking lot and at Wells Fargo across the street. C. Kelly asked what is extraordinary or exceptional about the property. Mr. Verreos stated that there is nothing exceptional about the property, however in order to use the mezzanine the parking variance would be required since there is no Burlingame Planning Commission Minutes Page 3 December 13, 1993 parking on site. There were no other audience comments and the public hearing was closed. C. Jacobs then moved to deny the application. Motion was seconded by C. Mink and approved on a 5 -0 -2 -voice vote, Crs. Deal and Graham absent. Appeal procedures were advised. 5. SPECIAL PERMITS FOR TESTING SERVICES AT 1200 HOWARD AVENUE, ZONED C-1 SUBAREA B (KING P. YEE, PROPERTY OWNER AND SCOTT W. BRENNAN, APPLICANT) . Reference staff report, 12/13/93, with attachments. CP Monroe discussed the request, review criteria, Planning Department comments, study meeting questions and conditions. Acting Chm. Galligan opened the applicant, answered questions from taken are FAA pilot licensure credential, insurance professional, vary from 1 to 4 hours. Ellis commented that this use is consistent with the intensity of other uses in the area and then moved to recommend approval of this special permit with the following conditions: (1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped, November 12, 1993 General Floor Plan; (2) that there will be no more than 1 proctor and 12 test takers on site at any one time and that an amendment of this special permit shall be necessary if any expansion is requested; (3) that the hours of operation will be from 9:00 A.M. to 5:00 P.M. Monday through Saturday and there shall be no more than 60 days per year where the hours of operation shall be extended from 7:00 A.M. to 10:00 P.M.; and 14) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Kelly and approved on a. 5-0-2 voice vote, Crs. Deal and Graham absent. Appeal procedures were advised. 6. AVERAGE FRONT SETBACK VARIANCE AT 1480 B OAK GROVE AVENUE, ZONED R-2 (ANGELO TAVERNA, PROPERTY OWNER AND APPLICANT) Reference staff report, 12/13/93, with attachments. CP Monroe discussed the request, review criteria, Planning Department comments, study meeting questions and 4 conditions. C. Ellis stated the applicant visited him and discussed a project, it is difficult to tell if this is the same project; C. Jacobs also spoke to the applicant, however, the application was not clear about what he was going to do; there were many questions about the location of the Burlingame Planning Commission Minutes Page 4 December 13, 1993 stairs and availability of light access to the existing units. The plans were unclear. Building Department will require clearer plans. Measurements not clear, width of lot not marked on plans. If this house is left out of average setback calculations the garage does meet setback requirements. Drawings inadequate. Architect, Maurice Keen, was not available for questions. Acting Chm. Galligan opened the public hearing. Angelo Taverna, 1480 Oak Grove, Burlingame, the applicant, spoke to the Commission. This is the oldest building in the City, moved to this site in 1960's. Would like to have a garage on his property and at the same time enlarge the living space in the 2 units. There were no other audience comments and the public hearing was closed. Commissioners discussed problems with the plans as submitted noting to act on application plans need to have proper dimensions, be clear about door locations and enclosures, show setbacks; without clearer plans cannot meet conditions to build according to plans,. Problem not with average setback, but with plans, benefit to bring parking•up to code but is addition out of character with other development in block, plans too poor to tell. The applicant was asked to show mature tree placement on future plan. C. Kelly then moved to deny approval of the application without prejudice directing the applicant to revise plans as discussed. Motion was seconded by C. Mink and approved on a 4-1-2 roll call vote, C. Galligan dissenting and Crs. Deal and Graham absent. Appeal procedures were advised. 7. SPECIAL PERMIT FOR REAL ESTATE USE AT 330 PRIMROSE ROAD SUITE 1606, ZONED C-1 SUBAREA A (EDWARD A. KEITH, .PROPERTY OWNER AND APPLICANT). Reference staff report, 12/13/93, with attachments. CP Monroe discussed the request, review criteria, Planning Department comments, study meeting questions.• If recommended to Council for approval, 3 conditions suggested. There were questions about the actual location (suite #) of the applicant and the number of employees. Code enforcement issues revealed during staff research were illustrative of what is going on in the building and do not relate to this applicant. Questions about number of employees; need complete application. Acting Chm. Galligan opened the public hearing. The: applicant was not in the audience, there were no comments, the public hearing was closed. C. Mink moved to continue the incomplete application. The motion was seconded by C. Jacobs. Mink then moved to deny approval of the application without prejudice directing the applicant to provide a full sixth floor floor plan showing clearly the used space and the other leased spaces on the floor. Motion was seconded by C. Kelly and approved on a 5-1-2 voice vote, C. Jacobs dissenting and Crs. Deal and Graham absent. Appeal procedures were advised. CP reviewed City Council actions/discussion at its December 6, 1993 - regular meeting.
