ROLL CALL Present: Commissioners Garcia, Giomi, Graham, Jacobs, Leahy, Schwalm, Taylor Absent: None Staff Present: City Planner Margaret Monroe MINUTES - The minutes of the July 8, 1984 meeting were unanimously approved with the following correction: C. Graham seconded the motion for item number one. This information to be added to the minutes. AGENDA - Order of the agenda approved. PUBLIC HEARING 1. REVIEW OF DEIR-63P FOR THE OFFICE/AUTO RETAIL CONVERSION OF THE OLD BEKIN'S STORAGE BUILDING AT 1070 BROADWAY C. Taylor excused himself from review of this item due to conflict of interest. He left the podium. Chm. Garcia introduced this item. CP Monroe discussed the draft EIR and explained that comments taken at tonight's meeting will be incorporated into the final document. Reference CP staff report, 7/22/85, and attached copies of comments from responsible agencies on the proposal. She introduced Joyce Hsiao, consultant, who further discussed the project (code requirements which were exceeded, cross-section drawings in the document, major impacts and mitigations, alternatives to the project). Chm. Garcia asked for comments on the EIR from the audience. There were none. Commission discussed the EIR: an excellent focused EIR; possibility of keeping the train from blocking the Broadway/California Drive intersection will be explored; more discussion on rear access; request for statement from staff on effect of proposal on Bayfront; what business activities will be moved from other Mike Harvey locations to this location; how construction equipment will be stored and where construction people will park; will the exterior of the parking structure be softened with use of landscaping; review cost of possible traffic light and who should pay for signal installation; should address removal of the sheer walls on second and third floors between the new and existing areas; discuss where northbound and westbound Burlingame Planning Commission Minutes Page 2 July 22, 1985 traffic from Carolan Avenue goes to get to their destination if a barrier is placed on Broadway at Carolan; would like to have the complete study on the 5 -day Broadway/Rollins traffic study and the 1 -day Broadway/Carolan traffic study; possible addition of second exit will be discussed at the public hearing. CP Monroe noted that Final EIR will hopefully be scheduled for the August 12 Planning Commission meeting as long as requested information does not require new studies but that there will not be a public hearing at the time of Planning recommendation. C. Taylor returned to the podium. VI. ITEMS FOR ACTION 2. SPECIAL PERMIT TO INSTALL AN 11' WIDE SATELLITE DISH ANTENNA ON TOP OF THE HOUSE AT 1920 CARMELITA AVENUE Reference staff report, 7/22/85, with attachments. CP Monroe discussed this details of this application, staff comments and Commission requests for information (reference 7/22/85 staff report and attachments). Three conditions were suggested for consideration. The applicant, Joe Karp, was present. He had more pictures of the proposed dish antenna site from various locations around his home. The public hearing was opened. Alan Horn spoke in favor of the request. There were no comments against the application and the public hearing was closed. Commission discussion included: exact location of the dish antenna was shown using the additional photos; clarification that applicant had reviewed and agreed with comments in the staff report and whether CP thought that this request falls reasonably within the intent of the ordinance adopted by the City Council;a major concern of the ordinance is the visibility of the dish from other streets and neighbors; size of lot; location of dish in back corner near pool is unacceptable due to amount of foliage and electrical device can't be installed that close to the pool; house in back yard may be capable of supporting the antenna but there's too much foliage so is unacceptable; clear line of sight from antenna to signal source required; would like better criteria before we make a decision; would like to continue review of applications based on merits rather than have strict ordinance. C. Taylor moved to approve this request subject to the conditions in the staff report: 1)that the conditions of the City Engineer's 7/1/85 memo and the Building Inspector's 6/21/85 memo shall be met; 2)that the antenna shall not be installed until the City Engineer is satisfied that the roof structure is adequate to carry the antenna or the roof structure has been modified to accommodate the antenna,in no case shall the city be held responsible for future damage to the roof or structures caused by the antenna; and 3) the city shall be notified if the antenna is moved, removed or its location is altered in any way and an amendment to this permit shall be required. Page 3 Burlingame Planning Commission Minutes July 22, 1985 Discussion on motion: would like to consider fourth condition that 4) That the landscape screening of the antenna from the street be maintained. C. Taylor accepted fourth condition. Second C. Graham. Motion amended to add that the dish color be maintained as green by C. Schwalm. C.Leahy objected to this antenna due to it being visible from the properties a half block away who can look into the applicant's property. C. Jacobs objected to approval of this application because we need more specific, directive criteria when we vote on these applications. C. Schwalm felt that based on aesthetics and screening that application warrants acceptance. Motion approved 5-2 (C. Jacobs and Leahy dissenting). Appeal procedures were advised. 3. SPECIAL PERMIT AMENDMENT TO CONSTRUCT A 4040 SF TWO-STORY ADDITION TO THE ATHLETIC CLUB AT 1730 ROLLINS ROAD Item continued to August 12, 1985 Commission meeting. 4. REQUEST TO EXTEND THE PERMIT DEADLINE FOR THE 800 ROOM HYATT REGENCY HOTEL AT 1333 BAYSHORE HIGHWAY TO MAY 1, 1986 CP Monroe discussed this request. Reference CP memo, 7/22/85, and attachments. The financing package is now complete but new final plan and construction schedule requires May 1986 start date. This change will not affect the formerly proposed occupancy date of September 1987. Commission discussed possibility of extending permit for a full year rather than a few months. C. Schwalm moved to extend the permit to the date requested in the applicant's letter; second C. Taylor. Motion unanimously approved on roll -call vote. Chairman Garcia acknowledged the presence in the audience of Bud Harrison, former mayor, and Joe Harvey, former Planning Commissioner. 5. REVIEW OF PREVIOUSLY APPROVED PERMITS A. SPECIAL PERMIT FOR AFTERSCHOOL DAYCARE PROGRAM AT MCKINLEY SCHOOL B. SPECIAL PERMIT FOR SPORTS THERAPY CLINIC AT 888 HINCKLEY ROAD C. SPECIAL PERMIT FOR A COURIER SERVICE AT 2-4 ADRIAN COURT D. SPECIAL PERMIT FOR A MASSAGE BUSINESS AT 1302 BAYSHORE HIGHWAY C. Giomi made a motion that these four permits be reviewed and approved with no further review unless complaints are received or the operation changes which would require a permit amendment, Planning staff to so inform the applicants. Second C. Graham; motion approved unanimously by roll -call vote. E. SPECIAL PERMIT FOR TNT SKYPACK COURIER SERVICE AT 850 MAHLER ROAD The Commission discussed this item separately. Discussion included: to make this permit legal we should start the permit amendment procedure since they area already 20% larger than they expected to be even Page 4 Burlingame Planning Commission Minutes July 22, 1985 though they are looking for a new location; see no problem with postponing action for two months or three months since they are leaving and amendment procedure is time-consuming and costly; David Parkinson, vice president of TNT Skypack, was in audience and stated that they area currently negotiating on two locations. C. Jacobs made a motion that action on this permit be postponed for three months. Second by C. Graham; motion approved unanimously on roll -call vote. Recess 8:45 P.M.; reconvene 8:52 P.M. ITEMS FOR STUDY 6. SPECIAL PERMIT TO ALLOW A POLYGRAPH EXAMINER SCHOOL AT 1209 DONNELLY AVENUE Commission requests: clarify how the students will get to the site; clarify the business hours; will signage be affected. Item set for action on August 12, 1985. 7. SPECIAL PERMIT TO ALLOW A BALLOON AND GIFT SHOP AT 1199 BROADWAY Commission requests: what does the applicant mean by the truck being at storefront during the day --will it be parked on the street or behind the building; applicant to review the numbers he gave for projected number of customers after 5 PM on Saturdays and Sundays. Item set for action on August 12, 1985. 8. SPECIAL PERMIT TO CONVERT AN EXISTING 10,000 SF BUILDING AT 1722 GILBRETH ROAD FROM LIGHT INDUSTRIAL TO OFFICE SPACE Commission requests: applicant to confirm whether or not rear parking area is still under lease to others and if all parking will be available for future users of the building; do comparison between this application and former Sears service center application; how much of this building was previously in office use; check original building permit to see how this building was described. Item set for action on August 12, 1985. PLANNER REPORTS - REGULATION OF ANTENNAS Reference staff report of 7/22/85 discussing the background of the Council's action and what led up to the 1983 amendment of the code to add the current code regarding dish antennae, considering antennas as lot coverage and pending FCC review of dish antennas and their possible impact on local control of dish antennas. Staff recommends delay of revisions to the code until we see what the FCC does in October or November. Commission discussion included: ground -mounted antennas are considered accessory structures; clarification of whether all roof antennas must Page 5 Burlingame Planning Commission Minutes July 22, 1985 be reviewed under present code; dish antennas are being installed every day regardless of the ordinance and you will never get a complaint because they are so commonplace; a 4' antenna is able to pick up several signals although not as many as a larger dish; the ordinance does not regulate regular wire antennas, only dish antennas; present ordinance allows us to make valid decisions; the FCC action deals with regulation of free speech; whether satellite owners have right to charge for signal or can scramble their signals is also an issue. C. Schwalm moved to wait until November or until the FCC takes a specific action before we take any action to review or amend our present code for dish antennas. Seconded by C. Graham; approved 6-1 by voice vote (C. Jacobs dissenting). - CP referenced 7/16/85 memo from Tom Moore regarding parking meters at 1209 Howard Avenue. - CP Monroe reviewed Council actions at its July 15, 1985 regular meeting and upcoming discussion of Bayfront signage at their August 14, 1985 study session. OTHER BUSINESS - C. Taylor asked staff to review work in progress at 1128 Oxford Road. - C. Graham discussed staff clarifying the difference between service uses and retail uses especially as related to intended uses for the building at 1199 Broadway. - request that staff check up on mast or communication antenna atop the old police station and 60' tower atop the arcade - request that staff look into codes relating to dismantling autos on a residential site.
