ROLL CALL Present: Commissioners Ellis, Garcia, Giomi, H. Graham, S. Graham, Harrison, Jacobs Absent: None Staff Present: Margaret Monroe, City Planner; Jerome Coleman, City Attorney; Frank Erbacher, City Engineer MINUTES - The minutes of the November 23, 1987 meeting were unanimously approved. AGENDA - Order of the agenda approved. ITEMS FOR ACTION 1. FENCE EXCEPTION FOR A 7' HIGH FENCE ALONG THE SIDE AND REAR PROPERTY LINES AT 1512 HIGHWAY ROAD. ZONED R-1 Reference staff report, 12/14/87, with attachments. CP Monroe reviewed details of the request, staff review, Planning staff comment, applicant's letters, study meeting questions, code requirements for granting a fence exception. Letter in support from Anna B. Alexander, 1504 Highway Road received December 14, 1987 was noted. Three conditions were suggested for consideration at the public hearing. Chm. Giomi opened the public hearing. Applicant, John Diserens, was present. He submitted two letters in support from the adjacent property owners: Mildred and Alex Hanson, 1516 Highway Road and Frances Lisa, 1508 Highway Road. His comments: he is replacing a dilapidated wire fence installed many years ago; he conferred with a licensed contractor about the design, then discussed the plans with his three neighbors all of whom approved; the neighbors were kept informed of difficulties encountered during construction which lengthened installation time. Commission/applicant discussion: the reason applicant requested a 7' fence was to shield the view from his deck into the neighbor's yard and an unsightly driveway to the rear. A Commissioner pointed out applicant's deck is elevated, if it were at ground level he would not have this problem. Applicant stated he liked the latticework on the top of the fence and wanted as high a fence as possible; he had assumed contractor would get all necessary city permits. There were no audience comments and the public hearing was closed. Commission comment: fence is attractive, have no objection, but have a problem with the required finding of exceptional circumstances. With the statement she could not find exceptional circumstances with this property since the applicant is asking for Page 2 Burlingame Planning Commission Minutes December 14, 1987 privacy on his deck but the deck is elevated, he could have built a lower deck, approval could be precedent setting, C. Jacobs moved to deny the fence exception. Second C. Ellis. Motion to deny approved on a 6-1 roll call vote, C. S.Graham dissenting. Appeal procedures were advised. 2. TENTATIVE CONDOMINIUM MAP EXTENSION, LOT 14, BLOCK 7, MAP NO. 2, BURLINGAME LAND COMPANY, 623 ANSEL ROAD Reference agenda memo, 12/8/87. CE Erbacher reviewed this request, no condominium permit extension is needed since the project is under construction. C. Harrison moved for approval of a one year extension of this tentative condominium map to January 6, 1989. Motion was seconded by C. H.Graham and approved unanimously on roll call vote. Appeal procedures were advised. 3. SPECIAL PERMIT FOR A 12' HIGH, 10' DIAMETER GROUND MOUNTED SATELLITE DISH ANTENNA AT THE IBIS HOTEL, 835 AIRPORT BOULEVARD, ZONED C-4 Reference staff report, 12/14/87, with attachments. CP Monroe reviewed details of the request, staff review, City Planner comment, applicant's letter, study meeting questions. Four conditions were suggested for consideration at the public hearing. Staff advised requirements of the CBI's memo would be automatically included in the building permit. Chm. Giomi opened the public hearing. The district manager of Spectradyne, Inc. (company installing the antenna) was present representing Axel Hochkoeppler, general manager, Ibis Hotel (applicant). He advised the dish will sit in a fixed position, it will not rotate. There were no audience comments and the public hearing was closed. With the statement this antenna will not be visible to the public, C. Jacobs moved for approval of the special permit and for adoption of Commission Resolution Approving Special Permits with the following conditions: (1) that the 10' diameter satellite dish antenna shall be installed at the location shown on the plans submitted to the Planning Department and date stamped November 10, 1987; (2) that no part of the satellite dish antenna shall rise more than 12' above grade and the dish antenna shall be painted the same color as the hotel; (3) that the satellite dish antenna's surface shall be nonreflective and the property owner shall be responsible for maintaining this nonreflective surface; and (4) that a building permit shall be obtained before the satellite dish antenna is installed and any changes in the size, height or location of this antenna shall require an amendment to this use permit. Second C. S.Graham. Comment on the motion: think the top of the building would be a better location but will vote in favor. Motion was approved on a 7-0 roll call vote. SPECIAL PERMIT — INFANT/TODDLER DAY CARE CENTER = 707 EL CAMINO REAL Requests: what church activities occur at the same time, particularly those which might affect parking/traffic; what did the license for the school include; how will arrival and departure of the children be regulated; why is this special permit different from the permit for the school; does the day care center plan to expand in the future if successful; does the figure of 100 people on Saturday/Sunday refer to the total site. Item set for public hearing January 11, 1988. 5. DETERMINATION REGARDING WHETHER PROVIDING -AN ELEVATOR TO MEET STATE HANDICAP REQUIREMENTS WILL IMPOSE AN UNREASONABLE HARDSHIP, AT 852 EDGEHILL DRIVE Staff will ask applicant to provide information on what proportion of the total cost of construction the elevator would be. Commission requests: what type of retail will be going into this building; type of elevator; what kind of residential use will be located there, residential care or apartments; review height of the building; regarding applicant's statement that one scheme for incorporating an elevator would require extension into the hill which would present safety concerns, has applicant had soils report done, what is the basis for this statement. Item set for public hearing January 11, 1988. 6. SPECIAL PERMIT - TELEVISION ANTENNA ON THE ROOF OF THE HYATT HOTEL - 1333 BAYSHORE HIGHWAY Requests: is applicant planning to install a satellite dish antenna also and, if so, why separate applications; compliance with FAA standards; why can't cable TV service be used; will there be a fee to guests for use of the TV. Item set for public hearing January 11, 1988. 7. SIGN EXCEPTION - HYATT HOTEL - 1333 BAYSHORE HIGHWAY Requests: comparative table of hotel signage; will existing readerboard be removed; timing of completion of the freeway entrance and erection of this signage. Item set for public hearing January 11, 1988. PLANNER REPORTS Review of R-1 Zoning Regulations There was no discussion of the CP's memo reviewing alternatives for addressing problems of air, light and privacy as they relate to bulk and mass in new single family construction and in substantial remodels of single family houses. City Council has directed these problems be examined at their study session on January 20, 1988. - C. Ellis reviewed Council actions at its December 7, 1987 regular meeting.
