CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was
called to order by Chairman Graham on Monday, January 28, 1985 at
7:30 P.M. -
ROLL CALL
Present: Commissioners Garcia, Giomi, Graham, Jacobs, Leahy,
Schwalm, Taylor
Absent: None

MINUTES - The minutes of the January 14, 1985 meeting were
unanimously approved.
AGENDA - Items #2, #3 and #4 continued to the meeting of February 11,
1985; order of the agenda approved.
ITEMS FOR ACTION
1. SPECIAL PERMIT TO ALLOW A 200 SF ADDITION TO A 400 SF CARPORT AT
760 WALNUT AVENUE, BY J. D. MC CARTHY FOR JAMES POPIN
CP Monroe reviewed this request for an addition to a carport which
will cause total area to exceed 500 SF. Reference staff report,
1/28/85; Project Application & CEQA Assessment received 12/13/84;
J. D. McCarthy letter, December 11, 1984; staff review: Chief Building
Inspector (12/17/84), Fire Chief (12/14/84), City Engineer (1/9/85);
study meeting minutes, 1/14/85; aerial photograph; notice of hearing
mailed 1/18/85; Resolution SP/3-85 Approving Special Permit; plans
date stamped December 13, 1984. CP discussed details of the request,
code requirements, staff review, Planning staff comments on recent
subdivision of this site. Two conditions were suggested for
consideration at the public hearing.
Discussion: existing slab and backup area of 201. Chm. Graham opened
the public hearing. James Popin, property owner and his
representative, J. D. McCarthy were present. There were no audience
comments and the public hearing was closed.
Commission comment: this site abuts the R-3 zone at the rear; addition
is in the backyard, would have little impact on the neighbors and
cannot be seen from the street.
C. Giomi moved for approval of this special permit and for adoption of
Planning Commission Resolution SP/3-85 with the following conditions:

(1) that the carport addition shall be limited to a 10' x 20' covering
over the existing slab built according to the standards of the Uniform
Building Code; and (2) that the closest edge of the slab for the
carport be no closer to the property line on the driveway side of the
lot than 201. Second C. Leahy; motion approved on a 6-1 roll call
vote, C. Jacobs dissenting. Appeal procedures were advised. -
2/3/4. GENERAL PLAN AMENDMENT, REZONE AND TWO SPECIAL PERMITS -
SENIOR RESIDENTIAL FACILITY - 1221 BAYSWATER AVENUE
Items continued to action on February 11, 1985.
5. SPECIAL PERMIT TO ALLOW A ROOFTOP DISH ANTENNA LOCATED AT 1460
BURLINGAME AVENUE TO SERVE 1462 BURLINGAME AVENUE, ZONED C-1,
BY GARY ANDRIENI WITH RAIMUND WURLITZER
CP Monroe reviewed this request to allow an existing satellite dish
antenna located on the roof of 1460 Burlingame Avenue. Reference
staff report, 1/28/85; Project Application & CEQA Assessment received
11/29/84; copy of Municipal Code Chap. 18.18 Radio and Television
Antennas; Gary Andrieni letter, November 15, 1984 with drawings
detailing placement and dimensions of the antenna installation;
photographs of the site; Continental Satellite Systems brochure; staff
review: Fire Chief (12/12/84), Chief Building Inspector (12/17/84),
City Engineer (1/9/85); Towber letters to Andrieni, 12/14/84 and 1/4/
85; block map; study meeting minutes, 1/14/85; aerial photograph;
notice of hearing mailed 1/18/85; Resolution 4-85 Approving Special
Permit. CP noted letter confirming property owner's consent to the
application received in the Planning Department today and discussed
details of the request, applicant's letter, code requirements for
antennas, location of this installation. Five conditions were
suggested for consideration at the public hearing.
Discussion: the fact that this is a code enforcement item, antenna was
installed without a use permit or a building permit, it must be
removed if Commission does not approve the special permit; if any part
of the antenna is found to extend over a property line written consent
of all property owners involved will be necessary prior to issuance of
a building permit; concern that much of the information requested at
the study meeting had not been received.
Chm. Graham opened the public hearing. The applicant, Gary Andrieni
was present. Mr. Gilmore, his representative, told Commission that
manufacturer's technical data had been furnished, he felt the same
wind effect would apply on the ground or on the roof. There were no
audience comments and the public hearing was closed.
Commission discussion: how can we grant this use permit without all
pertinent information; the applicant has not abided by the city
ordinances, what is he advising his clients; suggest building permit
be clearly conditioned to meet city engineering standards; concern
about the size of this antenna when viewed from the west side of

E1 Camino Real; if satellite antennas are to be allowed this is the
size the city will be considering with present technology; applicant
advised he sells video equipment; the dish does not replace an antenna,
it brings in signals directly from a satellite and increases the
number of channels; he has not sold any in Burlingame but has put up
several in Hillsborough conforming to that town's criteria; he does
his own invoicing, has installed some himself, some on contract.
Further comment: this application violates three of the code criteria
for antennas, do not find this acceptable; have no problem with the
size, appears to be no worse than most antennas on homes in
Burlingame; since City Engineer will require removal and
reinstallation, location of the dish could be moved at that time.
C. Schwalm moved for approval of this special permit and for adoption
of Planning Commission Resolution SP/4-85 with the following
conditions: (1) that the conditions of the Chief Building Inspector's
memo of December 17, 1984 and the City Engineer's memo of January 9,
1985 be met; (2) that the city receive written permission from the
property owner, Mr. Wurlitzer, for the location of the antenna on the
roof of 1460 Burlingame Avenue to serve the property at
1462 Burlingame Avenue; (3) that a building permit be issued for
installation, this permit to be applied for and granted within 30 days
following the effective date of the special permit; (4) that all parts
of the dish to serve 1462 Burlingame Avenue be wholly located on the
property owned by Mr. Wurlitzer at 1460 Burlingame Avenue or
permission be gained from all property owners affected; and (5) that
this antenna shall be removed when the retail video use is terminated
at 1462 Burlingame Avenue. Second C. Taylor; motion approved on a 5-2
roll call vote, Cers Jacobs and Leahy dissenting. Appeal procedures
were advised.
6. SPECIAL PERMIT TO ALLOW AN OFFICE EXPANSION AND A VARIANCE TO
LANDSCAPE REQUIREMENTS AT 1660 ROLLINS ROAD, ZONED M-1, BY
H. J. WINTSCH (APPLICANT AND PROPERTY OWNER)
CP Monroe reviewed this request for a 1,220 SF office space addition
to a warehouse building and for a variance to reduce landscaping.

Letter in support (January 21, 1985) from Arthur Zanello, owner of
1718 Rollins Road was noted by staff. Discussion: parking requirement
if this structure were entirely warehouse; height limit in the M-1
zone.

Chm. Graham opened the public hearing. Applicant was present. There
were no audience comments and the public hearing was closed.
Commission discussion: of the 21 present employees, only 14 are on
site at one time; there are 12 on-site parking spaces; City Council's
desire to retain warehouse facilities in the M-1 area and reluctance
to allow more intense office use, this request is inconsistent with
planning objectives of the city, can find no compelling reason to
approve, it would be a significant change from warehouse to office.
Applicant advised existing parking spaces are marked and employees do
use them, they have explored other possibilities for the addition but
none were feasible. Commission expressed concern about further loss
of landscaping; should stay with the 10% requirement to make the area
more attractive; would not want to set a precedent by allowing the
variance to landscape requirements; feel the 20% office space
restriction in the code was to prevent conversion of warehouses into
office, in this case will not be losing any warehouse space but will
be adding office and losing landscaping.
C. Giomi moved for denial of the special permit. Second C. Taylor;
motion approved on a 7-0 roll call vote. C. Jacobs moved to deny the
variance. Second C. Giomi; motion approved on a 7-0 roll call vote.
Appeal procedures were advised.
7. SPECIAL PERMIT AND PARKING VARIANCE TO ALLOW A CAR RENTAL
OPERATION AT THE RAMADA INN, 1250 BAYSHORE HIGHWAY, ZONED C-4,
BY CALIFORNIA COMPACTS RENT A CAR WITH RAMADA INNS, INC.
CP Monroe reviewed this request to locate a car rental business at the
Ramada Inn. Reference staff report, 1/28/85; Project Application &

Six conditions were suggested for consideration at the public
hearing.
Chm. Graham opened the public hearing. Betty Jenkins, representing
the applicant, was present. There were no audience comments and the
hearing was closed.
Commission discussion: no fixed signage is proposed, applicant wants
to use portable signs on the side or roof of their courtesy vehicle.
Applicant's representative advised they are looking for a larger site
to handle a complete operation, the present site would help them get
started at a San Francisco International Airport location, they serve

trainees of computer training departments in Santa Clara County who
arrive at SFIA rather than San Jose airport; California Compacts is
not a large firm and have lower prices; their experience has been that
never more than one-third of the fleet would be on the lot at one
time; customers would take the rental cars to Santa Clara County and
stay in that area unless there were a shortage of hotel rooms; plans
are for one manager and one part time employee at the Ramada site.
Further Commission comment: the condition that all rental contracts
be written in Burlingame; at present approximately 30% of California
Compacts' rental business is generated by Silicon Valley trainees,
they hope to increase this with a site near SFIA. One Commissioner
found difficulty in demonstrating hardship to support the parking
variance for this new operation, hardship might be found if and when a
request for expansion was made. It was suggested a condition be added
that no signs be attached to the roof of any vehicle.
C. Jacobs found the variance request was a small one and controllable
under the conditions attached to the permit, that it would allow car
rental at the Ramada Inn but would not have an adverse impact on
traffic in the area, and that it would not adversely affect the
comprehensive zoning plan of the city. C. Jacobs moved for approval
of the special permit and parking variance and for adoption of
Commission Resolution No. SP/5-85 with the following conditions:
(1) that the conditions of the City Engineer's memo of January 9, 1985
be met; (2) that the car rental use be operated as described in the
Rent A Car Questionnaire dated December 10, 1984 with no on-site fixed
signage, a fleet not to exceed 15 cars, no maintenance, preparation or
washing of cars done on site, and as further described in the December
15, 1984 and January 18, 1985 letters from Beverly Webster represent-
ing California Compacts Rent A Car; (3) that there be no changes to
this operation as above described including increasing the five
designated parking spaces or fleet size of 15 without amendment to
this use permit granted by the Planning Commission; (4) that should
this site be reused or the existing hotel use intensified, this use
permit would be automatically discontinued; (5) that all rental
contracts for cars picked up at 1250 Bayshore Highway shall be written
in the City of Burlingame; (6) that this use permit shall be reviewed
for compliance in six months (July 1985) and again in one year (July
1986); and (7) that no signs be attached to the roof of any vehicle.
Second C. Garcia; motion approved on a 6-1 roll call vote, C. Graham
dissenting. Appeal procedures were advised.
8. REGULATION OF RESTAURANTS IN SUB -AREA A OF THE BURLINGAME
AVENUE COMMERCIAL AREA AND IN THE BROADWAY COMMERCIAL AREA
EXTENDED TO CALIFORNIA DRIVE BETWEEN RHINETTE AND CARMELITA
CP Monroe reviewed this item, referring to Council's adoption of an
urgency ordinance establishing a moratorium on restaurants in the
above areas. Reference staff report, 1/28/85; Towber memo, Update of

Burlingame Avenue Commercial Area and Broadway commercial area. CP
noted discussion in the staff report regarding what Commission's
recommendation to Council should address, Planning staff's update of
the 1982 restaurant survey and the need for a specific definition of
restaurant in the code.
Discussion: staff's formula for measuring density in its restaurant
update; specific area covered by the moratorium. Chm. Graham opened
the public hearing. Cyrus McMillan, attorney representing the owner
of property on the corner of Lorton and Burlingame Avenue, addressed
Commission: he contended that the ordinance definition of eating
establishment as "any business which sells food at retail and contains
seating for more than four members of the public" was too restrictive
and suggested 10 seats rather than four; he was in support of review
by a use permit procedure. There were no further audience comments
and Chm. Graham continued the public hearing to the meeting of
February 11, 1985. Staff was requested to notice this hearing in a
newspaper of general circulation.
Commission discussion: request was made for a list of restaurant sites
and number of seats in each; if a density criteria is used, need to
define the measuring formula and administrative procedures for
existing restaurants; explore a "freeze"; possibility of a temporary
prohibition, staying with the present ratio until further studies can
be made; suggest use of a consultant to study traffic generation and
the current parking problem; what criteria would be used for
consideration of a special permit; feel the number of restaurants does
have a direct bearing on parking and can be dead space in the downtown
streetscape; think the city should first consider whether restaurants
should be regulated at all, have not seen any evidence to support
regulation; would like figures on increase in new restaurants.

Requests: setback of wall, is wall adding a patio, height of

remain, drainage, history of the site. Item set for hearing February
11, 1985.

Requests: clarify second exit, designated guest spaces, impact on
