ROLL CALL Present: Commissioners Deal, Ellis, Galligan, Graham, Jacobs, Kelly, Mink Absent: None Staff Present: Margaret Monroe, City Planner; Jerry Coleman, City Attorney; Frank Erbacher, City Engineer; Bill Reilly, Fire Marshal MINUTES - The minutes of the March 23,. 1992 meeting were unanimously approved. AGENDA - Order of the agenda approved with the following changes: Item 19, variances, 1645 McDonald Way, continued to the meeting of May 11, 1992; Item #11, temporary trailer permit, 1450 Rollins Road, continued to the meeting of April 27, 1992; Item 112, tentative. parcel map, 2918 Adeline Drive, tabled. ITEMS FOR STUDY 1. SIDE SETBACK AND PARKING VARIANCES FOR A FIRST FLOOR REMODEL AND A NEW SECOND FLOOR ADDITION AT 1468 CABRILLO AVENUE. ZONED R-1 Requests: what is being retained, this appears to be a total reconstruction rather than remodel; amount of existing and new foundation; actual size of the garage; is it feasible to add another 2' to the garage to meet code requirement. Item set for public hearing April 27, 1992. 2. HILLSIDE AREA CONSTRUCTION PERMIT AND PARKING VARIANCE TO EXTEND THE FIRST FLOOR OF AN EXISTING SINGLE STORY RESIDENCE AT 1813 LOYOLA DRIVE, ZONED R-1 Requests: number of bathrooms with the proposed addition; can applicant extend the paved parking farther back on the lot on the east side in order to get the car out of the front setback area; will there be any grading associated with the parking pad. HILLSIDE AREA CONSTRUCTION PERMIT FOR A PARTIAL, FIRST FLOOR AND A NEW SECOND STORY ADDITION AT 2700 SUMMIT DRIVE, ZONED R-1 Requests: will the existing satellite dish antenna be included in the notice of hearing; show the existing ridge with a clotted line on the plans; provide poles with flags to indicate the proposed addition; neighbors within 300 feet may not be impacted, suggest properties on the uphill block of Summit Drive also be noticed. Item set for public hearing April 27, 1992. 4. FOUR SPECIAL PERMITS, LOT COVERAGE AND PARKING VARIANCES FOR IMPROVEMENTS AT 1720 SHERMAN AVENUE. ZONED R-1 Requests: do the records show why there was no building permit for the carport; reason for the photographs of other garages; drawing/sketch of the 1969 carport and, progressively, drawings of the additions; what are the exceptional circumstances to support the variance requests; if cars are being repaired on site how is the oil disposed of; confirm the need for the variance for tandem parking; there is potential for a second unit, what measures does the applicant propose to prevent that occurring. Item set for public hearing April 27, 1992. 5. SIGN EXCEPTION AND A MASTER SIGNAGE PROGRAM FOR BURLINGAME AUTOMOTIVE MANAGEMENT AT 1017, 1019 AND 1025 ROLLINS ROAD, ZONED C-2 Requests: concern that the readerboard may have off -premise advertising similar to the Acura readerboard, can this be addressed in the conditions; include in the staff report language in the sign code regarding freeway oriented signage and in the vehicle code regarding flashing signs; how often will the message change, what is a glow cube. Item set for public hearing April 27, 1992. 6. SPECIAL PERMIT FOR A TAKE-OUT RESTAURANT AT 1302 BAYSHORE HIGHWAY, ZONED C-4 Requests: total number of suites in this complex; accurate parking layout; why are parking stalls shown in the fire lane; there are more stalls shown on the plans than exist on the site; is there any other take-out business in the area; how will the business be split between take-out and service on the site. Item set for public hearing April 27, 1992. 7. SPECIAL PERMIT FOR EMBALMING AND REFRIGERATED HOLDING FACILITY AT 1280 ROLLINS ROAD, ZONED M-1 Requests: is this the same business that was in San Mateo; are there restrictions regarding disposal of body fluids and discharge into the sewer system; is Nerli Lane open and fire access satisfactory; explain the relationship between the San Mateo establishment and the Burlingame facility. REAR SETBACK AND PARKING VARIANCES FOR A FIRST FLOOR ADDITION TO AN EXISTING TWO STORY HOUSE AT 2327 HALE DRIVE. ZONED R-1 Reference staff report, 4/13/92, with attachments. CP Monroe reviewed details of the request, staff review, applicant's statements in the application, required findings. Three conditions were suggested for consideration at the public hearing. Tim Connor, applicant, was present. He stated they want to add a bedroom and bath to the existing house, the addition will fill a nook in the rear yard which is not usable, it cannot be seven from the front; the house has four bedrooms now but two of them are very small, they would like something bigger; they need a bedroom with bath on the lower floor for family visitors who cannot use the stairs. Responding to Commissioner questions, applicant said he has owned the property two to three weeks, the laundry room approved in 1990 is not a usable area; there is room in the garage for two cars and they can put a third car in the driveway; the only change he is requesting is adding a bedroom at the rear on the ground floor, the only other work they have done is to remodel the interior of a bathroom on the second floor. There were no audience comments in favor. Mary Joe Hernandez, daughter of Dorothy Norling, 2325 Hale Drive read a letter (April 13, 1992) from Mrs. Norling in opposition. This letter discussed additions and development on this site resulting in a 4' rear setback and loss of sunlight to the neighbors, the present request to bring the house in line with the garage 4' from property line is going too far, a second story could be added to this addition. Mrs. Norling commented other neighbors share her concern about the large homes being built in the area which seem disproportionate to the lots and with additional traffic, they feel setback regulations should be adhered to. Ms. Hernandez added her comments: the plan as presented is deceiving, only 105 SF but that is in addition to what has been added previously; for the last two years the site has had construction going on, neighbors have already lost sunlight to their kitchen and diming areas. There were no further audience comments and the public hearing was closed. C. Deal advised he would abstain from discussion and voting on this project . C. Jacobs stated she had a problem with the very short driveway for uncovered parking and with enlargement of this big house, she questioned if anything could be parked in the driveway space and commented there are other ways to get what the applicant needs without further impacting the neighbor. For these reasons C. Jacobs moved for denial of the variances. Motion was seconded by C. Graham with the comment that while the side is termed the rear, in essence it is the side, present code requires 7' for the side setback and even this 7' is Burlingame Planning Commission Minutes Page 4 April 13, 1992 not met by this addition, there will be a big impact on the neighbor, almost doubling the size of the mass now at this location on the lot, there is plenty of room upstairs which could be used. Motion for denial was approved on a 6-0 roll call vote, C. Deal abstaining. Appeal procedures were advised. 9. LOT COVERAGE AND TWO PARKING VARIANCES FOR A FIRST AND SECOND FLOOR ADDITION TO AN EXISTING RESIDENCE AT 1645 MCDONALD WAY, ZONED R-1 Item continued to the meeting of May 11, 1992. 10. HILLSIDE AREA CONSTRUCTION PERMIT TO ADD A DECK AND SPA AT 27 ELLS CANYON COURT, ZONED R-1 Reference staff report, 4/13/92, with attachments. CP Monroe reviewed details of .the request, history of remodeling work since 1988, staff review, applicant's letter, required findings, study meeting questions. Four conditions were suggested for consideration at the public hearing. Commission/staff discussed penalty fees; a Commissioner suggested Condition 13 be tied to submittal for plan check and a time limit set for submitting for a building permit for the stair, deck and spa. Chm. Kelly opened the public hearing. Henry Yanaga, architect representing the property owners, was present. He advised the illegal enclosure under the driveway was found by a building inspector, they were told to remove it and did so. There were no audience comments and the public hearing was closed. C. Jacobs found no problem with this application, staff has clarified history of remodeling work, the suggested conditions will correct everything; no views will be obstructed. C. Jacobs :moved for approval of the hillside area construction permit with the following conditions: (1) that the stair, deck and spa shall be built as shown on the plans submitted to the Planning Department and date stamped February 20, 1992; (2) that the property owner or his representative shall renew or get a new building permit (as necessary) for the bedroom -bath -remodel project of 1988, Building Permit 15735, and shall call for a final inspection within 10 days -"of the approval of the hillside area construction permit for the deck, spa and stairs; (3) that the property owner or his representative shall make application for a building permit, correct plans as required to meet current Uniform Building and Uniform Fire Code requirements and apply for a building permit for the stair, deck and spa within 10 'days; the construction including any corrective work shall be completed, final inspection called for and all required corrections made within 30 days of approval of the hillside area construction permit; and (4) that full penalty fees shall be charged for all retroactive and renewed permits required by current Burlingame Planning Commission Minutes Page 5 April 13, 1992 City of Burlingame regulations for both the bedroom -bathroom interior remodel permit and the stair, deck and built-in spa permit. Motion was seconded by C. Graham and approved on a 7-0 roll call vote. Appeal procedures were advised. 11. TEMPORARY TRAILER PERMIT FOR BIOCIRCUITS CORPORATION AT 1450 ROLLINS ROAD, ZONED M-1 Item continued to the meeting of April 27, 1992. 12. TENTATIVE PARCEL MAP, 2918 ADELINE DRIVE, ZONED R-1 This item was tabled and will be renoticed. 13. REVIEW OF REORGANIZATION OF THE ZONING ORDINANCE AND NEW REGULATIONS AND RECOMMENDATIONS_TO CITY COUNCIL Reference staff report, 3/18/92, with attachments. CP Monroe reviewed the proposed reorganization, resulting editing and clarification of the text including taking out items no longer relevant or covered in other codes, and new regulations for calculating lot coverage, bay windows and greenhouse windows. The Planning Commission discussed the reorganization and changes. In addition to suggesting some editorial modifications to the text they clarified the requirements for calculating when eaves would be exempt from lot coverage (up to 24 inches), when fireplace chimneys would be exempted from lot coverage and setbacks (maximum depth of two feet and maximum width of six feet), clarified that the declining height envelope shall be measured from original existing grade and modified the second story exemption from the declining height envelope so that it does not apply when any part of the second floor of the adjacent two story house complies with the declining height envelope measurement. Chm. Kelly opened the public hearing_. There were no audience comments and the public hearing was closed. C. Jacobs moved to recommend to City Council the proposed revisions to Title 25, Zoning of the Municipal Code including changes suggested this evening., Motion was seconded by C.
